Just a musing:

If the window was such an impossible break-in point for a real burglary as per the prosecution, wouldn't that make it an equally bad staged break-in point?

I suppose, from a guilt perspective (I believe AK and RS are innocent) one would simply argue AK and RS didn't think of everything. A rookie mistake if you will. But then Judge Massimo Riccarelli characterized her as crafty and cunning. How crafty or cunning is it to stage a break-in at an "impossible" point of entry.

You have no idea what’s at issue here, do you.

Toto was recruited as a witness months after he'd supposedly witnessed a major finding in a crime.

It's not a moral issue. You'd send people to prison on Toto's testimony. That's the issue.

He's not. His testimony is criticised because it is incoherent and his lifestyle is adduced as evidence where it is relevant. So, heroin addicts are known to have memory problems, for example.

Raffaele never took heroin. Toto was an addict.

Well whomever broke the window tried,
for heck, they even hit the glass of Filomena's window soooo hard with that rock as to embed glass fragments into the hard wood of that shutter to make it look like the rock was thrown from the carport!

I wonder whose blood and black hair it was that someone placed on Filomena's window/sill?

If the window were a bad break-in point, then why did the landlord put up bars? Captain Amanda is the woman with such nerves of steel that she can break a window with a dead body in the flat. Incompetent Amanda picks an impossible entry point. Go figure.

As you know, retrieved phone records show she cannot have been at Raf's.

Cell phone records indicate Amanda told the truth but don't worry, you're not under oath here :rolleyes:

Who really excoriates Toto for his drug use? It is more for his incoherent testimony and the contradiction to the fact that he never mentioned any of this to the detectives that questioned him at the time of the murder.

Could Curatolo's use of heroin effect his cognitive capabilities? Absolutely. Could Raffaele's use of cannabis effect his cognitive capabilities? Absolutely. Is it likely that use would cause him to conspire to murder someone he barely knew? Not bloody likely.

IIRC the hair strands of Mez, Amanda, Rudy and Raf (presumed) were found on a sponge in Raf's apmt after the murder.

Enquiring minds need to know how they got there.

Your memory is incorrect. You don't remember correctly. If you still think you do remember correctly, please tell us why Mignini kept such important evidence secret from the courts?

Again, you are not vetting your sources. Alessi was placed with Rudy by the Italian prison system. The defense had no control over that though it is conceivable that the prosecution did. Alessi came forward on his own with the claim that Rudy talked about the murder of Meredith not involving Amanda and Raffaele. The court was required to hear this testimony and determine if Alessi's claim was credible.

Why do you think Alessi's claim is not credible? Are you perhaps prejudiced?

The hair and the TMB-positive material from the window are Reps 198 and 199 if I understand correctly. Based on a long-ago discussion here at ISF (which included images of the SALs), I believe that they tried a confirmatory blood test on Rep. 199 and that it was negative. However, again going on memory, the confirmatory test was performed months later. The test for DNA was also negative, but I don't recall when it was done. RoseMontague may remember it better than I do. If there were a delay, then that is sloppy work.

Where is your citation for the blood and hair on Filomena's window sill?

He was a heroin addict from an early stage of his career as a medical doctor.

If you are going to discredit Curatolo on the grounds of his lifestyle, then how very much worse is a child kidnapper and child killer?

I am all for parties bringing whatever witness they wish, as I have said several times.

The character or credibility of a witness soon becomes clear for all to see, so why worry?

In the event, Alessi was deemed unreliable.

Think about it. There is a dead body in Mez' room. Logistically, difficult to ransack stuff over the blood.

The police had an early theory the body was moved into the wardrobe (closet) via wrapped sheets - Mez died in front of it, cornered - and then repositioned, to stage a rape in a position where the body could not been seen from the car park.

For that reason, you would want to stave off discovery for as long as possible, with the staged burglary in a room not viewable from the front.

What does this have to do with anything?

No wonder the investigation went so badly for the police, if this was an early theory. No forensics supported it. All forensics pointed to Guede and him alone as the perp. One expert of nine said more perps, but did not name them. But 8 of nine told Judge Massei that Guede could have done this alone.

The case is closed. RS and AK are exonerated. Deal with it.

But NO ONE would say the same about the homeless Curatolo. He had no idea why he was in jail. And IF you came to the conclusion that his rambling incoherent testimony was accurate, you would have to say that if anything old Toto actually provided an alibi for Amanda and Raffaele.

You can't say he was reliable and then cherry pick his testimony.
