I'm a little bit nervous about Michigan Republicans playing shenanigans. Some of them are definitely hinting at that. But I think perhaps naively that when it comes down to it, this will all pass and Biden's electors will be selected.
Some are suggesting that legislators can choose the electors. But legally they cannot. A state has a right to choose their own electors in whatever fashion they want. But they cannot violate the laws of that State The State of Michigan as well as the other 49 states created laws that leaves the selection of electors up to the voters. The legislature could change that but not after an election. It would have to precede the election. The state in effect entered into a contract with the voters and attempting to bypass the election now would be breaking that contract.
There is also another issue Michigan elected officials would face. If they don't certify the election none of them would be elected officials any more as the presidential contest was one of many on the ballot.
It seems that President Trump has almost exhausted his options to litigate his way to the Presidency so it makes sense to move to the next phase - to get the results overturned through the actions of state legislatures and faithless electors.
The legal brouhaha has been an excellent distraction while GOP leaders can cajole and twist arms in the states. It's looking worrying in Michigan:
Whitmer also implored Senate Majority leader Mike Shirkey (R-Clarklake) and House Speaker Lee Chatfield (R-Levering) to “…put country over party, respect the law, and see through that the will of the people is reflected in our electors and not play games with this fundamental part of our democracy.”
Despite warnings against the meeting, a senior group of Republicans from the state Legislature, accompanied by lawyers, flew to Washington to meet with President Trump.
