Another gun thread- Colo state senators recall petition

I think that once major companies started pulling out of Colorado (Magpul for one) people started going "Hey, wait the **** a minute....." and decided to start making changes in their government. I say good for the citizens of Colorado. Too bad people in New York don't have the balls to do something like this. But, then again.....

From the link

"Two Colorado Democratic lawmakers facing recall elections for their support of the state's strict new gun control laws failed in separate attempts to block or slow their recall elections Wednesday......Jennifer Kerns, a spokeswoman for the group attempting to oust Morse, told The Denver Post that any further legal challenge would amount to an attempt to "delay and deny justice" to Morse's constituents.....Giron and Morse are being targeted for recalls because they both supported gun control measures.......If Morse and Giron face recall elections, they'd be the first state lawmakers to go to a recall vote since Colorado adopted the recall in 1912."

There is an interesting precedent that could be set here for the people and politicians of Colorado. Recall votes over policy and not because of impropriety or other unsuitability to hold office issues.

I suspect it has something to do with violating the constitutional rights of their citizens; which isn't policy and is indeed improper and a violation of their oath of office.

In California, there was an effort to recall one of the legislators behind the original Ca. assault weapons control act, David Roberti. This is what ended up happening to the backers of that recall effort:

Record Penalty Levied on Foes of Gun Control : Politics: Californians Against Corruption must pay $808,000 fine for failing to adequately report its finances during recall attempt of Roberti.

I wish the people in Colorado better luck.

The recently enacted laws in Colorado are less restrictive than the ones that have been on the books for years in California. Is the Federal Constitution that applies to Colorado somehow different from the one that applies to California?

In Mcdonald v Chicago, the SCOTUS incorporated the Second onto the states through the due process clause of the 14th Amendment.

Cases are playing out as we speak, in California and elsewhere, and we'll need to see how those cases will wind their way through the courts.

The California firearms laws in question are old enough to drink.

What defition are you using for major companies here? And given that Magpul is a private company how do you know?

Are you under the impression that you are 5 supreme court judges?

Considering the number of gun controls already in existence that must mean loads of politicians have done exactly the same thing. So how come this tool has not been used to remove them from office?

The rough and tumble world of politics where actual democracy and voters get pushed to one side.

I don't know. Anger, perhaps? After 10 years of the feckless AWB, I have to tell you I was pretty angry when Feinstein proposed doing it again. I think that with the recent federal decisions, the constitutional aspect is coming to the forefront. Maybe the Coloradans involved in the recall have just had enough?

Some of the rural counties are talking of secession, citing the population shift from rural to urban and claiming that state lawmakers are only considering the interests of city-dwellers.

What Californians Against Corruption was accused of was improper documentation of campaign donations - not misuse or diversion of funds - and they were eventually hit with the largest penalty ever levied against a campaign operation.

I suspect their real crime was being effective.

There's probably a hell of a lot of truth to that.
