I'm in building construction, and the mangling of language is downright sitcomacized.

One guy I work with is entranced with the term 'substrate'. Absolutely anything that is under something else is a substrate. Including, and I swear, that a notepad is the substrate of a pen.

I ascertain that this is an annoyance to you.

Prosecutor reads racist messages by Ahmaud Arbery’s killer
[AP News]

Then prosecutor Jesse Evans asked Langford about a text message Travis McMichael had sent him last year that used a slur for Black people when referring to a “crackhead ..... with gold teeth.”

Langford at first said he didn’t recall receiving the message. Then after reviewing a transcript of the exchange, he answered: “He was referring to a raccoon, I believe.”

 Yes, I'm sure the area is just inundated with wild racoons who have drug problems and dentists...

That's the dumbest thing I've heard this week.

...unless the subject in question was in fact a crackhead with gold teeth. Actually, do we even have crackheads anymore? I thought meth economically muscled crack out of the market.

You misunderstand.

He wasn't referring to a racoon, he was referring to a "coon."

As in, "I thought he was talking about a coon"

“We have substantial evidence that, on the day in question, Mr. Arbery was not a jogger,” said Robert Rubin, one of Travis McMichael’s attorneys. “He was there for nefarious purposes.”

Rubin gave no evidence in court that Arbery was doing anything wrong the day he was shot.

Even if the second paragraph didn't blunt the first, that's still the "citizen's arrest" defence which, as gone over in depth upthread, doesn't make their actions any less illegal.

This is true, but he isn't trying to convince lawyers, he's trying to sway a jury.

Nope, in this particular case, I think he's trying to convince a judge - this is a bond hearing, so I don't think the jury is sitting yet.

However, I do agree that he is likely "putting it out there" to sew doubt in the minds of potential jurors.

Body cam footage released and shows that the police followed proper police protocol of ignoring the dying black man on the ground instead of rendering aid.

Charitably speaking, these cops are very bad at investigating a homicide scene. While taking a statement from the killers, the cop repeatedly interrupts them and puts words into their mouth.

Seems to me the cops was trying to help these guys get their dubious self-defense story straight. Definitely trying to hit certain key elements that paint Arbery as the aggressor while not inquiring about much else. Even then, the narrative they spin isn't very compelling.

Hard to say if this is malice or just regular incompetence. Earlier reporting makes it seem like the PD wanted to make arrests on the scene and were instructed not to by the DA.

The estate of Arbery is suing, alleging a conspiracy by local officials to coverup the wrongful death.

NEWS: on 1st anniversary of his death, #AhmaudArbery’s mother has filed a civil lawsuit in her son’s death.

Along w/ the 3 men charged with his murder, the suit names:

-11 Glynn County police officers
-the (now) former PD chief
-2 DAs who recused themselves
-Glynn County, GA

No idea whether or not this will be successful against the cops and the DA's that bent over backwards not to prosecute the three murderers, but any wrongful death claim against the three killers seems like an easy case given they are likely to be convicted of murder in the case.

Any case against the DA and cops is going to be an uphill battle to overcome the tremendous amount of discretion and immunity granted to these positions of power, even though the original decision not to prosecute the murderers itself stinks to high heaven of impropriety.

…snip….

We’ve seen enough evidence to know it happened - understand that in a court case it is “alleged” until a verdict is given but outside a court case we know there was a conspiracy.

Agreed.

The question becomes is there anything legally actionable. The law gives sweeping discretion to cops and DAs, and even in cases where they pretty clearly abuse that discretion, holding them accountable in courts is often difficult.
