The Biden Presidency (continued)

For example, he could simply pardon every person of the crime of being illegally in the country.
That would be a tricky thing for this SC to untangle.

At the very least, he absolutely needs to pardon everyone involved in prosecuting Trump - not because they committed any crimes, but because they and future prosecutors and investigators need to know that they will be protected and not left to fend for themselves.

I think the last Biden Presidency thread didn't make it through the forum migration.

Since there are still 2 Months or so in this Presidency, it deserves an active thread.

And there is a lot of things Biden could do still.
Biden seems to be planning to go with a bang. He has authorized the Ukraine using long range American missiles to fire into Russia. Now I read he is suggesting sending nukes to the Ukraine. Has he gone senile, or what?

Where did you read that he was suggesting sending nukes?

I'm sceptical of that source.

Yeah, no.

Yeah, I'm thinking some big blanket pardons are in order, but without a lot of fanfare, just quietly issue them to those that are clearly in Trump's crosshairs and other 'at risk' individuals.
We've had this discussion before:

"Due to the findings in the 1925 case, Burdick v. United States, it seems as though accepting a pardon is, in fact, admitting guilt. In Burdick the appellant was offered a pardon but declined it, also refusing to testify in criminal court. The opinion of the case given by the justices seemed to uncover that 1) a pardon can be given before a conviction and sentence; 2) a pardon can be refused, and 3) acceptance of a pardon implies acceptance of guilt. "

What you suggest is unethical and an abuse of the power of the pardon.

Biden has commuted the death penalty for 37 of 40 death row inmates. The three exceptions are all convicted of terrorism (Dylann Roof, Dzhokhar Tsarnaev of the Boston Marathon bombings, and Robert Bowers of the Tree of Life synagogue shooting).

Just been announced on a Radio 3 news bulletin. They also said that the Orange One can't reverse the pardons when gets inaugorated. Is that right?

The President's Pardon Power is pretty broad with regards to Federal Crimes. It was designed to be the last stopgap measure in case everything else in the criminal process went wrong for whatever reason, so putting limits on it kind of defeats the purpose.

Besides, if Trump pardons himself, he would want that to stick.

See, this is a good use of the pardon power. Good on him for that.

Really annoying that Biden managed to decide who on death row gets their sentence commuted, but not for those who were on home confinement - there were some nasty pieces of work that should have rot in jail.

I think that one led to the other. He went with a blanket commutation for the COVID home confinement cases, then got dinged because there were some real ◊◊◊◊◊◊◊◊ in there. He was also thinking about a blanket death penalty commutation, but after the political fallout from the first commutation hit, he decided to keep a few of the real ◊◊◊◊◊◊◊◊ on death row.

I have no proof of this, but that's how it plays out in my head.

And, true to form:

"Biden gave Liz Cheney a Medal yesterday, even though she has proven to be totally corrupt," Trump wrote on Truth Social. "Biden rewarded her only because she hated 'TRUMP' ... This is not America. January 20th cannot come fast enough."

In her response, Cheney continues to prove she is one of very few Republicans with a spine:

"Donald, this is not the Soviet Union," Cheney wrote. "You can't change the truth and you cannot silence us. Remember all your lies about the voting machines, the election workers, your countless allegations of fraud that never happened? Many of your lawyers have been sanctioned, disciplined or disbarred, the courts ruled against you, and dozens of your own White House, administration, and campaign aides testified against you."

"Remember how you sent a mob to our Capitol and then watched the violence on television and refused for hours to instruct the mob to leave?" she continued. "Remember how your former Vice President prevented you from overturning our Republic? We remember."

Cheney then urged Americans to oppose Trump during his second administration to protect "our Constitutional Republic."

"And now, as you take office again, the American people need to reject your latest malicious falsehoods and stand as the guardrails of our Constitutional Republic — to protect the America we love from you," she wrote.

Thanks to Biden's speech, we will fix the issue with dramatic wealth inequality, just like we fixed all problems with the Military-Industrial Complex after Eisenhower mentioned it.

I don't blame Biden for running in 2020. Most people outside the US have no idea about our odd primaries state by state. The primary voters pick the canidate. It happened to be Biden. Many good Democrats were looking to save their career and it looked like an election Trump would win. They (various governors) had plans to come in during 2024 when we would have been done with Trump and he clearly is not grooming a successor. He is one of a kind.

2024 was different. But the candidates that had a chance to beat Trump remainded relative unknowns. Trump did everything right to be in the news. No regular politician would have worked.

I was a little unclear. If Biden had decided not to run by 2023, there still was no time to prepare anyone but Harris.
Trump did everything right to be in the news. No regular Democrat politician would have worked.

I blame him for not running in 2016, when he'd have had a better chance than Clinton of putting an end to MAGA.

Biden has issued preemptive pardons to General Milley, Doctor Fauci, and the members of the January 6th commission, in order to protect them from trump's proposed revenge.

There are new things to explore for Trump:
-use executive order to erase pardon
-veto the constitution
He has not used veto enough!

Why not ages ago?
Was this supposed to be some kind of gotcha?
He was watching Trump to see how revengey he seemed to be leading up to the end, and apparently concluded it was more likely than not. Unlike most of us, Biden has actually met with Trump in person recently.

And this has unleashed the predictable flurry of comments to the effect that this confirms their guilt, making them susceptible to prosecutions in other jurisdictions.

You have to accept a Pardon for it to become funcional.

Biden could have just pardoned everyone remotely on Trump's ◊◊◊◊◊◊◊◊, and if they don't like it, they don't have to accept it (I think Schiff said something along those lines). There was no need to wait until the very last second.

Hopefully there was no need to do it at all.

Surely Trump can just rescind these pardons as part of his “official” duties?
Well, the pardons were valid under U.S. law, but that doesn't mean they hold under the new Galactic Empire! They'll regret their impudence as they toil in the new prison colony on Mars.
