The absolute penultimate step - the very last thing that officially happens before the oath of office is given - is that the president of the Senate - Mike Pence in this case - has to announce the results of the vote. I wondered early on whether he would just announce Trump the winner, on the basis that there could be no norm or expectation put above screwing around with by this bunch of *************.

However, we recently saw Pence swear in Mike Kelly as Senator (Arizona), so perhaps Mike Pence has a single shred of political decency left in him.

I think Pence is in an interesting situation now. I'm sure he was hoping to be the R candidate in 2024 regardless of how this election turned out. Now there is a non-zero chance of Trump running again in 24 with someone else as the VP candidate. Unless he is a complete moron, he knows he can't trust any Trump promise to choose him as a running mate again, nor is he likely to beat Trump in the primaries.

It's a certainty he'll run, the non-zero chance is that he'll win the nomination.
Of course, there is also a non-zero chance he'll be dead or in prison.

I would think so as well.

Legally, there is only one way this ends. The states certify the votes, and in so doing they appoint their electors. Those electors vote, and Biden gets the majority of the votes. Those are counted in Congress and Biden becomes President on January 20.

Everything else is just some variation on "What happens if someone does something illegal?" See....guns.

The one time in American history where people did try to do things illegally, it did come down to threats of civil war. The appropriate phrase was "Tilden or Blood." And what happened then? They made up an ad hoc procedure, and did some negotiating. What happened in 1876 was certainly not described in the Constitution.

In theory, there is one other way this ends which is technically legal. That way is a huge number of "faithless electors" switch the election. In the real world, that is not even a remote possibility, but it's theoretically possible that without breaking any laws, 270 electors could decide to vote for Kanye West, in which case he would be the duly elected President of the United States.

The Safe Harbor Day legislation was a result of what happened in 1876.
 
I presume that the Electors are appointed when the results are certified in the states. It's the states that do the appointing, not the Congress. Or, perhaps they are appointed on Dec. 14 when they meet? This seems a technicality that won't influence the 270 number.

The electors are actually named before the election. Votes for Trump or Biden or anybody are really votes for the slates of electors committed to those candidates. But some Trump dead-enders insist that legislatures can appoint their own slates of electors without regard to the election results. The idea doesn't have much legal support.

I see the 11th Circuit of Appeals tossed out Trump's case declaring it moot, without merit and that he doesn't have standing.

Hell, given his weight, his very unhealthy habits and his belief in woo medicine,I don't think he will last until 2024.

Prison is also possible. One wouldn't think that an American president would ever be incarcerated, but Trump loves to break the rules.

Even if is not enough for a convinction lots of crap is going to come out about what Donnie has been up to. A lot of it, even if it's technically not illegal, will make him look bad to all but this really hardline supporters.

If there's an upside to Trump's behavior, he's testing the limits of what should be acceptable or legal for a president to do, and I'd hope that some holes would be plugged in the law as a result.

Still, I'm putting my hopes on prison.

In any case, it's hard to imagine that he'd ever be elected president again.

Did the AZ governor really do that? That has got to be a new low for the American Presidency-

"This is President Trump calling..."

"I'm sorry, I can't come to the phone right now, please leave a message and I'll get right back to you..."

(...knowing that the reason you're hearing the voicemail is because the person leaving it has absolutely no intention of getting back to you.)

He did. It's been in a number of news clips. He's signing papers and a call comes in with Hail to the Chief ringtone and supposedly he set that ringtone just for Trump. He silences the phone and keeps signing papers.

Exactly. He's pushed the limits and exposed holes that that need to be plugged. For example, we need a Constitutional amendment prohibiting a POTUS from pardoning her/herself, family member, or anyone from any crime directly related to or benefiting the POTUS.

I also find it difficult to believe that Trump could be elected POTUS again. People were fooled it 2016 because he was an unknown entity and some were willing to take a chance on him. He is no longer an unknown entity. We know him for what he is and he has been overwhelmingly rejected.

No one could've imagined that a crime family would move into the White House. It's absolutely mind-boggling.

The key going forward is to protect your elections the way Chris Krebs did. That guy is a hero IMO.

Also fight to keep mail-in ballots to help defeat GOP vote suppression. That stuff is very important. The GOP will tend to lose a fair vote.
