It would depend on the crime, but probably. "Using" the gun can be as much as showing it/pointing it at a person, not actually firing it at them. The threshold for actually firing the gun would depend on the type of crime committed, the chances of physical harm to someone at the time, etc. etc. Too many variables to answer that question with a simple "yes" or "no"
