In Court today, Judge Wood orders the Cohen team to complete their review of seized documents by mid-June or she will revert to the SDNY taint team

Cohen's lawyer asks for more time than June 15 to get it done.

Wood says review of materials must be completed by June 15. After that, the remainder of the materials go to a taint team.

I wonder what the Cohen legal strategy is. It's pretty clear his lawyers' strategy is to make a lot of money. Could intentional delay be part of the strategy? Hope for a time that is right for a pardon? I don't think so. Pardoning Cohen might sink Trump as soon as he did it. And unless he has a plan to knock him off Cohen would still be around to testify but without the possibility of taking the fifth amendment. Plus Trump can't pardon people convicted by a state.

He might be able to mitigate the prison time if he flips but if the tapes he made plus whatever else he had lying around provide the Mueller team pretty much what they need Cohen's testimony could be moot. Especially since a couple of his buddies have already flipped.

How about this? Some have said that Mueller won't release findings too close to the election, out of respect for the process. Thus, if Cohen slows things down, the results may be delayed until after the election, keeping Congress more likely in Republican hands and watering down the effect of Mueller's investigation.

Just a thought. I've no idea whether Mueller is that close to wrapping up or not, of course.
 
I thought the defense was always entitled to know what the prosecution has on them, regardless of whether they are guilty or not?

Only what is going to be used as evidence at trial.

No, prosecutors must turn over all potentially exculpatory evidence as well.

But regardless, all that refers to after charges are filed, not before.

Neither Cohen nor Trump have been indicted yet. Mueller need not and should not give them a heads up on what the investigation is turning up.

The Feds have their own rules for discovery, and then there are about fifty (i.e. one per state) others, of varying practical assistance to the defense.

One aspect is common to all of them. A prosecutor must disclose any exculpatory evidence to the defense. This includes anything which might exonerate the defendant. Other material evidence might need to be requested, but potentially exculpatory evidence has to be turned over, without the need for any action on the part of the defendant.

One of the quickest ways for a guilty verdict to get overturned is for it to be shown that the prosecutor withheld that sort of evidence. That doesn't look good on their record, so they tend to avoid any likelihood that they'll get caught doing that.

They may try to play fast and loose with other discovery requests from a defendant, but they tend to be pretty careful about that one.

They can only get as much out of him as he can pay. He seems to have a very high maintenance life style since he had to mortgage his home.
