Congress pass a law banning Insurrectionists?

The 14th seems poorly thought out, too.

Be that as it may, the various examples of enabling legislation for section 3 were aimed directly at people whose actions motivated the need for the section in the first place. I can't abide the notion that we have to wait to pass legislation until the consequences it would prevent have somehow ameliorated on their own.

No. It's not that people will see it through that lens. It's that the people writing the bill will see it through that lens, and they will tailor it to their opinions about this specific case rather than crafting well-thought-out legislation of general utility.

What then do you see as the appropriate remedy for this specific case? We took it to court, and the court said, "Write a bill." But somehow we can't write a bill.

Do you think we would have had the 14th Amendment if not for the Civil War? Do you think the authors of the 14th Amendment and its original enabling legislation might have had the Civil War in mind when they wrote it?

Eventually, but not now. Right now, any such law will only be viewed through the prism of Trump, and whether or not such a law would or could be used to disqualify him. That's not a good environment for crafting thoughtful legislation.
Oh noes! Trump mite get teh angerz!

GOP controls the House.

How do you expect such a bill to pass?

If Dems win the House and keep the Senate, they will only have 21 days to pass a new law (by killing the filibuster), indict Trump and convict him under the new law.

You really think there is a chance in hell that would happen?

Is preventing Trump from being President again really worth risking a civil war?

Maybe ask the insurrectionist.

Voters.

Indeed, they did. But 1) it's not particularly well crafted, 2) it didn't actually do much, and 3) Jan 6 doesn't resemble the civil war.

Are you certain that allowing him to be President again won't cause a civil war?

If that's what triggers a civil war, well... you could argue electing Lincoln did too. But nobody blames Lincoln for the civil war.

Trump isn't going to start a civil war. If libs start one because he gets elected, that's on them. But I doubt that will happen.
