Updated: 2:21 p.m. ET June 10, 2004WASHINGTON - David Hicks, an Australian held at the U.S. naval prison at Guantanamo Bay, Cuba, has been charged with conspiring with al-Qaida in Afghanistan, the Pentagon announced Thursday.

Well, did they? Was it "allowable" torture like those memos from admistration lawyers, or was it "real" torture?

Sorry, the guy may be guilty as Osama, I simply don't know, but given the way they've gone about all this, he's going to look like a victim no matter what.
 
Why have a military tribunal? Why not just send him to Australia and let them deal with him?

There is no confession.

Maybe we should wait and see if he's found guilty or not?

Come on Bjorn....you know the deal, they must be guilty because they are in gitmo.....And they could not have been tortured because we don't do that sort of thing. They should be grateful they are even getting some form of trial......tribunal....lynch mob...whatever its going to be called.

Please tell your President. We've been trying to tell him this since the guy got caught. Bush still thinks our capital city is Vienna (and he nearly said it out loud at a press conference with our clown PM the other day too!).

The act of holding him for a protected torture session should have ended long ago. I have said right from the start, he may be guilty as hell of something, but you have to have a fair trial to establish this. The whole process of holding and charging him has had nothing to do with a system of justice. He was held Guantanamo Bay precisely because it was believed legal advice was that norma legal processes did not apply. The court will have it's judges appointed by those charging him, there is no process of appeal. It still stinks to high heaven.

"The rules and procedures abandon the established, fundamental protections that you would find in any civil criminal court or military justice court martial," Mori said.

"David Hicks has not injured any US servicemember or citizen, these are weak charges, where is the worst of the worst?" the major asked.

US Defence Secretary Donald Rumsfeld has described the hundreds of detainees held at Guantanamo Bay as "the worst of the worst" in the US war on terror.

"The Australian government has come out and publicly admitted he did not violate any Australian law," Mori stressed.

An Australian has just been jailed for terrorism, but this was done in a court of law following proper legal process.

And how could he be charged with aiding the enemy? He is not an American.

Our conservative government doesn't want him, because he has broken no Australian laws. I suspect he hasn't broken any American laws either. "Aiding the enemy"? He wasn't smuggling any cigars, that I know of, and he isn't American.
 
Well, it is does not mean much since there is little doubt that this guy will be found guilty, but at least he will be able to speak to his lawyers.

Unlike two of the other Gitmo detainees who are about to face trial have been unable to speak with their lawyers since they do not speak English, their lawyers do not speak Arabic, and no translators have been provided that can speak both languages.

Go figure!
