Cont: The Trump Presidency: Part 26

(Debated whether I should put this in the Coronavirus thread, but it does seem to have wider implications.)

Looks like Moscow Mitch's manipulations have had results, and its one that will kill people....

From: CTV News
...the Supreme Court late Wednesday barred New York from enforcing certain limits on attendance at churches and synagogues in areas designated as hard hit by the virus. The justices split 5-4 with new Justice Amy Coney Barrett in the majority....The court's three liberal justices and Chief Justice John Roberts dissented....Earlier this year, when Barrett's liberal predecessor, Justice Ruth Bader Ginsburg, was still on the court, the justices divided 5-4 to leave in place pandemic-related capacity restrictions affecting churches in California and Nevada.

This is exactly why people were concerned... a shift in the court, conservative justices ignoring precedent. And it will get people killed.

Oh look everyone! Religious cults putting the importance of coins jingling around in its weekly collection plates first and foremost, over the health and safety of its daft faithful followers.

Quelle surprise.

Remember bible thumpers, the world is watching....

Trump pushing through dozens of last minute policy changes – including use of firing squads

Donald Trump has sought fast-track authorisation for several administration-wide policy changes before he leaves the White House in January, including the use of firing squads and electrocutions in federal executions, according to a report from ProPublica.

The Department of Justice entered a proposed rule change into the federal register in August. It cleared a White House review earlier this month, and the president could authorise the policy before he leaves office.

Federal executions are typically carried about by lethal injection, unless a judge orders a person to death by other means.

According to the proposed rule change, the administration claims that “death by firing squad and death by electrocution do not violate the Eighth Amendment's prohibition on cruel and unusual punishment”.

Is there some burning need to get this done? It's going to go away on Jan 20 anyway.

Err... "The World" disapproving would likely be counted as a positive by a number of the more... bible thumping among Christians, just to poke at that. So maybe that's not the best warning.

Trump pardons Michael Flynn.
Does that mean he's not protected by the Fifth Amendment?
Right. He can be required to give testimony about himself and others, and if he refuses or lies he can be prosecuted for it.

I'd be curious whether the government will have the backbone to 1) investigate crimes that he might have been involved with, 2) call him as a witness, and 3) jail him if he lies.

Do we know yet what exactly Flynn's pardon is for (just lying to the FBI? All charges? All crimes, whether charged or not)? There is talk about a 'full' pardon, but I haven't yet seen any details.

Detaiis haven't been released yet. I would have thought it would be for "all crimes." But I note that the pardons for Bernard Kerik and Michael Milken name their specific convictions, which I guess would mean they could be prosecuted for anything else.

Barr is still trying to get several people dead before Jan. 20, and one of the grounds for appeal has been that the lethal injection protocol causes unnecessary suffering. I guess this allows him to say, "okay, you get a choice."

And it should be noted that lethal injections cause unnecessary suffering because doctors won't participate in executions and the people who will are illiterate morons.

Justice Roberts seems to be a reasonable sort.

Only when compared with the other right wingers. Roberts, when compared to the whole population is *very* conservative. For example, in cases involving a corporation against a government agency, an individual, etc. he almost always sides with the corporation.

Tweeted by Michael Beschloss:

“George Mason, delegate to Constitutional Convention, said in 1788 that a President should not have power to pardon because he might "pardon crimes which were advised by himself. It may happen, at some future day, that he will establish a monarchy, and destroy the republic."

Firing squads might present a problem for similar reasons.

They'll have to find Democrats willing to man the firing squads because when Repugnicans do it they tend to form a circle.

I think the people on death row would now have more appeals, pushing executions out in time anyway. "Wait a minute, now you are changing the rules in the middle of the game."

The firing squad thing sounds like a Q dog whistle to me.

This sounds more likely to me.

For purposes of National Security, Section 230 must be immediately terminated!!!

Twitter is sending out totally false “Trends” that have absolutely nothing to do with what is really trending in the world. They make it up, and only negative “stuff”. Same thing will happen to Twitter as is happening to @FoxNews daytime. Also, big Conservative discrimination!

I think he's just setting up yet another thing that he knows Biden will fix as soon as he's in office, but which the Trumpers can immediately spin to their advantage. "Biden is so weak on crime, he won't even let us shoot murderers* any more! SO SAD!"

*And yes, I fully expect at least one of them to try to equate "Eliminate firing squads" with "Take guns away from the police", and there will be others dumb enough to fall for this.
