Excitement in the Border wars

My son called me today to wish me a happy birthday, and to tell me about some recent excitement that he had a part in. He is a uniformed customs and immigration agent at the Nogales port of entry in New Mexico. Three days ago he was standing guard duty in the parking lot that straddles the border (I've never been there, so I could be wrong on some of the details), along with another officer in a patrol car. He was armed with an M4 carbine, their version of the M16; the other officer had a shotgun in the car. The patrol car parked near his end of the parking lot and the officer got out, when he heard tire squeals from the far end of the lot and saw a Ford Crown Vic or similar accelerating toward the patrol car. He possibly meant to ram the car, or perhaps to push his way through the barricade that marked the border. My son said he took three steps forward, chambered a round and got a sight picture as the car approached; he said he was pulling slack off the trigger when the car dodged a bit and ran between the two officers, spoiliing the shot for fear of hitting the other officer. He apparently did a quick turn after deciding that he couldn't successfully mount the barricade and took off back to the south. As no one was in danger at that point, my son couldn't shoot. He said that is easily the closest he's come to killing someone outright; he is sure that he'd have got him at a 50 ft range through the open side window.

Background: My son is also a captain in the Army reserves, and was at one point a Colorado State Patrolman. He's had plenty of shooting time, though he's probably not trained to the level of our forum member in the Cavalry (can't remember his name right off; sorry).

Was it an attempted car theft or an illegal border crossing?
