I think this is a case where a retrial is totally unjustified.
With the recording nothing new will emerge, a complete waste of resources. A hung jury means reasonable doubt end of story.
I presume the solicitor general makes the decision like here.

No. Please stop insulting our intelligence and spend a few minutes finding out about jurisdictions other than NZ. Stop making posts that are essentially stupid.

It would be quicker just to state what is the case. That's the point of the forum, collating information and opinions.
 
There is actually a semi-reasonable explanation for it in his post on that body building forum. It's possibly all ghost written, but his story doesn't jump out at me as being outrageously unbelievable.

The struggle took place about 2-3 metres away from the rear glass doors that lead to my balcony. My front door was about 10m away, and has an automatic closer and lock which I would have had to flick then hold open while trying to force her out. This would have been much more difficult and wasn't really an option. Putting her outdoors would have meant I could separate her from me and keep an eye on her through the glass doors until she either calmed down or I called someone like security or police to take her away.

I did read this earlier, and on the surface you could argue that it's reasonable.

The recording completely betrays it. I just listened to it again, and I don't know how anyone could reasonably interpret it as a guy just simply restraining her and protecting himself.

I'm not biased against the guy. I'm aware of how the press has sensationalized and twisted the story (one social commentator originally referred to to the case as a gang rape). I have a particular dislike for mob opinion. I've even discounted his previous behavior that he made public. I think everyone deserves a defense.

That said, I don't know how anyone could interpret that he wasn't intimidating her. His behavior was of a friggin' animal.

A re-trial is what will happen in that event, and as far as I'm aware that's standard procedure.

To say that nothing new will emerge is an assumption; Gable could elect to testify, for example.
 
Aside: Large black man gets drunk with Tostee. Beats Tostee up for an hour and after wrestling Tostee locks him on the balcony. As Tostee is calling the cops he gets a carving knife from the kitchen to defend himself and scare the baddy.

Large black man with tatoo's & biker jacket then climbs over balcony to escape, screaming and hollering but falls to his death.



You see all fof the fuss is because it was a pretty girl. She has the exact same rights and responsibilities as any other adult. But because it is a pretty girl who screamed at the end just the same as had she been an actual victim - there is a knee jerk reaction.

This is the single dumbest comparison I have seen yet. If you had used a legit argument - the guy was tiny and Tostee seriously outweighed him, same result from the balcony - I would be of the same opinion that he is responsible. Has nothing to do with gender.

He put up with her crap because he wanted to get lucky, plain and simple. Certainly not because he was a nice guy. Once that part was over, then he wanted to throw her out. many bad decisions followed. That is my opinion and I am allowed to have it. I had no idea who the guy even was until this post and formed my opinions after reading a few lengthy details. Just because I don't seem to have quite the downtime you do to listen to audio of the whole mess, nor do I want to hear her scream to her death, doesn't make my opinion any less valid than yours. And quite frankly, given the tone and content of your posts, I doubt I can take you seriously.
 
Murder has to be unanimous so I would think that is pretty much a no go given the juries time

Manslaughter doesn't so guessing they're trying to decide whether that or letting him off
 
How anyone can conclude otherwise is a mystery to me.
So was hers tbf.

Doesn't mean she deserved to die though.

Comes across to me as one of those rare occasions when two complete nutters get together smashed off their heads
