Other courts have already ruled on this in the past, for example on Robert Mueller being appointed as Special Counsel which was upheld by the courts under almost identical circumstances.
 
This solves all kinds of problems for Trump in Trump II term. Dismiss all special counsels not appointed by Trump himself.

As a former president, Biden is immune from prosecution, per the United States Suoreme Court.

Although it seems final, this is just another delay tactic.

Justice Thomas all but instructed Judge Cannon to dismiss the case on appointments grounds. This signals he is willing to support the argument in the Supreme Court. But of course Trump will just pardon himself for the good of the country.

On the merits, this was an open-and-shut case of overt criminal behavior. But by dismissing the case as she has, Judge Cannon supports the narrative that the case was only political.
 
Does the government have to return the stolen secret documents? The veteran Russian spies could use more time to fully peruse them.
