The state of FL v. George Zimmerman

JDN says 3rd degree felony murder with child abuse is allowed under instruction, but Court is moving on, will return to arguments this issue.

West head may explode.

West and Mantaie finish wrangling over provocation.

That part of the instruction that Zimmerman provoked the use of force is out of instructions.

Huge win for the defense in removing the great bodily injury instruction from the state's proposed instruction.

Verdict Form: Defense gets special circumstances appended to the end instead of included in the body. The not guilty finding will not be on Page 1, though.

Court in recess until 1:00

At 1:00, court will hear arguments on 3 degree murder charge.

After that, BDLR will give states closing.

To recap/clarify:

Second degree murder is in,
Manslaughter by act is in,
Aggravated Assault is out,
Third degree felony murder (child abuse) will be argued after lunch recess.

What about Manslaughter by Culpable Negligence? Did she rule that out or in?

Heh. Court back in. Mantei brief argument.

West starts to talk, JDN cuts him off and says "you don't need to do that"

Third degree felony murder (child abuse) is out.

Court would rather drop third degree felony murder (child abuse) than listen to Don West for another two hours.

So, summary on jury instructions:

2nd degree murder
manslaughter
NOT guilty.

Each of the two charges will have additional components that will affect the length of sentence.

The state had asked for language in the instruction that Zimmerman provoked the use of force, but that will not be included

The state had asked for language in the instruction defining great bodily injury , but that will not be included

The defense had asked for language in the instruction that following is not illegal, but that will not be included

I believe the above is accurate

This came up in the moderated thread but it relates directly to the trial and is therefore appropriate for this thread. I know this was discussed before, but I had not seen this exchange until now:

Is that behavior appropriate on the part of the judge?! Why is she trying to intimidate the situation like that when she knows quite well they didn't want to say/decide until the end, and that they have every right to do that? Seems highly inappropriate on her part.
