Stormy Daniels Sues the President

It's kind of funny, really. I remember all the repupblican politicians and conservative talk radio folks tut-tutting Clinton about his various sexual escapades and saying that character matters. Apparently that only applies when the president is a Democrat.

Lying in a deposition about a blowjob is an impeachable offence for a Democrat, but violating campaign laws to cover up an affair is not for a Republican.
According to TBD Trump was forced against his will to sleep with Stormy as she used her unnatural power to deprive Trump of responsibility for his actions.

Ah a defence of Trump's actions that could have come straight from the Taliban.

While we all enjoy a good bit of wildly exaggerated hyperbole now and again let us endeavor to at least stay in this particular dimension, shall we?

By the way, Dondi was never translated into Talibanese

By the way, another thing that I said was that this was not the most important case on the Judge's docket?

Well lets take a further gander at the Judge's Summary Smackdown Order:

"This is not the most important matter on the Court's docket."

HAHAHA!!!!

Everything I touch turns to gold!

The judge simply found procedural errors in the plaintiff's action. He made no finding about the merits of the case.

What about the last sentence of the judge's decision, ordering Cohen, "Essential Consultants" and Trump himself to file "responsive pleadings" to the plaintiff?

This case is wide open.

The Judge summarily denied the motion, and politely smacked the lawyer around for wasting his time, violating an order and nor complying with the rules.

The last sentence is a scheduling order. As I have pointed out repeatedly, the responsive pleading will likely be a motion to compel arbitration and Cohen will file a motion to dismiss to boot.

There is also a chance that the judge will rule that Trump wasn't involved in formulating the agreement, but its still enforceable. However, that also brings up the other problem: a lawyer making agreements on behalf a client and not informing them might have legal problems of their own (disbarment or worse). So even if Trump avoids punishment for both criminal charges and embarrassment, his lawyer may not

How though, the agreement doesn't seem to be written to be between anyone but DD and how can a contract between someone be enforceable when on the the principle parties didn't even know about it?

It simply isn't written in a way that makes any sense if trump didn't know about it for it to be valid. For example Cohen or the LLC can not sue for breach of letting the evidence out, only DD can do that as well as choosing the arbitration agency and what state laws are applicable.

It seems a huge stretch for the contract to be valid if Trump was not a party to it.

Avenatti will simply file the motion again when it's not "premature" i.e. after said arbitration motion. No dancing in the end zone until Trump scores, 'k?

Well hopefully this time he will not **** it up so badly that the judge pointed it out three separate times, huh?

He's great law talking guy!

Stop pissing on his Big Day. Let him have the W even if no one else is getting an L. Participation trophies all around.

Seriously if my lawyers ginned up a premature motion, that violated the page limits, did not include info about the service date and ended with the Judge reminding my lawyers that the case wasn't the most important on his docket, and that was the first salvo out of the box?

Yeah, I'd let them know I did not expect to see any of that work showing up on my bill.

In the court of public opinion, he's already got a slam-dunk "public policy" argument for why Little Donnie Two Scoops shouldn't collect $20M from Daniels.

In the ACTUAL court, Judge Otero dunked on little Micky LookatMEvenetti three times today.

That bit about the case not being the most important on his docket? Damn, that is a poster dunk right there.

The Judge wrote: "the parties are advised to carefully review" the Judge's order and the rules.

Oof, that is one hell of a gut punch to Stormy's "super" lawyer.

Micky LookatMEvenetti claimed that today's order does not bode well for the defendants.

Remember folks, the defendants did not even have to file anything because the motion was Summarily denied.

In light of the history of this tawdry affair, from now on we will refer to it as the Stormy Summary Spanking Order.
