Oh for crying out loud henri - IT IS A FACT THAT KATHY BOND WAS NOT REPEAT WAS NOT INVOLVED IN THIS CASE. It was Shirley Green. Just because you don't LIKE something does not mean it is untrue.

Also, Browning testified to the FACT that he found and removed pj fibers from the murder club. He stored them separetly - he did not leave them on the murder club. The black wool fibers that you keep harping on were UNSOURCED. That is most likely because inmate destroyed most of the family possessions at the end of the Article 32 so that by the time the CID and/or FBI was in a position to attempt to source these items there was nothing for them to compare the fibers to.....HOWEVER, there is plenty of evidence that shows dark wool clothing and at least 1 afghan were in that household at the time of the murders. Again, just because you don't LIKE the FACTS doesn't mean you get to change them to suit your whims.

IF you are unwilling to deal in the truth then quit posting here. we are not going to leave your nonsense unchallenged.

snipped inconsequential opinion.

There is background information to all this in an affidavit by Segal in 1990:

Segal's opinion is as inconsequential as your opinion about it.

The courts have not agreed with Segal's version of events or assertions about Brady violations by the court. The fact that Segal asserts he was correct and his client is innocent isn't exculpatory, and before you go the the sop crime groupie line "but it's a notarized document!" claptrap, all a notary does is verify that the individual appearing before them is the actual individual that is noted in the affidavit. It is no certification that the document is correct.

Still no evidence for your assertion that JM was "the doctor of choice for California police?" Do you just make things up as you go along to defend JM?

He's basically making things up as he goes along. Anybody that can post an absolutely self contradictory statement demonstrates that their grasp on reality is weak.

You can't assert that all witnesses and evidence are equal and then proceed to belittle or ignore every piece of evidence that points to the guilt of the accused, all within a couple of paragraphs.

I suspect one of the underlying reasons that HP wants to grant credibility to certain proven non-credible individuals is that by extension they themselves should be considered credible.

All you have to do is read this thread to learn that he they don't know if they're on foot or horseback.

HENRIBOY: Thank you for being you. As I stated in my prior post, I've had to correct you at least 25 times in the past 14 years regarding the FBI's hair/fiber re-analysis in the late 70's. I know that I've posted the following link in at least 3 of those 25 corrections, but you being you...

Notice how this affidavit was produced a year after Segal's affidavit? This speaks to your penchant for relying on "old" information and ignoring updated information that debunk your regurgitated claims.

Or wash, rinse, repeat.

I think that JM will eventually need to sue Henri for malpractice due to his incompetent representation on the 'net.

Because his defender hasn't been admitted to any BAR association other than the ones that sell booze, he might be in the clear.

I now can't find that information from Kathy Bond that the fibers on the murder weapon were pajama-like fibers. It could be that it's been censored off of the internet because it's politically embarrassing. Whether Kathy Bond or Shirley Green had anything to do with it is not all that relevant. It was Frier of the FBI who was the expert examiner. I'm pretty sure Kathy Bond was Frier's assistant, but I can't now find any information to back that up. JTF always insists that Murphy and Segal were wrong about Kathy Bond having anything to do with it, but I think JTF is talking through his hat. What Shirley Green says in an affidavit is not evidence.

There is some background to this matter at:

www.thejeffreymacdonaldcase.com/html/3-aff-frier_1991-02-08.html

and at:

www.thejeffreymacdonaldcase.com/html/1988-12-17-memo-defense.html

What happened is that about six months before the MacDonald trial Murtagh asked the FBI for a reexamination of the MacDonald case fiber evidence. That was conducted by Morris Clark, Kathy Bond and Frier of the FBI.

Those FBI reports about the fiber evidence was not good for the prosecution, and so it was suppressed by Murtagh for the trial. Clark, Bond and Frier were never called to testify, and the defense never informed of those FBI reports.

What is needed now is for an honest and independent European lab to examine those fibers before Murtagh can arrange for the FBI lab to tamper with and substitute those fibers. Unfortunately the Forensic Science Service in the UK is being closed down by the UK Thatcherite government.

This is what Kathy Bond wrote about the pill box which JTF thinks is so important. "Q89 pillbox contains sew threads ( like blue PJ top). That doesn't sound very definite to me.

This is a bit about what Murphy said about the fibers in his affidavit in about 1991:

"It should be noted here that during this conversation with Murtagh, Bond made the notation "Yarn in Q 100 prev. like blue PJ top," which leads me to conclude that a yarn taken from the debris around the mouth of Colette MacDonald was found by Bond to have been previously misidentified as being similar to the yarn from Dr. MacDonald's blue pajama top."

This is what JTF has said about the matter of these fibers previously on this topix forum. It seems like a weak explanation to me:

"Answering your inquiry is a speculative process, but I'll give credit where credit is due and echo Fred Bost's point that for various reasons, the fiber and hair comparisons of the CID and FBI differed in some respects. I believe that the mass of evidence in this case resulted in the dark woolen fibers being lost in the evidentiary shuffle by the CID in 1970. The mere fact that Stombaugh did not analyze the dark woolen fibers in 1974 and James Frier did in 1979, indicates that Shirley Green was able to correct some of the CID's cataloguing errors."What happened is that about six months before the MacDonald trial Murtagh asked the FBI for a reexamination of the MacDonald case fiber evidence. That was conducted by Morris Clark, Kathy Bond and Frier of the FBI.

Those FBI reports about the fiber evidence was not good for the prosecution, and so it was suppressed by Murtagh for the trial. Clark, Bond and Frier were never called to testify, and the defense never informed of those FBI reports.

inconsequential opinion snipped...

Or more likely you have no idea what you're going on about.

What have "The California Police" have to say about JM? If he was the "go-to Dr." as you asserted, it would be nice to know why.

Man On A Deserted Island

HENRIBOY: Cognitively speaking, you continue to be a man on a deserted island. You couldn't find bigger advocates of inmate than Bost and Potter, yet even they admitted they were wrong when presented with tangible documentation. Examples include...

1) When they viewed the lab notes from the FBI's fiber/hair re-analysis, they quickly realized that Shirley Green, not Kathy Bond, assisted Frier. Green wrote her initials on every slide, vial and pillbox used in this re-analysis. Their embarrassment reached new heights when they realized that they had never read Green's 1991 affidavit.

2) For 11 years, Bost and Potter accused Dwight Smith of being the mythical African-American home invader. In 1997, Bost admitted that Smith was not a viable suspect and this change of heart was based on several factors. The main factor was that Smith doesn't come close to matching inmate's description of the black male wielding the club.

3) Bost and Potter followed the lead of every other MacDonald advocate by admitting that Allen Mazzerolle was in jail on 2/17/70. You remain the lone holdout on this issue, but take heart in the fact that you have sole ownership of your cognitive island.

4) Bost and Potter admitted that it was possible, if not probable, that both pajama and dark woolen fibers were found on the club. They came to this conclusion after reading Shirley Green's notes which mention that she placed two fibers sourced to inmate's pajama top in a pillbox. Similar to Green's 1991 affidavit, Bost and Potter never looked at the following photograph.

I could go on, but I think you get the picture. Still waiting on responses to Challenges 2 and 3.

Oh! Oh! Can I name it?

Isola di Nessun Fatto - in English, (approx) Island of No Facts!

And for the President of this imaginary realm, how about "Capitano Degli Ignoranti." I think even non-Italians can figure that one out.

Everything sounds better in Italian!

Personally, I think Shirley Green was involved in forensic fraud along with Stombaugh at the FBI. Shirley Green claims she did all the reexamination of the fibers on the wooden club murder weapon in 1978, and that Kathy Bond had nothing to do with it, even though Kathy Bond was Frier's assistant.

Shirley Green admits in her affidavit that she was mainly involved in the scientifically impossible pajama folding experiment. There is no real proof that Shirley Green put two pajama fibers fibers from the murder weapon in a pill box. She could have been coached by Murtagh to say that. I think that was false testimony.

Mazerolle jumped bail at the time of the MacDonald murders and that's a verifiable fact.

Dwight Smith, and the curmudgeonly former drug addict local journalist Pat Reese, were interviewed as persons of interest one or two days after the murders by the Colorado Bureau of Investigation. They both lived in the same apartment block. Dwight Smith said he could remember nothing about where he was that night, and then the Colorado Bureau of Investigation were taken off of the case. probably on the orders of Hoover of the FBI.

All I know is that both Segal and the paralegal Murphy were convinced it was Kathy Bond who did the reexamination. It strikes me an attempt has been made to keep Kathy Bond's mouth shut about the matter in case she becomes a whistle blower. MacDonald lawyer Tim Junkin was on the right lines in his legal document in 2005:

In 1990, MacDonald filed a second post-trial motion seeking a reversal of his
conviction based on newly developed evidence, gleaned from the over 10,000 documents
obtained through numerous FOIA requests. Within these documents, the defendant found
the following, never before turned over by the government: 1) Handwritten lab notes of
CID investigator Janice Glisson (who testified at trial) which revealed that numerous
blond synthetic hairs, up to 22 inches in length, had been found in a hairbrush in the dining
room of the MacDonald home, and the hairs could not be matched to any known items in
the MacDonald home;18 2) The results of a 1978 reexamination of critical fibers found on
the body of Colette MacDonald and on a wooden club believed to be a murder weapon.
At the request of the prosecutor, in 1978 three FBI investigators had re-examined certain
crime-scene evidence and found black wool fibers in the debris taken from around the
mouth area of Colette MacDonald, on the bicep area of her pajama top, and on the club
that the government believed was the murder weapon and which was found outside the
home. FBI investigator Kathy Bond, in her hand-written notes, reported that at least some
of the purple cotton fibers previously identified on the murder weapon as matching the
sewing threads on MacDonald’s pajama top were not such, in fact, but were black wool
18 The government countered the 1991 motion by submitting an affidavit from an FBI agent,
Michael P. Malone, that the blond synthetic hairs were not wig hairs. Later, defense lawyers
learned that the affidavit was incorrect.

fibers. These black wool fibers were never matched to any known fabric in the
MacDonald home.19 (See footnote 7, infra.).

MacDonald lawyer Tim Junkin was on the right lines in his legal document in 2005:

1st bolded: Who cares?

2nd bolded: Assuming facts not in evidence and who cares?

3rd bolded: Assuming facts not in evidence, and who cares?

4th bolded: I can't remember where I was on that night, and who cares?

5th bolded: So Segal and Murphy were wrong, assuming facts not in evidence, and who cares?

All your assertions might sound perfectly reasonable on the Isola di Nessun Fatto but anywhere else they remain assertions from the Capitano and are not taken seriously.

it is too bad what you think. Shirley Green nor Stombaugh or Murtagh or anyone else from the government committed fraud (forensic or otherwise). You don't like the facts, you choose to make up your own. IT DOESN'T FLY!

Stick with facts or don't post.

Mazerolle jumped bail at the time of the MacDonald murders and that's a verifiable fact.

No henri this is not a FACT verifiable or otherwise. YOU CANNOT JUMP BAIL UNTIL YOU HAVE BEEN BAILED OUT. AM was IN JAIL on 2/17/70....HE WAS UNABLE TO RAISE THE BAIL MONEY AND GET OUT UNTIL MARCH 10, 1970. THIS IS A VERIFIABLE FACT.

What? Why would the Colorado Bureau of Investigation interview anyone in relation to this case? Colorado is in the CENTER of the USA. Pat Reese and Dwight Smith lived in the Fayetteville, NC area. Oh, and henri the FBI is a FEDERAL agency and CBI would be a STATE agency.

All I know is that both Segal and the paralegal Murphy were convinced it was Kathy Bond who did the reexamination. MacDonald lawyer Tim Junkin was on the right lines in his legal document in 2005:

Kathy Bond did not do the re-examination. get over it! What Segal or an anonymous paralegal "believed" doesn't constitute proof. ON the other hand, affidavits by the individuals such as Shirley Green DO CONSTITUTE proof. In an affidavit you are swearing to the veracity of your statements. That is why Jimmy Britt is damned lucky he passed away BEFORE the government could (and did) prove that his affidavit(s) were not worth the paper they were printed upon. IF he was still alive he would most likely be facing perjury charges (at least).

It Must Be Lonely On That Island

HENRIBOY: I love how you are able to mix and match fantasy with Challenges 2 and 3. Your ability to ignore concrete data (e.g., Glisson's initials written on vials, pillboxes and slides used in the hair/fiber re-analysis), while adding another layer (e.g., Glisson is now under the "forensic fraud" umbrella) to Challenges 2 and 3 is weirdly impressive.

It takes a special touch of the bizarre to makes claims that fly in the face of documented fact. I bet you don't realize that by posting a portion of a 2005 brief, you basically threw Junkin under the bus? In 2005, Junkin clearly didn't know that the Bond claim was debunked in 1991. This calls into question Junkin's work ethic and competence.

I'm assuming that being the ONLY human being on the planet who believes that Mazzerolle was not in jail on 2/17/70, provides you with some sort of cognitive comfort.

Still waiting on your responses to Challenges 2 and 3.

The 'net is a funny thing sometimes.

I searched for information on a particular incident involving a California legislator from the 1980's, and none of the standard search engines came up with anything. It wasn't until I went to my attorney and he had one of his people do some leg work that I found what I was looking for.

I don't believe that the information was "scrubbed" out of public view.

I believe that there is information that wasn't significant enough to be included in any online archive and the only way to access this type of information is to hit a library or archive and go through the hard copies.

No Clue

Apart from it's Ted Gunderson-like qualities, Henriboy's statement...

I now can't find that information from Kathy Bond that the fibers on the murder weapon were pajama-like fibers. It could be that it's been censored off of the internet because it's politically embarrassing.

...speaks to his lack of research skills. The following is an excerpt from Fatal Justice.

Apparently the two threads thought to be from the pajama top were residing in the pillox, because Kathy Bond's initial inventory note, before any actual analyses took place, stated: (2) Pillbox contains 2 short pc's sew thr (like blue PJ top)." An element that causes further confusion is her following notation, "(left as is)." Did this mean that Frier and Bond ignored the fibers in the pillbox, and never examined them, choosing only to examine the other materials?

Despite being the "bible" for the Mac Is Innocent crowd, Henriboy seems to have no idea that the source of this claim is Fatal Justice. If this is true, Henriboy has culled ALL of his information from claims leveled on the internet.

Despite needing 10 years of research to complete their book, Bost and Potter had no idea that this lab notation was from Shirley Green, not Kathy Bond. Their incompetence is wide-ranging.

1) Bost and Potter did not read Shirley Green's 1991 affidavit which is significant for Fatal Justice was published in 1995.

2) Bost and Potter didn't ask themselves why Green's initials were present on this lab notation.

3) Bost and Potter didn't ask themselves why Bond's initials were not present on any of the lab notes in this hair/fiber re-analysis.

4) Bost and Potter did not view FBI photographs 76 and 77 which depicted the pajama seam threads in a pillbox labeled Q89. Those photographs were taken in 1989, a full 6 years prior to the publication of Fatal Justice.

Bost and Potter were journalists. Newspaper reports and media outlet reports of vast and complex matters, like international trade with Russia, and supporting the Cocaine Importation Agency, tend to be inaccurate. I still think the lab technicians, apart from Frier and Kathy Bond at the FBI, were involved in forensic fraud and false testimony so that the trickster prosecution lawyers could win a wrong verdict, and an unsafe verdict by falsely conning the jury into thinking MacDonald pajama fibers were on the murder weapon.

Jeff MacDonald explained accurately what happened in 1988:

TO: DEFENSE TEAM

FROM: JEFFREY MACDONALD, M.D.

DATE: DECEMBER 17, 1988

SUBJECT: 1. JAMES FRIER STIPULATION AT TRIAL
2. MURTAUGH'S [sic] DECEPTION REGARDING BLACK WOOL
3. EXCULPATORY EVIDENCE SUPPRESSED BY PROSECUTION

We just received pages 4,610 - 4,760 from Friday, August 10, 1979, during the trial. Shirley Green had finished her testimony (following Paul Stombaugh) on Friday. Murtaugh [sic] then requested that he be allowed to read stipulations into record that he had discussed with Bernie Segal.

The Key pages are 4,619 - 4,613. The majority of pages 4, 614 -4,760 is a reading of Esquire magazine excerpts.

Key points to remember while reading line 4-17 on page 4,612 are:

01. CID handwritten notes of 1970 show that Exhibit 307 (at trial) was CID Exhibit E-205 (debris from club). CID findings: two "purple cotton fibers matching pajama top" and "blue, green and yellow nylon fibers from rug".

02. Paul Stombaugh in 1974 said that E-205 contains "two purple cotton fibers like those in pajama top". FBI number is Q89.

03. James Frier's 1979 handwritten notes withheld from the defense show that CID E-205 is Q-89 and the finding are:

"Two black woolen fibers--source unknown"

"One green woolen fiber--source unknown"

plus

two green, three blue and one gold fiber, all rayon, from rug"

plus

"numerous white cotton fibers"

04. The 1979 FBI typed report of Frier's findings, dictated by Morris Clark and not Frier, does not mention the crucial black wool findings.

05. Frier is listed as a government witness in the 1979 spring and summer witness lists and was in Raleigh, North Carolina, on standby to testify. He never testified.

page 2

06. In June 1979, the FBI was doing fiber studies on sweaters from 544 Castle Drive, apparently trying to match the mystery fibers.

07. Back in March, 1979, Murtaugh [sic] personally picked up the original and carbon copies of the fiber report disguising Frier's real findings.

08. At trial, Dillard Browning from the CID testified two fibers on the club were matched to the pajama top (i.e. that E-205/Q89 had two purple cotton fibers in it matching my pajama top). He also stated there were only two fibers in the exhibit!

09. At trial, Stombaugh, as the FBI "fiber expert", testified he found two purple sewing threads in Q89 (i.e. debris from club). Importantly he said he looked at them on slides, which Frier's report refutes.

10. The crucial deception: See page 4,612. Murtaugh, [sic] the only person besides Frier who knew of the black wool, lies to the court and Bernie Segal. We stipulate that we agree Frier would testify to the other fibers, i.e. the rayon fibers matching the throw rug. No mention is made of Frier's crucial finding of two black wool fibers! Since we stipulate, Frier does not go on the stand; we can't cross-examine him, and we can't discover the crucial notes. Murtaugh [sic] has, as a safety valve, made the FBI typed report, but no mention is made of Frier's crucial finding in it (in addition, we do not believe the defense received the typed report anyway).

Thus, through clever slight-of-hand, Murtaugh [sic] has intentionally and knowingly suppressed the single most crucial piece of exculpatory material in the case other then the (also hidden) loss of skin from Colette's hand on which the blood type of Greg Mitchell was found!

The black wool fibers put assailants at the scene because the black wool on the club (and in Colette's mouth and on her pajama top) is not from a source in the house.

11. Then almost unbelievably, the government asks me on cross-examination (page 6791, Friday, August 24, 1979) to explain "two purple sewing threads identical to those from the pajama top". My answer: "I cannot".

But, the fibers were known by Murtaugh [sic] to be black wool from outside the house.

12. The final blow is in the closing argument. On August 28, 1979, Brian Murtaugh [sic] tells the jury that the government took two purple cotton sewing threads from the club. Then, Blackburn takes over and states they would throw out the whole shooting match except for two things: the pajama top and the club because two purple threads on the club matched the pajama top and I can't explain it.

And so, the crux of the government case is a knowing lie. The fibers on the club not only weren't blue cotton or purple cotton (they were black wool), but they also were from outside the house. And, when I couldn't answer the government's query based on a lie, I was convicted. The government had subverted discovery for so long we could never do our own testing, and Murtaugh [sic] ingeniously had us stipulate to the one witness most dangerous to the government cover-up and lie, James Frier. If he testified, his cross examination and notes would have provided the defense with knowledge of the real, exculpatory facts, and, would have implicated Frier, Clark and Murtaugh [sic] in the obstruction of justice (and probably Murtaugh [sic] perjury).
