from .net a better or at least more readable version: The disciplinary tribunal, presided over by a lay Councillor, Antonio Leone, issued its ruling after the hearing took place in the Palazzo dei Marescialli this morning. Mignini, according to the accusations made by the Prosecutor General of the Supreme Court, had caused “unfair harm to a detainee by the postponement/prohibition” issued “only orally, with serious and inexcusable breach of the law”, of the right to confer with counsel, in obvious violation of the norm contained in the Code of Criminal Procedure which prescribes a “motivated decree” issued in writing and delivered immediately to all affected parties.

The substitute PG of the Supreme Court, Luigi Salvato, while recognizing as 'proven' the facts described in the indictment, had urged at the hearing the acquittal of Mignini, (defended by the Supreme Court Councillor Piercamillo Davigo) deeming the misdemeanor fact 'minor' (of little relevance) taking into account that Sollecito was allowed to speak to his lawyer, Tiziano Tedeschi, before being questioned by the GIP (judge for preliminary investigations) at the preliminary hearing. PG's request was therefore rejected by the disciplinary panel (tribunal) which will deposit within a month their reasons (motivazioni] for the verdict.

ETA - though open to correction I believe the .net translator added misdemeanor to the sentence. Changing the word "fact" to misdemeanor. I changed it.


Mignini received a mild censure for omitting to put in writing Raff could have counsel.

Please note:

1) Raff was told verbally and this is proven in the police transcript.
2) It was obviously human error, as Raff was allowed counsel, therefore there was no attempt to obstruct this right.
3) It is a minor rap on the knuckle, similar to the one received by Nencini for giving a pushy journalist a comment outside the appeal hearing in the corridor after the 'guilty' verdict, which Bongiorno victimised him for by lodging a complaint.

I would recommend Amanda and Raff quit whilst they are ahead.
 
And your postulating that the absence of that evidence is proof that he didnt. Not a very good premise when you consider that only a few swabs of DNA were taken and that Rudy may have been wearing gloves.

You're also suggesting that something is in evidence that isnt. There was no blood outlined ladies sized 37 shoe print in the murder room. Just as those weren't Raffaele's shoes.

If he was wearing gloves, where did the epithithel (sp?) cells DNA come from?

I am afraid there was a ladies shoeprint found size 37 ASCIS please refer to the testimony of Boemia, expert forensic shoeprint analyser.

The other shoeprint found was a size 42. Rudy takes size 45 so how lucky Raff was to get Massei to accept it was Rudy's instead of his, given no shoe was found of Rudy's. It was barred from evidence for Amanda as no shoe was found, so lucky her.

Seems as if they are trying to separate themselves from Mignini and this flawed investigation Say what you want but the Supreme Court issued a stunning rebuke of the investigation and prosecution that Mignini was a principal player.

You are wrong. There was no ladies print. That was a partial print from Rudy. As for epithelial cells, I have no idea what you're talking about. But the world is filled with epithelial cells, it's called dust.

? Rudy had already committed burglary and was caught in the act by the police. If he was punished for this crime and put in jail, instead of what did happen, which was nothing, he wouldn't be available to murder Meredith.

It seems burglary isn't a serious offense in Italy but it is here and can carry a lengthy sentence. I suppose it's a political issue but I do find it interesting that I've never once seen any PGP, supposed Meredith supporters, question the lackadaisical treatment Rudy received for his previous crimes which left him free to wander the streets despite being an armed criminal.

There is no evidence Rudy was a burglar. He was charged later with being in possession of a stolen laptop. That's hardly a profile for a future serial killer.

? Rudy Guede was caught by the police in the process of burglarizing a nursery, with stolen property belonging to the nursery in his backpack. That is burglary by its textbook definition, unless the owner gave him permission to enter the property and take their possessions.

Amanda just happened to be wearing shoes with the exact tread pattern as Rudy's and also left a left shoe print rather than a mismeasured scrunched up left shoe print on the pillow case that, in addition to the other 7 bloody left shoeprints in the room and on the pillowcase, also belonged to Rudy. This is what PGP actually believe!

Nonsense. This is more than 8 years later. They could have cared less before the stunning Supreme Court decision . Mignini and company got bitch slapped by the Supreme Court and Mig's bosses are throwing him under the he bus. They don't want to go down with him if it comes to that.

LMAO. Rudy was caught inside the nursery with stolen goods from a burglary that was committed a couple of blocks from his apartment only a few weeks earlir. Certainly, they didn't have enough evidence to convict him of burglary but that sure sounds like fairly compelling evidence to me that Rudy was committing burglaries.

It used to be that guilters did not talk about Mignini or PLE, was always an obsessive focus on mainly Knox, but also Sollecito their lawyers and the people the regarded as criminals, namely anyone who supported them.

At least these censures force guilters to acknowledge that people like Mignini might have even been involved!

Nonsense. All of this. This is not a minor technical breach at all. Mignini absolutely denied Sollecito (and Knox) access to a lawyer between 6th (i.e. the time of his arrest and detainment) and 9th November 2007. And then Mignini basically lied to the arraignment court and blustered/obfuscated about a written motivation for the denial of counsel. The arraignment court, in the form of Micheli, also erred badly by accepting Mignini's weasel words without protest.

And no, Sollecito did not receive access to a lawyer until literally moments before his arraignment appearance on 9th November. Try to stop making things up to suit your convenience, please......

There was, as a matter of fact, no women's size 37 shoe print found in Kercher's blood in Kercher's room. As a matter of fact, this can conclusively be shown to be a portion of the same men's size 44 Nike Outbreak 2 shoe attributed to (and admitted to by) Guede. The tread patterns can be matched exactly. It was a grotesque error by Boemi and the rest of the police's forensics team to find that this was a print made by a smaller women's trainer/shoe.

The prosecution's "experts" were way, way out of their depth when it came to footprint and shoe print analysis and attribution. They basically made things up to suit the police and PM. They were risibly - and possibly unlawfully - incompetent.

At most, Rudy was trespassing. His claim a woman he met at a party in Milan gave him access, is likely true, as she was sacked shortly after the incident, and he had indeed missed the last train home.

I'm not sure it's funny. It is clear that the experts in Italy will say whatever they are asked. As long as they are paid. It reminds me of the guy looking for a new accountant. He asked the first candidate "what does 2+2 equal?" The accountant says "4." He gets the same answer from his second candidate. The third candidate eyeballs him and replies "what figure did you have in mind"?
 
The box for a pair of size 44 Nike Outbreak 2 shoes was found in Rudy's flat.

As this make was a bestseller, that in itself means nothing. The print found was size 42 (Raff's size) and police identified it as his as it had the same star-shaped defect in the heel.

Raff told police someone must have stolen his trainers to commit the crime.

Raff's defense claimed "the print is far too indistinguishable to be able to identify it as anybody's". (You got it from the horse's mouth!)

Suddenly it is "definitely Rudy's", notwithstanding the ASCICS ladies size 37 shoeprint is disallowed as evidence, as the shoe was not found, but nor was the size 44 Nike Outbreak.

I take size 41/42 (UK 7.5 / 8) and to try to squeeze into two sizes smaller 39/40 (UK 5.5 - 6) would be extremely painful to walk in, even were one able to squeeze your feet into them.

You're kidding right? You're a burglar if you break into homes and businesses and steal things. PERIOD. Rudy most certainly was a burglar . He just was never convicted of the offense.
