I think the classic example of this is when he got to the point of saying Obama founded ISIS, if you watch that clip you can see that all he does is react to the crowd.

The thing is he has even told the crowd that's exactly what he's doing. At one rally he remarks on the lock her up chant for Hillary. Saying he just tried it, didn't actually believe it, it went over big so he just kept going with it. He tells them that he's just telling them what they want to hear and apparently that is what they want to hear.
 
It makes little difference. 90+ percent of all case law is created at lower levels. By not accepting the appeal they are saying this has already been decided. There is already 200 years of precedence.
I’ve lost track. Didn’t they bundle some cases together? It seems to me Trump’s lawyer have asked that he be declared immune in more than one jurisdiction. Immune from any subpoena, criminal or civil (while president). In that case it might make sense to look for the common thread and make a broader ruling.

I have no idea, though. If district court judges in both the first and second circuits (for example) have been presented with the same argument I can see the Supreme Court accepting both cases for expedited review. But I don’t know what the mechanics of that would be. Might try to figure it out later.

Soon after election he said at one rally he didn’t want to lock her up anymore. He didn’t get much reaction and I don’t know what happened at subsequent rallies.

As bad as the I.G. Report is for the FBI and others, and it is really bad, remember that I.G. Horowitz was appointed by Obama. There was tremendous bias and guilt exposed, so obvious, but Horowitz couldn’t get himself to say it. Big credibility loss. Obama knew everything!

So now Comey’s admitting he was wrong. Wow, but he’s only doing so because he got caught red handed. He was actually caught a long time ago. So what are the consequences for his unlawful conduct. Could it be years in jail? Where are the apologies to me and others, Jim?

They bundled three cases together.

The first involved the New York District Attorney investigating securities and tax fraud.

The other two were Congressional subpoenas and none of them require Trump to do a damn thing. The subpoenas are to third parties including his accountants and banks in possession of his financials.

Trump's attorneys have been arguing blanket immunity of not only any indictment but of any investigation at any level. It was his attorneys that took Trump's saying that he could shoot someone on 5th Avenue and not lose any votes to he could shoot someone on 5th Avenue and not be arrested, charged or even being investigated as POTUS.

I don't recall it being about "drain the swamp" and it was most likely after the election. As always, I could be wrong and unfortunately I ain't having much luck searching.

That could have been it, so maybe it was "drain the swamp". However, as you and Trevor Noah note, Trump telling his audience he was just playing them is part of his shtick and the point being made.

Keep attacking Fox News, Donald. Even knowing he’s protected in the Senate, Trump can’t stand the fact that the House is about to impeach him. If he lashes out enough even a few senators might warily begin to back away.

I can understand not wanting to get your hopes up, but that doesn’t sound like an effective legal argument.

Sorry to sound thick - but are the subpoenas for testimony from McGahn, Bolton etc. included?
