Consciousness

In short, we lock Johnny up. We don't call him evil, depraved, subhuman, for his crime. We don't have to dehumanize him to quarantine him from society. THAT's the difference.

And the judge has that same excuse to the extent that he's never heard of this new defense and pretends he cannot find a way to think through it. I mean if he's just going to be a dick about it to spite Johnny for his excuse that is.

Okay I feel like you aren't getting either my point or your own point.

If Johnny doesn't have free will in regards to his actions, then we don't have free will in regards to reactions to Johnny's actions. We can't just up and decide to treat Johnny differently anymore than Johnny could up and decide to act differently.

Where does the Judge's violation or ability to change his actions come form that Johnny doesn't have access to?

That's the problem with the Free Will argument. It always turns into "Okay but you have free will sometimes" argument.

Either you do or you don't.
