Continuation Part Six: Discussion of the Amanda Knox/Raffaele Sollecito case

But if she was dragged by her sweatshirt, wouldn't that necessarily mean the upper half of her body had to come first with her lower body trailing behind? If you see what I mean. It's in that scenario I can't see how there could not have been obvious blood on her jeans.

I agree with your second paragraph, but remember that here we're trying to account for the absence of evidence: why there was little blood on her jeans if she was wearing them during the attack. Even if this is possible, it certainly doesn't support the theory she was wearing them, it just doesn't rule it out.

No, I think that Hendry's hypothesis (which also matches the blood evidence) is that Guede pulled Meredith sideways around in an anticlockwise arc*, thus moving her head away from the wardrobe door and closer to the bedside table.

* In other words, picture Meredith lying on her back, with her feet as the "pivot", and Guede pulling her round anticlockwise by the upper body, so that her feet essentially stayed in the same position, but her upper body moved round to the left, from the wardrobe to nearer to the bedside table.

Isn't Ron Hendry's theory that she was dragged through the blood backwards by the sweatshirt until it came off? Which part of her body made the drag marks in the blood?

If you were looking down with the wardrobe at the top, Guede dragged her sideways from right to left. Hendry thinks he dragged her by the blue jacket until it came off with the sleeves inside-out. He only moved her a couple of feet, and he didn't drag her lower body through the pool of blood in front of the wardrobe.

Everyone (that I know) agrees she was on her knees, facing the wardrobe, when her throat was cut. Somehow she ended up in the middle of the room, on her back with her legs spread and a pillow under her buttocks.

I don't think all the defence experts agreed with that theory, did they?

From the diagrams I've seen, she was lying diagonally across just the left half of the pillow - not lying in the middle of it - with one leg straight and the other slightly bent and to the side. In other words a position which doesn't preclude an intended sexual assault but also could simply have been the natural position in which her body fell when she was on her back. She wasn't lying with "legs spread" and her buttocks positioned carefully in the middle of the pillow, so your description there is a bit misleading.

Right, except she was face down or on her side when he moved her. He pulled her upper body with the jacket and then he moved her lower body so that she was positioned as she was found.

He could have left her where she collapsed if his aim was to silence a victim who he had already raped.

I believe from memory that one or more of the police Luminol photos actually showed the exposure settings, but I can't be bothered to check back right now. However, I feel confident to assert that these photos were significantly overexposed, and that therefore the results are immediately questionable.

All of the crime scene photos have the standard metadata showing the exposure settings. However, the luminol photos were all edited in photoshop the next day and the changes to the exposure then were not recorded.

I think I'll have to continue this discussion tomorrow LJ (dammit, I always lose track of time when I post on here) or I'll be even more zombified at work than usual. I'm not convinced those are 'drag marks' at all, actually; for example, there are spots of aspirated blood visible within those marks, which surely would've been smeared if the weight of a person had been dragged through them shortly after they'd been made. Anyway, tomorrow.

I do agree with you on this earlier point though:

I personally think it's unlikely that Guede left Meredith to die (which would probably have taken between 10 and 15 minutes from the time of the stabbing) before carrying out the sexual assault (whether digital or penile penetration). I think that he would probably have been so aroused and adrenaline-fuelled that any post-stabbing sexual assault would have been carried out (and concluded) much more shortly after the stabbing had occurred.

I think it was actually determined to be less than 10 minutes (IIRC it was just 2 or 3 minutes, but I could be wrong). But I agree with the above in the sense that I think the least likely scenario is that he stopped, went into the bathroom, then went back into the room to complete a sexual assault. I think either he stopped the assault at the time of the fatal injury, or he continued in an adrenaline-fuelled frenzy, but continuing following a pause seems very unlikely to me.

BTW, you didn't answer my question as to whether the stain turning out to be something other than semen would lead to you altering your opinion on what happened? Feel free to answer tomorrow. :p

I don't think all the defence experts agreed with that theory, did they?

I don't know how else anyone could account for the pattern of blood droplets on the doors of the wardrobe closet, or the massive amounts of blood in front of that closet. What is your theory?

From the diagrams I've seen, she was lying diagonally across just the left half of the pillow - not lying in the middle of it - with one leg straight and the other slightly bent and to the side. In other words a position which doesn't preclude an intended sexual assault but also could simply have been the natural position in which her body fell when she was on her back. She wasn't lying with "legs spread" and her buttocks positioned carefully in the middle of the pillow, so your description there is a bit misleading.

I didn't say the pillow was positioned carefully, nor did I say how widely her legs were spread. Do you think I am distorting the facts to protect a theory? I would say I am going by what the physical evidence appears to show. If I'm wrong, walk me through the details and explain where I got it wrong.

I wouldn't go so far as to say every room was inadmissible, but they can't pretend that nothing was disturbed in every room, especially in Filomena's for the reasons you mention. However once the Polizia Scientifica were done the idea they could come back six weeks later and the place had any detailed and specific forensic value is absurd, they'd trashed the place.

Most certainly, to belabour the obvious, Meredith's room is completely admissible. The big (and perhaps safe) assumption is that whoever locked Meredith's door (99% chance it was Rudy, regardless of the position of the footfall outside) inadvertently preserved the room in the kind of condition arguably representative of the murder.

A close second is the bathroom, particularly the bathmat. To repeat a point made by PIP ad naseum, any trace genetic profile belonging to Amanda Knox is hardly surprising in the bathroom, and hardly indicative of her being at the cottage the night of Nov 1, to the exclusion of all other times.

It's always been a forehead slapper to say that Knox's "Biological profile" as referred to by Massei, mixed with Meredith's blood, is somehow indicative of guilt.... particularly beyond a reasonable doubt.

IMO the core of any guilt case is the theoretical assumption underlying it that the whole upstairs of the cottage had somehow been wiped forensically clean prior to 8 pm on Nov 1, ready to receive incriminating samples from everyone involved. Yet in that hallway towards Meredith's room and the bathroom, it was well travelled before the door was forced open to reveal the horrible tragedy.

Filomena's room was admissible, but where is the detailed investigation into that? Particularly outside, esp. if someone is trying to claim that no one entered through Filomena's window?

Amanda's room was admissible in the sense that the clothes she wore at the time of the murder (well, that she had at Raffaele's!) were found on the bed in her room right where she said she put them. I had an argument with Machiavelli about that a while ago, and regardless of the pedantic posturing, it is incredible that those clothes were not bagged the first day! (Or at least on Nov 6 after Knox's arrest!)

What did Peter Q. say about the bra-clasp, when he was trying to pin the blame on the defence lawyers for blocking the collection of the bra-clasp for 47 days? He said something akin to the bra-clasp being noted on Nov 2 as to-be-collected by the Scientific Police, while blaming the defence for it laying there for 47 days.

Aside from the fact that there WERE NO DEFENCE LAWYERS between Nov 2 and (what was it) Nov 8.... what does noted for future collection mean? To me it means that the Scientific Police were unusually incompetent! That Massei let's Stefanoni off the hook for the non-collection of the bra-clasp, and sustains Stefanoni in not testing the presumed semen-stain... well that says buckets about the integrity of some judges in Italy...

One of the very first websites I read that had a pro-innocence slant to it made the comment that to solve crimes like this, you start in the immediate-intimate vicinity of the victim and work your way outwards. The webmaster reasoned that Amanda and Raffaele most be innocent, because it is only going to the far reaches of the "outer edges" of this crime, that one even finds anything to suspect them of something.

And as noted, incredibly, Patrick Lumumba's apartment was never considered a "crime scene" in the way Raffaele's apartment was. What was THAT about?

I just had a thought;

what would happen if you google-translated good English into Italian and then back into English?

It is a little odd, when you think about it - no real improvement in his English in over FOUR YEARS of posting (and, presumably, reading), what must amount to several hundred-thousands of words by now.

Your theory is shot down by the fact that the google translations have not noticeably improved over those years.

ETA: Oops, I blame Google for that.

You need to reread what I wrote. I said that blood could be there in a very diluted state and it could even be from long ago because blood is very hard to get rid of.

I agree with the later, I was simply addressing the former. How does diluted blood get connected to the murder, notably the ones that couldn't have been wiped up as they're still well-defined, even in the unlikely event that someone would take the time and care to remove the invisible ones and not disturb the barely visible ones when it would take five minutes to remove them all?

Seems unlikely to me but I do think Amanda could have transferred the blood from the mat.

That as the final destination of the foot on the bathmat during that little ride would be a great explanation if the foot actually matched Amanda's. Otherwise the best I ever heard for that one was Withnail's suggestion it was where a girl visiting Amanda's room stepped down after perfuming her foot before they went out on the town.

My latest idea is to have a corn maze at night with zombies!

They had a 'PG-13' fright show that might have included zombies but as none of the (adorable!) little rugrats was 13 we didn't do that. However a few years back we did the corn maze in the dark and I (at least) discovered something: that makes it easier on a clear night as you can navigate by the North Star. This year me and my personally assigned rugrat wandered around for an hour and came out the same way we came in thinking we solved it.

Just addressing how I used met. It wasn't a text it was a convo. :p

Yes, but the relevant one was how she used it. You're on firm ground challenging 'never laid eyes on him' but since that Massei translation error was discovered there's only one proven time they 'met' as most people don't consider simply being at the same place temporarily without interaction as having 'met.'

It's not like the prosecution didn't look either, they had to do their best to prove any kind of relationship and that's the best they could muster. Most people have a better 'relationship' with the cashier at the gas station who doesn't speak English very well.

Well the numbers don't add up. Candace says 5:30 btw but let's say 5 am - and that TOD was 9:30 that's 16 and half hours. At the scientifically established .015 per hour of processing alcohol that would mean she had about .26 in her system when she arrived home. If you wish to believe that fine. What set of problems was she having?

Stumbling and stuff. Yes I can believe a 0.26 BAC, I live in a college town, one where it just so happens more drinking goes on than in most of the US. At 5 AM on November 1st they're trashed. We also have quite a diverse contingent from all over the world here and it might surprise you to find out the ones with the cool accents drink more than most Americans, some moreso than Wisconsinites!

Although I'm low in yachts right now I would bet that the vast majority of alcohol processes at .015-6. In an earlier back and forth I said that some small slowdown would surprise me. Rose has a chart that shows number of hours to get to zero (no source IIRC) but Meredith had a full drink in her system not just a trace. I didn't cherry pick the sites they were the first ones under search of something like "how long to process alcohol"

I know you didn't cherry pick, I looked too and saw the same thing. The equivalent of one drink compared to what was consumed in total is what I meant by a trace of it being left. Just a little flattening of that curve and a little higher BAC than you think possible and it's a solved problem in my view.

We hear all the time about someone being 'three times the legal limit,' usually after getting busted doing something stupid downtown and elsewhere.

Whoa cowboy! I think it's possible but there are other possibilities such as the girl covering for their friend.

No need to get mad, I was just including all the possibilities I could think of and eliminated that one as I couldn't think of a viable reason he wouldn't have incorporated it into his story had it happened.

I agree with your analysis generally here. She did buy Giacomo a bottle for his birthday and she did have access to the lower flat.

I don't know if it matters, but I think it could.

I can't think of a reason why. Is it just that you don't think the answer being residual alcohol possible that it's of interest to you? I don't find it unlikely at all, should I emulate Bruce Fisher and go down to State Street this Halloween with a breathalyzer and a video camera at bartime? Heh, I could tell them The Onion is resurrecting the 'Drunk of the Week!' :p

I agree a bit. When I heard the term used before this discussion I assumed it was used in the broad sense meaning that the murder occurred as some sort of violent occult related activities and not that the participants were engaged in a rite formally associated with Satan worship.

But when Machiavelli started to defend Mignini's letter with regard to the claim he had never used the term, Satanic Rite, I thought it would have been useful with regard to truth seeking to concede that there were no known direct quotes of Mignini using the expression. Further it would have been useful to acknowledge that Mignini never put forth any theories that were consistent with a narrow definition of Satanic Rite.

Machiavelli's also sought to limit Mignini's association with any of the salacious details of the crime that were being reported to only direct quotes of Mignini. He did this in the face of wide spread assumptions at the time that Mignini was behind the salacious theories that were being reported. He also strove to limit interpretations of what Mignini said to non occult interpretations. To me, it seemed like Machiavelli was almost functioning as a defense attorney with these arguments. The only thing admissible was that which could be reliably sourced and that didn't depend on hearsay or assumptions. FWIW, I thought Machiavelli demonstrated significant skills at argument with his approach. It also, appeared to me that intellectual honesty was not his goal. He was putting on the best defense possible for his client and a search for truth was not his goal.

When he was arguing in this mode I thought the most informative responses were those that attacked Machiavelli's arguments and not Machiavelli. I agree with Grinder that there were a lot of posts that related more to the poster's frustration at Machiavelli's approach than that were factually based counter arguments.

I found that people here were discussing about me over these last two days. It's interesting.
I decided to spend some time talking about some limited topics. But bear in mind I don't have enough time to actually sustain a detailed discussion with multiple people about one topic. Even less multiple discussions, that is multiple topics. I think basically nobody could do that. I'm not in retirement.

I was interested in davefoc's approach, because of his precise and logical questions on the topics.
I have topics left back however, I recall, in the order, about the claims against Stefanoni (like claimes that she lied, or that she refused to turn over data, or that she is not qualified etc.); the discussion about alleged "satanic" OR "ritual murder" scenario attributed to Mignini; some subsequent threads opened like about Amanda's ambiguous, threatening/blackmailing "blood on hands" memory; Charlie Wilkes addressing physical evidence and dynamics; Bill Williams repeated claims that Massei court made "findings" opposing the prosecution scenario, etc.

A great mass of claims is made by the innocentisti and they are repeated in the face of lack of backing or evidence of the contrary; moreover there is a big loss of time due to engagement by posters who indulge to provocation, meaning they decide to address me, of "Machiavelli and Vogt", thus factually diverding the topic of discussion (from my point of view). Btw these latter posters implicitly attempt to set a further reversal of "burden of proof" as I am constantly object of dietrologia, attributed "motives" and speculations about my own "intents"; I dont blame anyone for their choice about discussion style, but I don't consider their "insinuation" approach to be intellectually balanced so it tends to disqualifies them as interlocutors.

I find strange this latter description of my intervention as a "defense attorney" for Mignini. I'm not sure the comparison entirely fits. I don't feel like a defense attorney, and I don't think I'm doing exactly what a defence attorney would do. Maybe I've been rather like a political activist or like an academic fighting for a theory as opposed to others.
My attitude contains an element of provocation that stems from a sense of outrage, actually kind of hostility which you direct against political or religious opponents, to expose the weakness of a dangerous propaganda, rather than acting as a defense attorney. The "defense attorney" comparison tends to imply it's like addressing an impartial jury, but in fact I almost never feel as if I am addressing a panel of unbiased or intellectually honest people. I am mostly opposing enemies, or people who are simple believers "manipulated" by enemy propaganda. Not open listeners, but people how already "believe" their religion and won't believe the opponent - some are people with a vested and invested interest in 'saving' the defendants - maybe unless completely cornered and crushed by mathematical proof.
Above all, in all this I found most strange your conclusion that intellectual honesty was "not my goal". I wonter what you are based on. I'm not clearing Mgnini by assuming a specifically "narrow" definition of Satanic: on the contrary, I am saying he put forward, from the beginnig, a scenario that simply does not fit any ritualistic or cult-related murder plan, not even an occult/esoteric motive: there is basically only a sexual motive to start with, and the decision to make a little party; then, something happened which spiralled towards violence and the murder was unplanned. I am also saying that this scenario was basically unchanged, I mean: Mignini and Comodi never "changed" scenario. In the way in which it is described, the psychological details or other details they chose to mention, might sound like a different style from 2008 and 2009, but as you read it, in fact it isn't. Possible argument about money, drugs, a sexual context, clutches between Knox and Maredith over their house habits, personalities of the three perpetrators: these are the ingredients, they are identical and the story is the same.

My intent (on the satanic/ritual topic) is precisely to expose the fact that, if there are "wide spread assumptions at the time that Mignini was behind salacious theories", those wide spread assumptions are an example of irrational and unfounded claims spread by media campaigns. (Btw, ritual murder and salacious are already two different concepts, there is already a shifting both in meaning and implications). The wide spread false beliefs about what Mignini said may have a complex origin (more than one cause) yet they are unfounded, I may say they are obviously unfounded; the fact that their belivers lack any source, actually they have both Italian press sources against them and factual documentation disproving them, is something very glaring. The believers nonetheless tend to resist a re-formulation based on the actual information, or to consider a re-framing of their incomplete information from another point of view.

However there is also another point that I consider: the approach of Bill Willams for example, who makes unsupported claims, then says "you could stop all this about Satanic rite by sharing your document". I hold firm the point that this blackmailing approach is unacceptable. And logically wrong. This is a kind of paradigm of intellectual dishonesty; and this comes from the same poster who said that "all sources in the courtroom [sic] reported that". I would expect honest posters to acknowledge facts that they have or at least acknowledge when they don't have information; for example that - even analyzing just the limited quote from Mignini's speach tha Katody posted, despite its incorrect translation - you must infer that even that quote alone suggests, actually implies, that a "ritual murder" scenario would be incompatible with Mignini's proposed scenario (the drug fueled-party).

Is there any reason she couldn't have collapsed immediately following the fatal wound? Some blood spots were in the middle of the floor, and presumably would've landed there whether she was standing or partly or fully on her knees at the time it happened.

I have no particular theory on this one, she could well have been on her knees or at least slumped. I'm not interested in defending an absolute theory, only in reading the various opinions and coming to a view as to which is more likely (the conclusion of 'more likely', btw, is the best we can ever do on this).

I didn't say the pillow was positioned carefully, nor did I say how widely her legs were spread. Do you think I am distorting the facts to protect a theory? I would say I am going by what the physical evidence appears to show. If I'm wrong, walk me through the details and explain where I got it wrong.

You emphasized things which made the positioning sound deliberate and missed out things which leave open the possibility it was accidental. "Legs spread" is a misleading description of her actual position (and if you doubt this is the case, do a google search for 'legs spread' and see what kind of results you get. Just don't do it at work).

I think you represent one particular theory as being much more certain than it really is because you fear leaving any scope for uncertainty also leaves an opening for people to suggest Amanda and Raffaele were involved. Your position is understandable: one of the great weak points of the PGP position is that they have no coherent theory of the crime; ergo if there's one definite PIP theory of what happened which we can hammer home again and again and again and again, that (so the theory goes) strengthens our position. But refusing to consider any other, perhaps equally likely alternatives doesn't get us any closer to the truth of what happened either.

Anyway since I really, really have to go to bed now, I'll continue this tomorrow...

Perhaps you would like to comment on these quotes at this link from Massei's motivations document which does not find this was a party at all.... it was Rudy's actions which were the motive...

Welcome back. You may be able to argue with me, but you cannot argue with Judge Massei.

The change from zero-order (constant rate) to first-order (rate that depends on the concentration of remaining alcohol) is gradual and it depends on the Michaelis constant Km. It is possible to calculate a quantity called the elasticity of the velocity with respect to substrate concentration, and it is the apparent order of the reaction. 10-fold above the Km, one approaches zero-order kinetics, and 10-fold below, one approaches first-order kinetics. The elasticity is the partial derivative of the natural log of velocity of an enzyme over the partial derivative of the log of substrate concentration. Someone whose math skills are less rusty than mine can have some fun with this definition applied to the Michaelis-Menten equation. The enzyme in this case is alcohol dehydrogenase, and the substrate is ethanol.

My source for the following information is the "Drug Abuse Handbook," 2nd edition, Steven B. Karch, editor-in-chief (2007). The rate during the constant phase is between 10-20 mg/dL per hour with a mean of 15. Class 1 alcohol dehydrogenase enzymes have Km values of about 2-5 mg/dL; therefore, "they become saturated with substrate after one or two drinks." The phase in which the rate is almost constant as shown in Figure 5.2.13 is long, but the rate does indeed slow down after that. Because of various uncertainties, some workers question whether the additional complexity of the Michaelis-Menten model is really a net advantage.

Does this model explain Meredith's measured alcohol levels? Possibly, but I lean slightly against this explanation. The time between when Meredith drank and when she was killed seems a little bit long, unless Meredith were slow to oxidize alcohol.

Thank you for that research...though it hurt my brain to read it! :p

I think it more possible than you as I don't think .25 or so is all that unlikely for a drinking session that lasted until ~5AM. Especially for a female because of a relative lack of those alcohol dehydrogenase enzymes:

Women: If a woman and a man of the same weight drink the same amount of alcohol under the exact same circumstances, the woman will on the average have a much higher BAC (Blood Alcohol Content) than the man. This is because women have much less of the enzyme alcohol dehydrogenase in their stomachs than men do. If the same man and woman are given an injection of alcohol instead of drinking it they will tend to have the same BAC. This is because when the alcohol is injected it bypasses the alcohol dehydrogenase in the stomach.

However there is also another point that I consider: the approach of Bill Willams for example, who makes unsupported claims, then says "you could stop all this about Satanic rite by sharing your document". I hold firm the point that this blackmailing approach is unacceptable. And logically wrong. This is a kind of paradigm of intellectual dishonesty.

Okay.... I say something, you claim I am wrong. You say the basis for me being wrong is contained in documents you hold.

I suggest that you could end all this by posting the document you allude to. You call that request, "blackmail", "intellectually dishonest" and "logically wrong."

My word. Do you really want others to read your reasoning?

In 2002, on the advice of a psychic, he reopened a decades-old cold case. The Monster of Florence was a serial killer who attacked courting couples in the 1970s and ’80s. After murdering them he would take the women’s body parts with him. Mignini exhumed the body of Dr. Francesco Narducci after the psychic told him that Narducci, who died in 1985, was the Monster and that he hadn’t committed suicide [but] had been murdered by members of a satanic sect, who feared the Monster would expose them. He charged twenty people, including government officials, with being members of the same secret sect as the Monster. Mignini accepted the Psychic's vision as the truth.
Apparently A psychic told Mignini that Amanda was responsible for Meredith's death.
From there on it was the job of Amanda's lawyers to prove she wasn't.

The print is compatible just ask Bill cause Massei says so

Yes, but the relevant one was how she used it. You're on firm ground challenging 'never laid eyes on him' but since that Massei translation error was discovered there's only one proven time they 'met' as most people don't consider simply being at the same place temporarily without interaction as having 'met.'

Well we don't know that as Amanda has never made that clear. Rudy would have done more than just winked at her at LeChic. I will bet a yacht and a half that he talked to her at the club.

If CD was crossing her fingers behind her back cause met has a special meaning in this context, then I still think it is misleading and she knows it.

It's not like the prosecution didn't look either, they had to do their best to prove any kind of relationship and that's the best they could muster. Most people have a better 'relationship' with the cashier at the gas station who doesn't speak English very well.

Good point.

I wasn't really mad.

..... and Machiavelli's contribution to all this is to call someone "intellectually dishonest", "logically wrong", and employing a form of blackmail for asking to see the document Maciavelli says proves there'd been no mention of a Satanic Rite by Mignini.

Mach also says that a 20-year old foreigner could choose not to sleep where that judgement comes through her writings, and that this 20-year old American had spent her few weeks in Italy learning "Mafia Code" so that she could prepare for jail-house talks with her mother. O yes, that it is also probable that Rudy Guede was Amanda Knox's pimp, in a college town known for people who trade sex for drugs.

How am I doing, Machiavelli? I don't want to get this wrong.

Then there's the bit about Rudy was not eligible for being imprisoned for his break-ins prior to the killing of Meredith Kercher. What am I forgetting?

Do you think Machiavelli will EVER comment on: http://www.internationalskeptics.com/forums/showthread.php?postid=9568149#post9568149

Perhaps you would like to comment on these quotes at this link from Massei's motivations document which does not find this was a party at all.... it was Rudy's actions which were the motive...

Welcome back. You may be able to argue with me, but you cannot argue with Judge Massei.

The problem is that you first need to be able to read a judge Massei - know how to read a sentencing report, what is relevant, what is evidence.
Second, you shoud actually read what the prosecution said, if you want to compare them and find "differences".
And then, it won't be bad to know some little thing about the law; for example, what can be argued or used as argument and what can not.

So in other words, there was no point in Judge Massei writing the motivations report!!!!!

So these are not REALLY his findings, because they have to pass through the court of Machiavelli to be understood. Machiavelli will then demonstrate that Massei did not mean to say what he said.

Nice one.
