The state of FL v. George Zimmerman

Actually Good was called as a witness by the State.

You are correct, my mistake. He's in trouble however, since he was approached by the defense to correct some of the animation in the cartoon the defense tried to have admitted. The defense called for witness sequestration and they're the ones violating their own requests!

Actually it was the state that invoked the rule of sequestration. BDLR specifically invoked before the state's opening statement.

Once again, the state is playing defense attorney. Holes evidence reasonable doubt. Zimmerman needs to hammer home in closing that the state themselves haven't even articulated a cogent theory of guilt that they could prove beyond and to the exclusion of all reasonable doubt.

MOM on direct did a decent job getting around the states 3 questions on opinions he was not allowed to ask, getting root to describe his thoughts on those general issues. Again referenced the gun was safe, etc

Guy on cross, accuses root of testifying for publicity for his new company.

I think guy scores for the prosecution, as he asks detailed questions about what Root asked or didn't ask GZ about. Root cannot describe how fight moved from Tee to down the sidewalk, did not ask GZ detailed questions. I think it undercuts the basis MOM laid with Root for how he gathers information and pays attention to details. Guy gets him to admit he is lacking many details on fight.

Root is basically getting beat up as a proxy for GZ, as Root is unable to answer detailed questions abou the fight. I think that is a legitimate fail, as he was supposed to have spoken with GZ and asked him detailed questions.

No clue what the jury will take away from this guy.

Yes, I hope by at least closing defense provides complete theory of events.

We have heard them cross Di Miaio about whether a tree branch could have caused the injuries to the back of the head, does the state believe a tree branch caused the injuries or not ?

Also, the prosecution has called into question whether GZ could draw his gun with someone mounted on top of him the way described, does the state believe the gun was out earlier ?

The state has argued it was TM screaming for help ... since he has no injury, why do they believe he was screaming for help for 40 seconds ?

If you don't believe GZ, I still don't see that the state has even told, much less proven, an alternate story of what happened.

[Mandatory disclosure for internet communication: I, the poster known as Cylinder, have been issued a concealed weapons permit. That is all.]

I wonder if the defense asks for a final jury instruction to remedy Guy's mischaracterization that Zimmerman was obligated to inform a non-LEO dispatcher over the phone that he had a legal permit and was armed?

I think the tree branch theory will play a significant role in Mark O'Mara's closing argument. For the state to suggest that in what's supposed to be serious expert forensic testimony would stretch credulity for a defense attorney - no less the state's theory of guilt.

WFTV looked at the record - Donnelly was not under subpoena during his court visit - so that issue should be dead.

Haven't seen anything about this. Could this be why court was moved back to 9:00 this morning, no need to address the possible 2(?) sequestration issues ?

Judge Nelson swears in Zimmerman, wants to know if he plans to testify.

Every time JDN asks GZ if he plans to testify, Don West objects because the defense has not finished presenting case. Every time he objects, she overrules. No love lost, at all.

GZ tells JDN he has not decided.

MOM indicates he has two brief witnesses, then defense will rest.

ETA: Jury not present

West is right about Zimmerman waiving his right to testify. That should be done only when the defense announces its intention to rest. The defense is still making strategy on the fly.

Guy is perilously close to opening a door on fight evidence and training.

He opened the door for Roots opinion on reasonableness of GZ actions.

MOM: did GZ have any other options (when he shot) in your opinion ?

Root: No.

There's the steaming pile clinging to the state's shoe. Expert gets to testify that Zimmerman was not negligent in his use of the firearm and that he had no other option than using his firearm to prevent death or great bodily injury - motion in limine be damned.

Diana Tennis on the proposition that Zimmerman would try to override MOM/West's decision to keep him from testifying:

"Nope, his lawyer would mount him like a doll."
