It appears President Bush violated the constitution again. Does the judicial ruling now mean that anyone who associates with Bin Laden or AlQaeda is OK now?

Just a side question: Is it possible for someone, let’s say me or a lawyer, to designate as a terror organization someone you dislike? How would this be done? Just curious. For example, can I designate certain outfits of organized crime that I happen to know as terrorist organizations and have them prosecuted and jailed—or better yet, have them sent to Gitmo to be interrogated? I mean, can I perform something like a citizen’s arrest.

A federal judge in Los Angeles has ruled that President Bush’s designation of 27 groups and individuals as “specially designated global terrorists” in a Sept. 23, 2001, executive order violated the Constitution because it was made without any announced standards.

No. First off, Congress has already declared war on Al Qaeda, so they're in our crosshairs regardless of this ruling. Second, this sounds to me like they just have to make their criteria for this particular order explicit, and indicate why each designated entity fits that criteria. Which they will most likely do, and so nothing fundamental will change.

OR, we could just label them terrorist suspects beforehand, wiretap their phones, kick down their door and drag them to Guantanamo. We could claim their drug business was how they financed their terrorist business.

Hey, that could work for parking tickets too. Just think, we could bust into anyone's home (after the obligatory "ties to terrorism", of course) just to see what they had in there. Most cities would go along with it because we'd let them collect for parking tickets, city utilities, library fees and the like. It'd be a great time to round up some guns too. Anyone that shoots at us eventually gets killed, the rest get taken to a secret camp in Detroit. ;)

How can you declare war on an organization? :confused:

I cannot declare war on anyone - at least, not in any meaningful way. Congress, however, can declare war on pretty much any non-US entity they choose to - I know of no requirement that such an entity be a UN-recognized independent state.

war on drugs

war on poverty

war on illiteracy

war on terrorism

war on illegal immigration and so forth. Too bad we haven't declared war on stupidy, we KNOW where the WMD for that is, it's somewhere north, south, east and west of Washington D.C.
