    Why is the Supreme Court deciding this?

    Why is the Supreme Court deciding about whales vs. sonar? Either Congress intended it to apply to the military, or it didn't. This issue should not be in the Supreme Court. Congress should grow balls and specify it, otherwise shut the hell up both them and the court.
