Continuation Part 16: Amanda Knox/Raffaele Sollecito

OK, so it's all right to argue Amanda wouldn't notice her lamp was missing as there was enough natural daylight in her room to not spot the empty space on her desk.

But it's not all right to suggest most people do not turn on a light if not needed, and the fact the light switch in the small bathroom showed a smear in the depressed position suggested this action took place whilst dark.

Some people make good detectives, others do not. Mignini is a successful one.

Mignini is a moron. He's also NOT a detective. I have a skylight in 2 of the bathrooms in my home and I never turn the light on during the day. It is not an unconscious act.

You don't know if most people turn on the lights or not, you're just inventing that statistic. But it's irrelevant because many people do switch on the lights at light hours.

I don't think you understood the argument about Amanda's lamp.

Mignini is a thug, not a good detective.

1st hilite - At this point in time when Meredith presumably screamed, as per Guede's account IIRC, (and possibly cooborated by the Oggi pictures of the CCTV video tape from the garage - the different sets of people are all looking in the direction of the cottage, - Filomena's window was already broken. This is supported by the presence of the glass fragment in Guede's footprint in Meredith's wet blood. So the sound comparison to Nara, through her double pained window, isn't a clear comparison.

Whether Meredith actually screamed or not we'll never know. She may have been a woman of action trying to escape from Guede with no chance to scream before he plunged his pen-knife into her throat, and at that point Meredith was beyond the ability to scream.

I just don't know how long it took for Meredith to notice Guede until he overpowered her? If he chased her about the cottage a bit before subduing her, then she may have had the opportunity to scream?

Whether anyone heard Meredith scream we'll never likely know since the police didn't bother to even canvas that apartment building's residents.

It's been awhile since I reviewed those pictures, do you have a link handy? Do you recall the time when those people looked towards the cottage?

Was it around 9:00 pm? I strongly feel that Meredith was attacked shortly after walking in her front door, so any screaming would have been around 9:00 pm, or shortly thereafter.

Secondly, Nara was an elderly lady, IIRC, half deaf, and had previously been confined to a psyche ward in an asylum. She doesn't have to be lying, just have convinced herself that she saw something, and then keep reinforcing it in her head until she thinks its real. Not reliable, but not the same as lying. (I don't know of course whether she lied or fooled herself, but listening to her describe the incidents, I was struck by how much her account seems to have come directly from press reports. The idea her testimony would be comsidered credible is just bizarre. Wasn't she another one of the finds by that cub journalist, Foie?

I agree, Nara was a horrible EAR-witness. YES, the cub-reporter also discovered Nara, but as Nara admitted in that CBS video, the police never did actually interview her and they only used Nara's comments as filmed by that Italian news crew. Unbelievable!

2nd hilite - I hadn't heard this detail before, that Rudy was captured on the CCTV leaving the cottage. (DANO has been great on piecing together what images could be captured on what cameras). I thought Guede was spotted running up the stairs after the crime, when he bumped into a couple on their way down? But I may have that detail wrong. Anyway, I'd like to know more about the reporter claiming to have seen Guede leaving the cottage on the CCTV tape, that's news ot me.

I read it awhile ago but not sure of its source? I know the police had a lot of security footage they never released. Since that one CCTV cam is facing the cottage's gate, if Guede left by the front gate, then he would have been captured leaving, just as Meredith was captured by that same camera around 9:00 pm arriving home. Guede's shoes had a distinctive reflective strip on them, so he would have stood out.

I think the garage had up to 5 security cams scattered about, but mostly the camera footage that is aimed at the cottage's gate was released, probably because at first the police thought the CCTV had captured Amanda heading towards the cottage, but after releasing the footage, everyone agreed that it was instead Meredith arriving home at around 9:00 pm, and not Amanda.

The police also (as is standard practice today) reviewed other security cameras that were located between Raffaele's apartment and the cottage, but when the defense asked for copies, the police said those other cameras had nothing of interest and claimed they had disposed of the footage. Guede lived close to Raffaele, so those other security cams may have captured Guede out and about that night?

Clearly, those other security cams NEVER captured Amanda & Raffaele out and about that night! Of course, they may have flown over all those cameras on Amanda's broomstick?

I'm sure that American prosecutors have occasionally buried exculpatory evidence, but never as blatantly obvious as was done by the Italians in this case!

3rd Hilite - DANO had shown pics or pointed to clothing disturbed around the kitchen or living room, IIRC, its a fair ways up thread by this point. Maybe an overturned chair too? I'm not sure, but I believe there was indications of a scuffle or a chase outside Meredith's room. I imagine her running there and trying to get the door closed before Guede can get to her, when she might have been able to call the police. But obviously that didn't happen, or we never would have heard of the case.

But I do recall there seemed to be some evidence of a chase or scuffle outside Meredith's room, so I don't think Guede first surprised her there in her room.

As I recall, there was very minor disruption in the kitchen area, which Guede may have done either before or after the murder?

As I say, I think Guede tried to leave without confrontation as he had always done before, and found himself locked in. At that point I think Meredith might have noticed him. The only other way out that Guede knew of at that point, would have been Filomena's window, and to get there he'd have had to go by Meredith's room - unless he could have opened another window and escaped - which also might have drawn Meredith's attention.

ETA- OOPS - just noticed that Filomena's room is next to the front door, so he would only have had to start walking back towards Meredith's room to get to Filomena's door, and if Meredith came out from the noise of Guede trying to open the front door, then, they see each other, and the assault is on. Would be interesting to know if any of the overturned stuff were in between the front door and Meredith's bedroom. referring to the layout Grinder posted on page 41, #1637, it seems to be in the right spot. Calling DANO, Calling DANO, Come in DANO... specific details needed...
I find this area of analysis to be fascinating, because I think there's a lot there to piece together.

It is interesting – too bad the police buried all the evidence which didn't conform to their crime scenario.

Here's Google-maps of the area:

https://www.google.com/maps/place/P...c27908da9d521:0x3082c90e3e480c0!6m1!1e1?hl=en

Filomena's broken window was facing 90 degrees perpendicular to the area in the garage where those people were standing, and the distance from them to Filomena's window was 100' with walls and shrubbery in between. Filomena's bedroom was also down the hall from Meredith's bedroom, where all evidence points as the location she was murdered at. If Meredith screamed in her own bedroom, then there's little likelihood anyone across the street heard her scream.

The comparison to OJ is difficult to find relevance because its a completely different crime, with a completely different set of evidence. OJ was also a former world class athlete. Guede was semi-pro, obviously highly athletic, but overpowering a much smaller woman hardly seems an impossible task for him. Meredith's bruises and injuries document how much of a fight she was able to put up, and the single set of footprints in blood, shows Guede acted alone.

The relevance for me is that one man wielding a knife could quickly kill two adults in their prime. OJ may have been a star athlete in his younger years, but by the time of the murder he was out of shape with bad knees.

The other relevance is that Nicole's condo is in a densely packed neighborhood (I've driven by it), and despite the fact she was butchered on her front steps out in the open, none of Nicole's neighbors heard her scream.

Stefano Bonassi Statement 3-Nov-2007: http://www.amandaknoxcase.com/wp-content/uploads/2015/06/Stefano-Bonassi-Statement-3-Nov-2007.pdf

Some interesting things in there....

I left the duvet over the two bed cushions to avoid them getting covered with dust.

The small bathroom is used by all to shower and we leave the window open, as a rule, to let the shower floor dry up.

I don't know what to say regarding the blue pillowcase stained with blood because it was hanging and clean when I left.

I don't know how to explain the traces of blood on my duvet given that my door was locked with a key as well as the window.
Now I'm off to find a pic of the blue pillowcase he says was hanging when he left.

Quite remarkable:

The end of Bonassi's Nov. 3 witness statement includes a reminder that he must maintain secrecy about what he has told the police. This statement does not seem to appear on the witness statements of others that I have checked. Is this statement uniquely applied to certain critical or potentially embarrassing-to-police information?

ETA: Interviewers for Nov. 3: Profazio, Giobbi, Napoleoni (the police in charge of the investigation);
for Nov. 4: Mignini, Giobbi, Profazio, Napoleoni, and two other police officers. This suggests the importance of these interviews as perceived by the police and prosecutor.

We get it.

No, apparently you don't get it. Or you wouldn't refer to Mignini as a successful detective. You wouldn't be referring to claims by Mignini as if they were indisputable facts.

I wish you got it. Just like I wish creationists and global warming deniers "got it". But alas....sigh.

Maybe I could have worded it better: there was a smear of Mez' blood on the light switch. (Put there by Amanda's finger on balance of probabilties.)

The issue about the lightswitch and day time is part of the prosecution's (Mignini) closing submissions at the preliminary hearing (likely similar to the main, not transcribed). He makes an issue that the finger mark depresses the light switch, so was done in darkness hours.

Have you looked at the light switch for yourself? This is pure lies and conjecture.

Someone that wants to do some simple research can determine for us which switch is for the working light and which goes to the wires for the missing fixture over the sink. When the video crew came through in the afternoon of November 2 the bathroom lights were off and diffuse shadows from the light comming through the skylight can be seen under the fixtures. Later that day for the still photography the overhead light behind the door was turned on. If you can spot the switches in the video and compare them to the stills you can determine which switch and which position turned the light on.

...

Then again, maybe Sophie had hooked up with Guede while partying the night before, and Sophie w/ Guede had hatched the murderous plot?

Just kidding since this was obviously Guede all the way.

Did you know that Sophie lived right behind the lawyers office that was broken into through the second story window? Sophie would have had a direct line of sight to that crime from her own apartment. Why do you think Sophie doesn't report seeing Rudy breaking in?

Why, "on the balance of probabilities"? What other evidence supports this, because a simple on-off declaration really doesn't cut it.

There is no evidence at all of Amanda's finger being in Meredith's bedroom or in the bathroom at all. I realize there will be no answer forthcoming from you, but this factoid on its own is pure bollocks.

Lots of good points Ken. I'll just stick to a few things that stuck out to me.

I agree there is uncertainty over whether Meredith screamed, but as others have remarked, guide seems to have made a careful effort to tell lies that hew closely to the truth, like he's covering things that might be verifiable so as to make his tall tales more believable. I'm pretty sure he said Meredith screamed, which he wouldn't know if an outside witness had overheard. That's one thing.

Second is the heavy bruising to Meredith's mouth - extreme violence to her mouth. Suggests to me an extreme immediate need to get her to be silent, and that suggests to me she was screaming (but I'm not a detective as others have suggested might have helped had there been any around to investigate.

And thirdly, there are the Oggis photos from the CCTV (sorry don't have the link, but DANO is great on this kind of thing), different sets of people, all around 9-915pm IIRC, all looking in the direction of the cottage. Trees and walls might provide some sound shelter, but I think its speculation to say "probably" would have muffled the sound. 100 feet is pretty close, and a broken window means its at least more plausible than through double pained glass in newer construction.

Also, if you review the floor plan Grinder posted, the living area is in between the front door and filomena's room, so Guede charging through that space to get to Meredith is consistent with the floor plan. Doesn't mean it happened that way, but I think there is strong correlation in timing, physical lay out, logical, physical injuries, and Guede's own account even taken with a grain of salt.

I agree its amazing the police never canvassed the apartment building. Like the phony moon suits, its more like an amateur theater troupe than a crime scene investigation unit, its no wonder they keep coming up with theater metaphors, like 'staging a break-in', or 'leaving the scene'.

Raf talks about requesting the CCTV camera footage from 2 cameras between his apt and the cottage in front of Judge Ricciardi(?), who denied Raf's request. Raf said it was then that he gave up on getting a fair hearing in the courts. But he also wrote, IIRC, that the police delayed retrieving the footage until it had been taped over. So not sure what your source is on that bit of info.

Last thoughts on OJ. We also don't know if Nicole screamed, although I thought there was testimony from someone, a neighbor I think, about Ron Goldman being surprised, and saying 'hey, hey' something like that. Also, there was the testimony of a neighbor who heard the dog's "plaintive wail". So if Nicole had screamed, I think that probably would have been heard by the same witnesses, but that's just an expectation, not proven of course.

I challenge anyone to conduct this social experiment: find a similar place where people tend to walk down a confined path intended for cars and see how often they look back when the sound of a car behind them can be heard.

There was no positive identification of Rudy on any CCTV tape. Rudy himself provides the times of his arrival and departure from the cottage which are compatible with his guilt. Yet he claims the CCTV images are not him. I tend to believe this as there is no reason for him to lie about it.

The police also claimed the same images belonged to Patrick's friend and alibi Usi. They will make whatever claim suit them at the time. It is clear they are pathological liers. Never believe what the police and prosecutors say. Make them produce the evidence.

These discriptions of a chair turned over, a sweatshirt taken off and left on a chair in the kitchen, papers knocked from the shelf and the drying rack upset come only from Rudy's statements. There's is no physical or forensics evidence to support them except for a free papers on the floor in the hall.

The three exits from the cottage are: the front door which was likely locked with a key, Meredith's window (a 3+ meter drop in the dark) and the patio.

The bloody shoeprint trail from the murder room stops at the far end of the kitchen table (where Rudy says he left his sweatshirt), there is a partial step towards the front door then backs away without compleating that step and finally steps in front of the couch and paces in place while always facing towards Meredith's room and the other exits. In is my beliefe that Rudy at this point is contemplating how to get out of the cottage and ultimately decides to return to Meredith's room to find the keys.

There's also Filomena's's window, through which Rudy entered that night, and surely must have been aware of as a possible egress should he chose to use it.

I agree with your description of Rudy pausing, then going to get Meredtih's keys, that all fits. I also think Rudy trying to get out the front door and Meredith coming out of her room also fits.

If Rudy has no reason to lie about the CCTV cameras, why would he have any reason to lie about papers being disturbed in the kitchen/living areas?

Anyway, all good conjectures.

Aliens caused Sicily fires, say officials

By Nick Pisa in Rome5:36PM BST 26 Oct 2007
Aliens were responsible for a series of unexplained fires in fridges, TV’s and mobile phones in an Italian village, according to an Italian government report.
Canneto di Caronia, in northern Sicily, drew attention three years ago after residents reported everyday household objects bursting into flames.
TV news footage at the time showed electrical appliances as well as cookers, a pile of wedding presents and furniture smouldering.
Dozens of experts including scientists, electrical engineers and military boffins, arrived in the village 60 miles east of Palermo to investigate the phenomenon.

Guede's shoes had rather unique reflective strips which would tend to implicate him in the CCTV videos I saw, but the police claimed to have even better images of Guede (obviously not released) that at the time they claimed could positively ID Guede (note that the police also claimed to have video of Guede walking away from the cottage AFTER the murder):

Fourth suspect in Meredith murder identified

By Malcolm Moore in Rome – 10 Nov 2007

A fourth suspect involved in the killing of British student Meredith Kercher has been identified by police, it emerged today.

The manhunt for another possible killer began after forensic scientists identified a fingerprint in blood on a cushion in the house that did not match any of the three current suspects.

The police now think they can identify him from the footage from three car park security cameras which overlook the house where Miss Kercher was killed. However, he has not yet been named.
[ ]
A fourth man, thought to be a "musician" from North Africa, was captured on security cameras walking hastily away from the "house of horror" on the night the murder occurred.

The police believe he is the same man who was spotted in a nearby launderette the following day at 1.30pm, in the company of a young woman.

http://www.telegraph.co.uk/news/worldnews/1568931/Fourth-suspect-in-Meredith-murder-identified.html

The above article also reports that the police, based upon the parking garage's CCTV security footage which had captured Guede approaching the cottage TWICE (at 7:52 & 8:21 pm) that night, also had the police early on concluding a much earlier TOD (Time of Death):

"Raffaele Sollecito and Amanda Knox spent the entire afternoon smoking hashish," she said, before Lumumba texted her mobile phone in order to arrange a meeting. The judge [Claudia Matteini] said Knox had previously agreed to help Lumumba "have an encounter with Meredith”.
[ ]

The three suspects returned to the house that Knox shared with Miss Kercher just after 9pm, at around the hour that Miss Kercher, of Coulsdon, Surrey, was returning, having eaten a pizza at the house of her best friend, Sophie Purton, the report said.

At the house, Sollecito "bored of the same old evening, and wanting to try an 'extreme experience'" allegedly took part with Lumumba and Knox in a sexual assault.

There you have it! If Mignini had just blamed Meredith's murder on aliens, lots of time and money would have been saved. The real killer would still be free, but since he showed little concern about that ...
