Plus dont forget that Martin was a known thug and juvenile delinquent kicked out of school for the third time at the time of his attack on Zimmerman.

I can't tell if that is sarcasm or not....

I guess it wasn't....

Trayvon was a undisputed juvenile delinquent. Fact is instead of being in school he was at his dads place...likely sent there because his mother was fed up with his repeated delinquent behavior. And is it a little strange how long it took the father to become concerned about his missing son?

Anyway...no one can dispute that Mr Zimmerman was brutally attacked. He had blood streaming down the back of his head. Mr Zimmerman as a watch captain has every right to follow and question the juvenile delinquent. Its a neighborhood that has been rife with break-ins...Trayvon Martin attacked a bus driver. Travon Martin attacked Mr Zimmerman. Zimmerman rightfully and legally shot Trayvon Martin. Zimmerman will be found innocent...unless he gets a black jury...then he is dead meat.

Why did you just add the "against TM" part?
Because I assumed you were saying it reflected "bizarre aggression" towards TM. If that's not what you were suggesting, how would stating "these ****** always get away" constitute bizarre aggression in any way? In that case it's just a statement of frustration.

Perhaps not bizarre, perhaps even legal... but without a doubt it's the actions of GZ that led to the killing of TM.
Odd that, GZ kills another who would be alive to this day if GZ had stayed in his car and for that TM is attacked and assumed a thug. Go figure.

Well...

Yet again, the main issue being covered was not Zimmerman's bizarre agreession, it was the SPD's refusal to arrest him.
One more member with psychic powers...

We have no evidence that GZ engaged in "bizarre aggression". However IF his story is true, it would seem TM may well have.
I find it odd that you don't think saying "these ******** always get away" is bizarre aggression...

No qualifier in any of the above. Then you add the qualifier: (bolding mine)

I find it odd that you think him an off hand comment he made to someone else constitutes "bizarre aggression" against TM.

I thought perhaps you were adding it to try and say we were talking about after contact between Z and M was made. Because the word "against" would imply direct aggression.

I, OTOH, thought we were all talking about from the point Z first selected M as a suspect.

So, against M directly after contact, versus "about" TM indirectly, just "against" a suspect.

So, obviously, if you were trying to say we were talking about direct aggression on M after they made contact with each other then Z saying "these ******** always get away" would not count. Because that happened before the contact.

That is why I was confused by your qualifier.

I still am pretty sure saying "these ******** always get away" about a suspect, whom you have never met, and therefore aren't sure is an "*******" is bizarre aggression. Especially when you say it in front of a police dispatcher...

At least because of that line there is no denying that Z was pretty sure of himself about how much of a suspect M was.

The facts surrounding the conviction of Marisaa Alexander are a bit troubling to me as well. If the facts bear out (I haven't paid close attention to the case) she was way overcharged given the totality of the circumstance. There are some key differences in the case, though.

The Castle Doctine cannot be applied in this case since Alexander claimed self defense against her domestic partner. Florida 776.013(2)(A) provides "The [Castle Doctrine] presumption [of reasonable fear within your own home] set forth in subsection (1) does not apply if the person against whom the defensive force is used has the right to be in or is a lawful resident of the dwelling, residence, or vehicle, such as an owner, lessee, or titleholder, and there is not an injunction for protection from domestic violence or a written pretrial supervision order of no contact against that person."

Alexander can still rely on tradition SYG justification, but she fired a warning shot. As stressed by my CCW instructor using his 10+ year experience as a prosecutor stated, in every instance, firing a warning shot will be used by the prosecutor to prove that the threat was not immediate. If you feel you can safetly fire a warning shot, that shot is illegal. Every time.
[ETA: Outside the home, you should also not unholster or present your weapon as a warning either, for the same reason. Menacing with firearm carries strict minimums in Arkansas as well.]

I can understand that this may present a bad stink of race-based prosecutions but you cannot use misconduct by the state to justify further misconduct by the state.

I understand why it is written that way, but it still saddens me that the law is written in such a way that you should shoot to kill and not fire a warning shot.

And it doesn't need to do so. That isn't what is needed for PC.

I'm not certain I follow your meaning here. The state has to provide a prima facie claim in an affidavit to support arrest. That is, they have to claim each element of the crime. What is the "depraved indifference" element in the Zimmerman affidavit? Each element also has to be attributed as to what probable cause exists for that element.

The prosecutor could claim that the act of shooting in a dense residential area was a depraved act, but then the affiant has to deal with the self-defense claim. The standard is very low and a matter of fact (therefore subjective to the magistrate) but it's not thin in this regard - it's non-existent.

Just because GZ's attorney hammed it up for the media until the judge got bored and shut him down, doesn't make that statement any more significant.

I am lost. The quote provided was the jury instruction for the definition of depraved mind. The act must be proven, BARD, to demonstrate "ill will, hatred, spite, or an evil intent." I'm missing that element.

... Mr Zimmerman as a watch captain has every right to follow and question the juvenile delinquent.
No, he doesn't.
The neighborhood watch captain was specifically instructed not to get physically involved in people reported as suspicious.

Those who are trained in the use of firearms are trained to draw with intent to kill only.
You are the one who is an *********** (I add an extra couple of ** just for fun:)

And by the way
Zimmerman will walk for the simple reason, he acted within the confines of the law and the state will not be able to prove otherwise

As my friends says "My daddy said never point a loaded gun at something unless you plan to blow a hole in it."
