Donald Trump's bottomless pit of legal problems.

Trump's legal team has just gotten a little smaller, with the resignation of Tacopina.

i wasn't sure which thread to put this in, since Taco Penis was representing Trump in both the stormy Daniels hush money case and the E Jean Carol case. No reason for his resignation was given.

(I do have to wonder if it's because he now sees what a train wreck Trump is, after his closing statement in the NY fraud case, and does not want to have anything to do with it.)

Pet peeve - why does a lot of the media still not simply say he raped her - that is what the court said, there is zero chance of any legal liability for anyone now saying that Trump is a rapist. That's been proven in a court of law.

I had considered that.

But, I assumed that unlike some of Trump's other lawyers (not to name names, but it rhymes with Halina Abba), Taco Penis actually had had some success in past years, so I assumed he would be one that would have actually been paid.

Perhaps Trump - more likely someone currently* on his team has thought they can delay the court cases by claiming they no longer have legal representation and it will take time to find someone and for them to be prepared to defend Trump?

*at least on the team and indispensable until tomorrow when Trump will deny ever even meeting them.

They might have fetched the coffee.

Was Tacopina the only one representing Trump in that action? Or his firm? If your one and only lawyer quits on you during a case, that's usually cause to be granted a continuance. But if it's just one lawyer on a team, no.

No. There were three Trump attorneys listed on the case. Lead attorney is Susan Necheles.

I am pretty sure Trump had more than 1 lawyer on the relevant cases. (Given the fact that the E Jean Carroll lawsuit is currently undergoing jury selection suggests Trump still has lawyers on that case, and I think Habba is still defending him on the falsifying business records case.)

That doesn't mean Trump won't try to use the "my lawyer left me" as an excuse, even if it has little chance of succeeding.

If his lawyer makes the claim it must be true.

Trump continues to lie and use this trial as a campaign platform. After leaving the courtroom where damages for E. Jean Carroll are being determined, Trump said the trial is rigged, he never knew Carroll, and that this is election interference. He then claimed that Democrats can vote in the GOP primary in NH. That's a lie: "Registered independent voters can take part in the primary voting process so long as they choose which party’s primary to vote in, according to the New Hampshire Secretary of State’s website. Democratic voters who choose to vote in the GOP primary need to have switched their party registration, a deadline which passed on Oct. 6.
He also continued with his "Kaplan is a radical Trump hater" and "Trump hating guy" nonsense (an accusation he like to hurl at any judge who doesn't kiss his arse) and said Kaplan was a Clinton appointee but then quickly followed it up saying, "But I'm sure that has nothing to do with it." So why bring it up?

He claimed Carroll "got rid of massive amounts of evidence"; Carroll deleted SOME of the hate mail she got but had plenty that she kept. Besides, this trial

He continued the lie that he only asked for the trial to be delayed one day so he could go to his MIL's funeral and disparaged the judge for refusing the delay.

Alina Habba, his lawyer, was reprimanded by Kaplan several times and threatened to remove Trump form the courtroom:

"There was more drama in the courtroom when Judge Kaplan threatened to remove Mr Trump from the courtroom if he did not stop audibly commenting on the testimony of Ms Carroll.

The judge acknowledged that the former president was probably eager for him to do so, to which — according to reporters in court — Mr Trump responded: “I would love it.”

He brings it up because you're right about Trump hurling invective at any judge who doesn't coddle him. Every judge who opposes Trump's interest is a "Trump hater," participating in election interference, and/or part of the Deep State. I speculate that he caught himself and disclaimed it because he doesn't want another gag order against him.

Again, client control is part of attorney professional practice. If you do not counsel and coach your client on proper courtroom decorum, and take responsive action to quell misbehavior when it, it reflects badly on you, the attorney. Just more evidence that Trump considers every legal action against him to be nothing more than theater.

"...Judge Kaplan threatened to remove Mr Trump from the courtroom if he did not stop audibly commenting on the testimony of Ms Carroll."

You absolutely do not do this in court. If you are the defendant, you sit still, say absolutely nothing, don't pull faces, and listen attentively. Commenting out of order on witness testimony underway is very much contemptible behavior.

Trump didn't make the "But I'm sure that has nothing to do with it," remark because he thought it might get him another gag order, because his other remarks about Kaplan, including calling him "nasty" and a "radical Trump hater" would have gotten him that.

Following Judge Kaplan’s warning, Mr Trump wrote on his Truth Social that he has an “obligation to be at every moment of this ridiculous trial, because we have a seething and hostile” judge “who suffers from a major case of Trump Derangement Syndrome.”

“He is abusive, rude, and obviously not impartial but, that’s the way the crooked system works!” he wrote.

A three year old throwing a temper tantrum has more self-control than Trump.

I don't see why the judge doesn't move Trump to another room where he can see the proceedings via a TV. He could communicate with his attorneys via mic/headphones. There's no need for this media attention action Trump continues performing.

It's a federal court room where cameras aren't allowed. This would be much simpler in a State court room. I wish there were cameras in this court room recording Trump's antics.

So are you saying the mechanics of it are too complicated? Do they never have a defendant in another room such as when the witness is intimidated by the defendant? Or when the defendant needs to be gagged such as here and the image of a tied up, gagged defendant is too prejudicial to the jury?

A closed circuit TV in another room does use a camera but the judge can allow its use. It's excluded from the no camera rule in the facility.

So when does contempt of court finally kick in?

I hope it has bars.

After procedural methods like removing the defendant from the courtroom and verbally admonishing the counsel fail to achieve the desired results. It's up to the judge. I agree with others that most judges seem to be erring on the side of allowing the shenanigans rather than give Trump ammunition for claims that the judges are being unfair to him.

All of this reminds me of Luke, our very middle-class neighbour from a long time ago. We often heard him in the garden telling Toby (his then three year-old child who is likely now at university :o) not to do things alongside various threatened sanctions.

Luke never followed through on his threats, Toby absolutely knew this was the case, and he constantly acted out for Luke. Ingrid (his wife) on the other hand never threatened a sanction that she wasn't prepared to implement and Toby also knew this and behaved much differently when she was in charge.

Trump reminds me of Toby and the US legal system reminds me of Luke.

Commentary elsewhere is that Kaplan is giving Trump zero grounds for an appeal on procedure. Kaplan has gone to more than extraordinary lengths to NOT have the slightest hint of "prejudice" against Trump, justified or not. Because Donny is sure to appeal (it's part of the plan to spin things out forever) on the grounds that "the judge was actively biased against me". He is already laying the groundwork for this, and in my view, his lawyer is helping him bait Kaplan along those lines (VERY unprofessional).

Donny is hoping that if the appeal judge is another Cannon and can be shown even a skerrick of animosity from Kaplan, he might have grounds for such an appeal to be upheld.

ETA: He needs to be put in a soundproof booth in the court where nobody can hear him. The proceedings can be piped in to his headphones, and his lawyer can speak to him privately by phone. Eichmann-style!
