No. He's told to put the gun down because the dispatcher doesn't want the cop to shoot him by accident or vice-versa.

Perhaps, but they are taking quite the risk if they are wrong, and if they thought there was no one at home why did they bring weapons? Could it be just in case there was somebody home?
So whoever said it was an act of violence in itself to break in whilst the homeowner is there, so therefore they deserve to be shot, is just making an assumption that these teens wanted a face off and 'were there to torture and kill'.
Are you suggesting that the homeowners should have assumed that the armed intruders meant them no harm? I do not think that it is incumbent upon the homeowner to give the intruders the benefit of any doubt.

But even then, do what the police do. Confront the intruders, point your AK at them and say: FREEZE! Put your hands on your head! TURN AROUND AND GET OUT OF MY HOUSE BY THE TIME I COUNT TO THREE!

Fire a few shots above their heads and watch how fast they get down that driveway. Note the registration number of the car, its make and colour.
Warning shots will likely get the homeowner arrested.

Go back inside. Lock and bolt your door. CALL THE POLICE. Call your insurers, and a handyman to get your window fixed. Get a burglar alarm fitted.
This was, I am certain, done.
 
Given everything that I have read now, I believe that the criminals thought that the house was unoccupied.

And I can't find the dispatcher telling him to stop shooting anywhere in the transcript.

Here:

Peters: "Soon as you confirm the deputy is in the house, I'll unload the weapon."
Dispatcher: "OK, just go ahead and keep the deputy, er, I'm sorry, keep your weapon on your bed and remain unarmed, please, sir."


Obviously, he is being polite.
 
This is crazy. So it is legal to shoot them dead, but illegal to fire warning shots to give them the opportunity to get out.

I despair.

Warning shots aren't simply loud noises a gun makes to scare people. They're fired bullets that continue to travel for quite some distance sometimes through walls.

Here's the deal...if you are in life threatening danger you can shoot someone to end that threat. That's it. If you are shooting for any other reason than to end the threat then you really aren't in danger. You've brought deadly force into a situation that didn't warrant it. What you really want in that situation is a pair of pots or pans to bang together to frighten them away as if they were bears or pumas.
 
And let's not forget they were masked. Three guys breaking in the back door is bad enough but three guys wearing ski masks is pretty hard to interpret any other way.

I agree it's frightening for Zach Peters and it sounds like a really hellish situation to be in, barricaded in the bedroom.

The masks may have been to conceal their faces from potential security cameras.

Thankfully they are not burglars any more.

By the way, I know it's an obscure fact, but brass knuckles are a weapon, not a burglary tool.
