I need your help.

I'm putting together a new site that will be the home of The Amaz!ng Meeting. This is not just for announcements of the upcoming meetings, but also for memories from meetings past.

What I really need is photos (and permission to use those photos) from people who have attended past TAMs.

If you have photos to offer, please send them to jeff@wagg.com, with a short note saying I can use them on the new site. I'll be happy to give credit for the photo if you'd like.

I would gladly send you any pics I have. But you'll have to get the permissions of people portrayed in them from the people themselves (most of my TAM pics are named with location and people in them, which would lead to names like "Frontier - bullriding - MoeFaux.jpg" and such).
I'll see what I have that's acceptable for publication on a website.

Well, you could argue that the photos are being used to promote future events, which is a commercial purpose, and therefore that permission would be needed. It is a commercial venture after all.
 
I believe that if the photos are being used in stories then the primary purpose is clearly journalistic. It would only be advertising if the sole purpose was advertising. As long as no one is being shown in a blatantly embarrassing manner then I can't see any cause for complaint. The very worst that could happen is someone says "Take my picture down" and you take the picture down. No big deal.

What I'm implying is that I'm a lazy SOB, and I have no intention to e-mail or PM dozens of people asking if they would mind having their pic up on the website. Jeff can do that himself, since he'll be having to ask that same question from the same people regarding various other poster's pictures too most likely.

In other words, I'm not saying he has a legal obligation, just that I know Jeff wouldn't want to offend anyone by posting their pictures without consulting with them first. Unlike, apparently, you.

Stop fighting you two! I think if someone wants to give their photos away but makes it a condition that the recipient should gain permission from the people in the pics, that's fair enough. If Exarch tells Jeff that he can use his pics on condition Jeff wears a pink dress for the rest of the day, that is his right.

If Jeff doesn't want to wear the dress, he would have to decline the photos, but we all know that ain't gonna happen. Matching bonnet and everything...

I like the way your brain works. So who is going to bring a pink dress to TAM for Jeff to wear? I propose he has to wear it for one hour, and show up in public wearing it. It's Vegas, so only we will notice no doubt ...

Absolutely. They will need a model release from everyone whose face is recognizable, even if the photographer took pictures of themselves. Informal permission won't be sufficient to protect the JREF if someone who is willing to allow their pictures to be used today decides later that they don't, and the JREF has no model release to produce in court.

Sorry, but that's reality. They'll be using the photos to promote and advertise, and that's a whole different ballgame. Forum users posting them on a forum is informal, nonpromotional use. Making them part of a TAM-promotional site is completely different.

I strongly suggest that all parties involved do some research on the legal requirements regarding the use of photographs of individuals before they are made publicly available as part of this proposed website.

As it stands, they have no legal right to use photos of anyone who attended TAM at a TAM-promotional website without a signed model release. But don't take my word for it, ask a property-rights lawyer. I cannot recommend it strongly enough.

Gotta go with Pyrrho on that point. I have a bunch of photos of people I'm perfectly willing to supply, but I already know that some people in them do NOT want their images published.

Sorry, but that's the way it is in the commercial world. :con2:
 
I guess I have the wrong impression of JREF. I thought it was educational. Others are now saying it's commercial. Is TAM commercial or educational? It makes all the difference.
