Continuation Part 10: Amanda Knox/Raffaele Sollecito

I understand she had a key, yes. Did she put it on her own key ring (if she had one) or simply leave it somewhere in the house? The evidence discussed above suggests the latter. How would Guede know about this usefully available key? There is no suggestion he broke in.

Well, of course, one unfortunate possibility is that the boys told Rudy that they would be away for the weekend and Meredith could be caring for the plants and cat. We'll never know the answer to that one, though. I don't think he would have gone downstairs if he wasn't certain that the boys were away.

That's the sort of question a prosecutor would ask.

QUESTION - Do you remember what was kidnapped in Amanda's room ?
REPLY - Honestly ...
PRESIDENT - You can look at the record .
ANSWER - Yes, there was a diary, a camera, a computer. The only thing , here , now comes to my mind , entrance into the hall we found the keys the apartment downstairs .
PROSECUTOR - DR. MIGNINI - Where in particular?ANSWER - If I'm not mistaken on the left as you enter , were attached .
QUESTION - Attach to the wall?
ANSWER - Yes, I think so , there in the hall, were in availability of all in substance. Then other things, but what they kidnapped colleagues ...

This says that there was a record of what was acquired from the cottage that day. We just have not seen it.

But this is strange. I was just looking over Mauro's testimony and he says Barbadori was assigned to Filomena's room that day so why is Mignini asking him about objects taken from Amanda's room?! Did nobody review the script before they made this play?

Do these keys look like the keys that were filmed on Nov. 3 next to the hammer in the downstairs apt?

I had assumed she had put it on her key ring with her 2 keys.. to the front door and her room.
Guede had used her room key and possibly the front door key to let himself out so perhaps only 1 key left so he tried it downstairs.
Is it possible that Giacomo had told him he had given his key to Meredith to look after the plants and the two cats?

Communication between Guede & the Boys

Well, of course, one unfortunate possibility is that the boys told Rudy that they would be away for the weekend and Meredith could be caring for the plants and cat. We'll never know the answer to that one, though. I don't think he would have gone downstairs if he wasn't certain that the boys were away.

Speculation 1: Since the DB (downstairs boys) played basketball (how frequently?) with Guede, they may have told him they wouldn't be able to play over the holiday, they were going to their homes in Marche. And would Silenzio mention Meredith would be taking care of the downstairs pot plantation?

Speculation 2: If Guede knew that the DB were gone, and maybe one or more of the upstairs girls, including Meredith, would be home at some time evening of 1 Nov., then the primary object of his burglary may have been rape, with robbery secondary.

Do these keys look like the keys that were filmed on Nov. 3 next to the hammer in the downstairs apt?

What are those keys to? Are they "lost"?

And is that a screw driver on the table as well?

If any of the items on the table are police property and not what the police found in place downstairs, why were they recorded in the CSV? (Yes, I know, the police are "so incompetent".)

Accounting for the downstairs key

Are these the same keys that were on the downstairs table?

The important point of the testimony PM Magnini is seeking seems to be the keys rather than what was in Amanda's room. And why would that be?

I'm actually thinking that this is a collection of items that the cops used to try to get in to Giacomo's locked bedroom. I think they ended up breaking the door in.

They were really hot to trot on there being no reason or opportunity for any person to have gone into that downstairs apartment.

And, the list that he was reading from must have been compiled on November 6/7 or thereabouts. This was the same visit in which the bra clasp and the knife could have been tampered with.

Just because you say it, doesn't make it so.

I'm thoroughly convinced that Stefanoni lied several times. She lied about that her lab had never had contamination issues.

Bah. Quote please. (If you manage to quote, then prove it false)

Welcome back, Machiavelli. I see your memory has failed you (again!). Here is where Massei renders Stefanoni on this point:

Massei PMF 220 said:
In response to a specific question on this point, Dr. Stefanoni declared that she had been working as a biologist for seven years, had always used the same methodology, and had never heard that any problem of contamination of exhibits had occurred.

I see that someone here has thoughtfully archived the actual testimony Massei paraphrased above:

From Stefanoni's testimony May 2rd, 2009:

PM Mignini: Listen, how many years have you been doing this work?
Stefanoni Nearly 7 years.
PM Mignini: Approximately 7 years. Have you worked on cases similar to this?
Stefanoni Yes. Yes, yes.
PM Mignini: Many similar cases?
Stefanoni Yes, various cases of similar complexity, basically, yes.
PM Mignini: Do you remember if you’ve always followed the same method?
Stefanoni Yes.
PM Mignini: In the way you basically collected the samples and then in the analysis?
Stefanoni Yes.
PM Mignini: Right, do you remember any confirmed contamination of samples?
Stefanoni No, such a problem has never been highlighted to me.
PM Mignini: So you have absolutely no recollection [of such a thing]… and you have always followed this same method that you have described to us today?
Stefanoni Yes.
(May 23, 2009, pp. 54-55).

Now if you read the rest of that page you'll see that in batch 4, well B11 showed a count of 34.30, meaning on the 34th cycle it registered human DNA as opposed to going 50 cycles without finding any which is what is supposed to happen, being as it's a negative control and there should be no DNA in it at all. In addition there were over a hundred samples with human DNA where the results were withheld, some of those quite likely because they'd show the copious contamination in that lab which would show up employing LT/LCN protocols.

She lied about the Luminol footprints and the presence of blood

Where? There isn't a single false statement from Stefanoni about luminol footprints. And there isn't any false statement about blood.

Yes there is:

Massei PMF 256-7 said:
With respect to the Luminol-positive traces found in Romanelli's room, in Knox's room and in the corridor, she stated that by analysing the SAL cards "we learn, in contradiction to what was presented in the technical report deposited by the Scientific Police, and also to what was said in Court, that not only was the Luminol test performed on these traces, but also the generic diagnosis for the presence of blood, using tetramethylbenzidine...and this test...gave a negative result on all the items of evidence from which it was possible to obtain a genetic profile" (pages 73 and 74).

As Massei renders it, through quoting Dr Sara Gino, the polizia scientifica did TMB tests on the luminol hits, Stefanoni omitted those from her comprehensive technical report, the RTIGF. As Dr. Gino also notes, when asked in court about the luminol hits Stefanoni claimed they only laid luminol there, which at that time no one could prove differently being as Stefanoni had omitted those results from her report. However when the defense was finally given the work records and other documents it was found that all those luminol hits had been tested with TMB and all were negative outside the one that overlapped where Rudy Guede's real bloody shoeprint had been processed and cleaned by the polizia scientifica six weeks before.

Total bs. It was Vecchiotti here who was dramatically caught lying.

What on earth could this possibly be referring to? How can anyone accuse Dr. Vecchiotti of lying when they excuse so many false statements made by Stefanoni and others when there's definite reason to believe they were not true and were of crucial relevance like whether the luminol hits had tested negative for blood with TMB or whether she was covering up lab contamination?

Machiavelli said:
It's ridiculous, your mind makes up now on this as a habit. On May 20. 2011 Vecchiotti and Conti themselves stated - before Hellmann - that the police lab had sent them all the data they had requested, and they praised their "complete cooperation". Vecchiotti also repeated on Oct. 30 2011 Stefanoni was "correct and cooperative". There isn't a single refusal of a request from Stefanoni in the record.
It's the simple truth.

That's a pathetic response, Machiavelli. The independent experts needed their commission extended by a month because Stefanoni had failed to turn over records in a timely manner. Provide a quote and the correct context for your assertion above.

Machiavelli said:
What is true is Stefanoni made DNA tests under the incidente probatorio statute, the defence expert was there, but nobody objected about lack of negative controls and nobody came to ask for electronic data.
There wasn't any request about EDF from the defence for two years. The requests the defence made at the preliminary hearing were promptly satisfied, as Bongiorno admits. The first time a request of electronic raw data was made was at the end of the Massei trial from Dalla Vedova, and was unintellegible. That was the first mention, oral and not understood by the judge, and was not repeated. No instance was submitted again.

Utter and complete nonsense. The independent experts confirmed in court that the defense asked for the EDFs and the independent experts asked for them as well. That's what led to the exchange of e-mails between Stefanoni and Hellmann's office which can be read here.

acbytesla said:
It's worth noting that not a single sample of DNA that might incriminate Amanda or Raffaele was available for retesting.
Machiavelli said:
I don't know what you mean with such statement. The bra clasp DNA sample was amplified more than once, and yielded two sequences each time (includes the Y haplotype).
The tests were done under the procedure known as incidente probatorio, art. 360 of the Code, that qualifies a test as a non-repeatable event.

He (probably) means that when they went to retest the bra clasp it had deteriorated due to Stefanoni's storage practices and was rendered useless for further DNA testing. When they retested the kitchen knife they didn't find the DNA of Meredith Kercher either.

I'm actually thinking that this is a collection of items that the cops used to try to get in to Giacomo's locked bedroom. I think they ended up breaking the door in.

Any thoughts on where the police obtained the keys shown on the table?

Apparently then these keys didn't fit Giacomo S's door and weren't the ones Giacomo had given Meredith?

Is there an inventory that the defense has from the police on all the contents of the apartments? If so, anything publicly available?

By the way, since Dan points out the window with the sill blood was barred, I have at least for now given up on squeezing Guede through it.

Welcome back, Machiavelli.

{Excerpt}

He (probably) means that when they went to retest the bra clasp it had deteriorated due to Stefanoni's storage practices and was rendered useless for further DNA testing. When they retested the kitchen knife they didn't find the DNA of Meredith Kercher either.

IIRC the bra clasp first test was suppressed and the second test result provided, in a manner that suggests laboratory misconduct.

Diocletus, Chris_H, et al. is this correct?

Diocletus, Chris_H, et al. is this correct?

Right. The first profile, from plate 410, is nowhere to be found. A second profile, from plate 414, which would have been generated the next week, was produced instead.

Contrary to Machiavelli's incident probatorium or whatever, there is no proof that defense consultants were advised of the process to generate the second profile.

Do these keys look like the keys that were filmed on Nov. 3 next to the hammer in the downstairs apt?

No. The keys from the hall upstairs were found on November 6 (or was that November 5 because it was on a Monday when the officer returned from vacation and this was the first thing he did). It's strange how these cops can't seem to remember which day was which.

The keys in the table were skeleton keys like what would be used on an old lock. They likely go to the interrior doors if they hadn't been updated. I suspect that the boys exterior door has a standard euro cylinder lock like the front door upstairs. The euro locks allow the landlord to easily change the locks when the tennents change thus minimizing the risk of an old tennent holding a spare key.

While you are looking at the photo of the tools on the table, look closely at the screwdriver. Under the screwdriver is a flat paper that might be a tissue and under that is a piece of glass. Did Rudy break in and leave those tools AFTER the window was broken?

I wonder if the cops would have collected the keys to the downstairs apartment from the boys when they came back to town to be interviewed, I think on November 3. Yes, I think they would have. Someone might even have innocently hung them on the wall upstairs--seems like a sensible place to store them.

Those dumb cops. They should have grabbed the keys from upstairs while they were conducting their key hunt. If those keys were there.

Yes, that's also true, but I suspect the way Tesla referred to it that he meant that no one could verify Stefanoni's results on either the bra clasp or the knife.

Yes, I believe that's what Tesla meant and that is what is true.

But what Mach said about testing twice might refer to the suppressed and to the provided results for the bra clasp as two separate tests.

Don't be ridiculous. That would be like storing samples in the fridge or forgetting whethef the lamp was really evidence and then later saying, '**** it, we'll use it anyway'. As if that would really happen.

So for clarity, you're suggesting the keys hung up on the wall and found by the police might have been keys the DB (downstairs boys) had brought back with them, rather than the "lost keys" that Meredith had in her possession until she was murdered.

ETA: Thus, Guede may have kept her keys, including her downstairs keys, and disposed of them after he visited downstairs (assuming he did visit there).

Yes, but I'm waiting for Dan O to chime in, because I believe that he has a picture of those keys and I'm not sure when it was taken.
