Just a quick one - would there be any reason in US law to stop (say) Silverstein taking legal action against LC? For suggesting that he was complicit in mass murder/malicious damage to property/insurance fraud or whatever?

I don't think anyone has filed one yet, but a libel lawsuit is very valid, and could end LTW's career fast. I don't think they've gotten enough press for anyone like Silverstein to have been made aware of it, but I expect that if they do get enough press, a libel suit is in their future.

On the other had, they have already been threatened with an intellectual property infringement as they used copyrighted material in the movie without permission.

They really should have consulted a lawyer before releasing anything.

I think if, by some freaking miracle, the film gets into Sundance, then the lawsuit will come. Farenheit 9/11 was one thing, accusing the USG of allowing things to happen. It is another thing for a movie to accuse a private business man of helping to kill 3000 americans.

If it plays, the suit will come.

I think alot of people realize LC is nonsense...at least I hope they do. I think if Silverstein sues, it validates the movie.

Which is precisely why the movie will never get any meaningful distribution. Film distributors know that Loose Change is at least in violation of copyright law, and could subject them to libel/slander action. It's questionable whether such a lawsuit could be won, but the amount of money a film distributor could make off LC isn't enough to make it worth finding out.

Yeah, something tells me the accusations are not affecting his business interests or his reputation among anyone that matters.

Words from a non lawyer.

In order to win a libel suit, you have to prove damages.

As a public figure, Silverstein has an even higher burden of proof.
