If Osama bin Laden was captured...

Oh I'm not saying they would ABSOLUTELY succeed; I've seen far too many instances of plans going south and troops being forced to wing it to believe that everything would ever go smoothly. But the PLAN would be to capture him alive, and given that this would be their orders, the troops would likely do everything possible to do so. Would they succeed? Well, that depends on how good they are. *G*
 
I understood that they have evidence, but not enough to indict. I had been told this by skeptics too, not the CTers. Is that incorrect?

They have not bothered to indict him for his role in 9-11 because the indictments for the embassy bombings are sufficient cause to arrest and detain him. There is abundant evidence that Osama was involved in the plot, including the confession video and numerous other statements he has made. I have no doubt that if he is captured, he will be indicted for 9-11 crimes.
 
once they indict, is their a time constraint within which they have to get him to trial, or is that only after he is captured?

I'm sure it would be easy to convict him on 9/11. It's kind of weird to me that anyone thinks there's not enough evidence and all that. Might be true, but so what? I'm far from convinced he'd deny anything. He'd ruin his street cred, disillusion his and other organizations, and blow his best chance at becoming the biggest martyr that the Islamic extremists could ever dream of. He's pretty crazy, but not stupid.

Personally, I think the smart move would be to just cut to the chase and kill him with a strategic air strike or whatever like they did Uday and Qusay. And then make him look all waxy and weird on the news.
 
I personally do not think that he will be captured alive. The most likely scenario is his being taken out by an airstrike, which would end him and his security team (if he is still using one) nicely. The second most likely scenario is, as sabrina said, his being killed in the gunfight.

It would be possible to take him alive, but you would have to know that you were going after him specifically, and would have to bring a 12 guage or two filled with flex baton. This could still go wrong.

I volunteer to take part in any of the aforementioned scenarios. Hopefully my career tragectory takes me there.

He would be charged for whatever crime that was easiest to build a case against him for.

Saddam himself was charged for a crime much less severe than his worst crimes.
 
The capture of Bin Laden?

It is actually very difficult in my opinion to see that it would realistically achieve anything. This is not to say I would not gladly see this guy put on trial for his crimes but in doing so it could actually make matters worse. If,for example the
US were to bring him to trial, it would simply been seen as his supporters as a show trial, further repression of the Islamic faith. It could actually drive people to further swell the ranks of Al Qaeda. Heaven only know what the reaction would be if he was capture, tried and sentenced.

An international tribunal is an option, but where? Who would do it and under what authority? This could again open up a whole can of worms, clearly countries like the
US would have high stakes in such a trial and the punishment, if convicted would be what? The death penalty? Life in prison?

I really do see any form of trial against UBL, if he was ever captured simply being disastrous, simply because he would be martyred, it would be seen as percussion and could ultimately lead to further acts of terrorism.

I have a sneaky suspicion that the capture of UBL is not really an option, I equally have a sneaky suspicion that a bullet in the head or a bomb from above is the preferred option, but either way it could lead to further escalation of global terrorism.

Not enough to use currently.

Assuming that he was in custody, we don't know what Intel resources that would free up to be able to be used in a public trial. It is possible that certain members of his organisation who are presently in custody could be used as witnesses against him and then we're assuming that he wouldn't just plead guilty anyway, or at least confess but claim he was allowed to do it because Allah told him to do it, or some other excuse for why it was justified.
