"I felt terrible about that," Sullivan says, after the prosecutor notes Flynn's conduct as a foreign agent ended in mid-Nov 2016. "I'm not suggesting he committed treason," Sullivan adds, further apologizing for his remarks in the prior session.

Sullivan should immediately recuse himself for these idiotic comments.

But he won't, because nothing you feel on these issues have mattered.

Recuse himself?

You have no idea how any of those proceedings work, do you?

Man, if people had to recuse themselves for "idiotic comments", this entire administration up to and including the president wouldn't be allowed to do anything at all.

Conservative hears, conservative repeats.

Trump is just now on Twitter calling someone else a sleazebag.

“I did try and **** her. She was married. ... And I moved on her very heavily“ - Donald “Conservative Values” Trump

He and his cultists are going to get worse and worse as his situation worsens. I expect there will be blood before long.

It's amazing how much loyalty someone with no concept of loyalty can command. Plus he has no ideology and no plan, no beliefs or convictions, etc. That's unusual, I think.

Sullivan was not apologizing for asking about reason, he was clarifying that merely asking about bringing charges of treason is not suggesting that treason was committed.

The reason Sullivan brought up treason was to gauge exactly how much the prosecutors were willing to give up - even a charge of treason? - in exchange for Flynn's testimony. If treason had been an actual possibility, then the government would have been giving up a lot to not charge Flynn with treason.

It was NOT an apology. He apologized for saying that Flynn had worked for Turkey when he was NSA.

The "fix" is the rules and procedures that govern the system in practice. It turns out the guy who has been navigating that for 30 years is pretty good at it.

Yet curiously, as I have shown, the guy navigating that system attacked the defendant based on completely erroneous information and after being corrected, said: ""I felt terrible about that."

As well he should, indeed to toss around a totally loaded accusation is well beyond the pale.

As such the question is : Should Sullivan recuse himself?

I have no opinion on that ___

He knows this. The desperate spin is all he has left.

You so funny. You keep pretending to understand the law and then you say ridiculous things like this. There is no reason for Sullivan to recuse himself as FLYNN plead guilty. Sullivan's ONLY job is to decide where in the range of 0 to 6 months does he sentence Flynn. I've seen people sentenced to that long of jail sentences without a thousandth of the amount of due process afforded to Flynn.

If anything Sullivan bent over backwards for the General asking 6 times if the General was sure he was ready to be sentenced.

Sigh, it was literally a simple yes or no question...

28 USC 455

(a) Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.
(b) He shall also disqualify himself in the following circumstances:
(1) Where he has a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding;

This is reminding me of Trump saying that a Mexican judge (who wasn't even Mexican) could not impartially adjudicate his case because of the totally not racist things that Trump had said.

Flynn is going to have a hard time finding a judge that isn't biased against criminal activity. Bad things happening to criminals is the raison d'etre of the criminal justice system.

I honestly don't have an opinion on that. But I know he isn't going to and the system is going to continue because that is the system.

Federal District Judge Emmet Sullivan, responding to some legitimate provocations, went on a grossly inappropriate rant that ultimately had the effect of bullying a defendant into deferring his sentencing—even though both the defendant and the prosecution were ready to proceed to sentencing and, indeed, even though there was no dispute between them as to what sentence the defendant should receive. Judge Sullivan’s irritation is understandable under the circumstances, and aspects of his reaction were reasonable, even constructive. But as the hearing wore on, the judge looked more and more like the judge featured in the song, who triumphs: “I’m a federal judge and I’m smarter than you—for all my life. I can do whatever I want to do—for all my life.” He delivered a series of cringe-worthy lines which he then had to retract. Neither Flynn nor Special Counsel Robert Mueller can be happy with what emerged—and the public shouldn’t be either.

I don't agree with everything in this analysis, but man did he nail Sullivan's hide to the wall:

“My decisions cannot be questioned by you: I'm always right! And my wise discretion is never abused—for all of my life!”
