This is how FOA dream things to be. There isn’t any such thing as an expert entrusted with the power of judging other experts admitted by the law, although I understand this is precisely what people here would like to be made to Stefanoni.
In fact, the truth is that all the claims about the Police and Stefanoni’s work that are found in C&V report, were already present in the defence submissions. There is nothing new. There is no new information compared to what was already known. There is no new claim compared to what already known (except minor claims).
Not responsing to everything - I'll just make a brief comment about this "dream" you think that FOA people have.

What I am hoping is that this is something also claimed in the appeal to the SC. Because if this reasoning is included, then the appeal by the prosecution is not going to succeed.

You seem to be saying that the C&V report does not exist, because there is "no new information in it," so that legally speaking, the case should withdraw back to the decision made by the Massei court.

With all respect, it is you who is dreaming. This is not reasoning you are using, it is a desparate act of a lawyer about to lose a case.

It is legalese for, "Be reasonable, see it my way!"

Hey Charlie could you come over to the moderated thread and explain the bank records Cape goes on about?

Stefanoni did not lie and was absolutely truthful, however she did not disclose her information in the preliminary hearing. She disclosed it in the trial, and she disclosed only truthful and correct information, which was deposited in her report. When she was asked about quantification in the preliminary hearing, she did not lie on the quantity but instead she answered she did not know, and then she said that it could be an amount of the kind of hundred picocrams. But she said “could” and “maybe”, and also said she did not have the datum with her.

She wrote down "Too Low" about a dozen times and then says in court that it could be a few hundred picograms. LOL. She is a lying liar.

You may not like her strategy of not disclosing data in the earlier judicial phase, but this is a matter of your dislikes. You project your own idea of how an expert should act like in any occasion in your likes.

Many thanks for confirming she had a strategy for with-holding crucial data from the defense. Is that how a supposedly impartial scientist reporting on the testing of evidence is supposed to act in Italy?

Wow, just wow.

I believe I saw predictions elsewhere that she would be lucky to get 50k. 4 million is some serious money. Good for her.
Yes, it is serious money, as even someone on PMF admitted:

In the publishing world, $4 million is a lot of money. It's twice what Dick Cheney is thought to have gotten for his memoir, "In My Time." Cheney spent decades as one of the most powerful men in the Republican party and was vice president for eight years.

Now, if only the Court of Cassation would blow off this prosecutorial appeal, and let the Hellmann acquittal stand, Knox would be thoroughly vindicated.....

Many thanks for confirming she had a strategy for with-holding crucial data from the defense. Is that how a supposedly impartial scientist reporting on the testing of evidence is supposed to act in Italy?

Might be that the answer is "yes". But I am not a moral judge of internal feelings of other humans. Or I could put the question whether someone thinks that behaviours of Vinci and Pascali were that of "impartial" scientists.
It is obvious - to me - that since Stefanoni became a witness against the defendants (which means, since she had discovered evidence and came to conclusions) she was no longer impartial. Impartiality as a concept has a full meaning before the starting of her work, it means that you be honest, but impartiality is not a concept that makes sense for her as participant to the trial, after she came to her conclusions. Stefanoni - just like C&V - is an expert witness, not an "impartial" one taking part to the debate. I expect her to act within the established rules in the trial, but not to be an impartial partecipant. A witness must tell the truth, an expert witness must provide correct information, not be impartial. Stefanoni is an expert called by the prosecution, he is there to find elements to help catch criminals. What do you expect her to do, to write down defence arguments?
But the real folly - what is not understandable to me - is why there seem to be people thinking that an attitude of Stefanoni (which I expect and deem obvious) implies innocence of defendants. I can't understand why people here are so keen to equate this alleged delay of Stefanoni with a nonsense conspiracy and inexisting lies, but think it's hopeless.

Meanwhile, you forgot to point out that the concept of "withholding" is strictly limited to a specific phase of the pre-trial. To say that everything has its time, is not the same of saying that one fabricates false evidence to frame innocent people.

Wow, just wow.

I believe I saw predictions elsewhere that she would be lucky to get 50k. 4 million is some serious money. Good for her.
Unfortunately this only brings her and the Knox/Mellas clan back up to zero, what with all the horrendous expenses incurred.

It will be from the libel and slander lawsuits to come that the four lost years of unjustified confinement will be made up for.

They now are back to Oct 2007.

If the Corte Suprema di Cassazione sends the case back to the appeals court, A & R will have a pile of cash to hire lawyers, experts and whatever they need. Ironically if the Corte Suprema di Cassazione does send it back it will increase the interest in the book or books and even offer a chance for sequels. The publishing house would welcome an ongoing trial and persecution.

Right now people sending protests to Harper Collins will only please them in knowing how much interest there is.
It is for this very reason that I plan on sending a huffy protest to HarperCollins! I will let them know that I am so mad that they would do this that I plan on sending individual, first-run copies of Knox's book to my immediate family of 28 people. My protest will be that I plan on boycotting sending any further copies to extended family until the 2nd printing.... which at last count was over 100.

Take THAT, HarperCollins.

His motivations are plainly illegitimate. He was not allowed to determine “evidence claimed by the prosecution” by using another expert witness, first of all because it is not “evidence claimed by the prosecution”, this was an appeal, the evidence was already discussed and established by a court. In order to introduce new evidence into the discussion of this kind of points, a judge requires specific kind of motivations, you cannot call an expert just for the purpose of sorting out things between defence and prosecution cause you’re ignorant of the topic; especially evidence that has already gone through a court judgement. Hellmann’s motivations, besides illegitimate, are also unspecific and void, in fact inexistent.
I'm not a lawyer (are you?), but it does not compute in a simple common sense way to me. Hellmann was obviously free to come to his own opinion about every piece of evidence, without looking back at Massei's nonsense. He did so with the 'suspicious phone call to mother', he did so with the shopkeeper and the bum. There's no reason he couldn't do it with the DNA test results the prosecution was waving around.
In fact according to the article 224 of the Code of Criminal Procedure he had power to order official expert review of this matter. I don't know what "specific kind of motivations" do you have on mind. The motivation to resolve issue about which the judges lack specific scientific expertise looks perfectly good. Could you point out the article of law about these specific kind of motivations?

This is absolutely the case. All parties were allowed to bring their experts, but this is not the same of fulfilling the duty to allow the same counter evidence on the point, whereas the law expressly concedes the right to present the proof a contrario, not just to debate the evidence presented with your expert witnesses. The court denied the party the right to present counter evidence of the kind requested such as an expert’s report or a further test.
Interesting. Do you argue that Massei also broke the law when he disallowed expert review and further testing to counter the prosecution's claims about the DNA?

This is how FOA dream things to be. There isn’t any such thing as an expert entrusted with the power of judging other experts admitted by the law, although I understand this is precisely what people here would like to be made to Stefanoni.

The Court stated that it appointed the expert panel "to compensate for understandable gaps in knowledge in a particularly complex field, both scientifically and technically". The official experts helped the court ascertain the technical and scientific question of reliability of DNA results. Prosecution's experts had their word in the discussion.

In fact, the truth is that all the claims about the Police and Stefanoni’s work that are found in C&V report, were already present in the defence submissions. There is nothing new. There is no new information compared to what was already known. There is no new claim compared to what already known (except minor claims).

Hmmm... indeed the mess with the DNA quantisation was known before. The issue of destroyed bra clasp obviously wasn't, but let's set it aside and say there was nothing new in their findings. Then what was it actually that the prosecution wanted to present new counter evidence to?

You say that Stefanoni lied, I say this is false.

According to the Court( Hellmann report):

On the other hand, Dr. Stefanoni (Scientific Police), apparently due to an understandable memory lapse, stated before the GUP that she quantified the extract using Real Time PCR (a system which allows the extract to be precisely quantified before it is amplified), and then clarified that she had not used Real Time for this extract, but the Quibit Fluorimeter, which gave the result “not interpretable”. However, Dr. Stefanoni nonetheless considered it suitable for continuing to the subsequent stages, at the end of which she identified Meredith Kercher’s DNA in the graph.

Well that is a strange lapse of memory and strange lack of preparation, considering the knife was the most important damning piece of evidence.
It becomes more understandable with:

The Expert Panel noted first that the quantification stage is notably absent in the investigations carried out by the Scientific Police

and the known embarrassing 'too low', 'too low' results.

Instead, in order to state that an expert “lied”, you have to meet a precise meaning by the law, that requires the expert to state or disclose false data, or state false facts about the matter of their research.
Let's agree on Hellmann's term "understandable memory lapse" then :)

The only experts who stated false facts are C&V: they stated that the negative controls tests did not exist. They based their argument about contamination regarding the knife on this false assumption. They were stating the false.
This is not true. They said negative controls were not provided.
Of course it's possible they existed, but were no good and Stefanoni got rid of them.

To me it is obvious that the C&V does not serve at all purposes of seeking the truth, since does not add absolutely anything to the altready known facts. All findings and opinions of C&V report were already known and had already been submitted by the defense in the first trial. Just for this it's obvious the appointing of new experts was illegitimate.

Hang on, I'm sure there was some new stuff. Like the starch on the knife that proved that it had not been bleached, which destroyed that prosecution theory? Or the fact that the bra clasp DNA didn't even prove that it was Sollecito's DNA in the test machine, even before you worry about contamination issues?

Oh well. Those of us who have been hanging around for a while remember when the talking point was "C&V will confirm the DNA evidence for sure!", and also when it was "Fiona looked at some Youtube videos and googled and even though she knows nothing about forensics or DNA she's sure based on their citations that C&V were idiots and Hellmann will see right through them!", and also when it was "OMG Hellmann has been got at! The fix is in! Supertanker! Masons! Mafia! Satanic cults!".

If the new comfort food for the delusional is "C&V were illegitimate, Hellmann cheated by appointing relevant experts to review Stefanoni's work, the Supreme Court will totally throw their evidence out!" then enjoy your meal.

There will be crow for dessert. Again.

Wow, just wow.

I believe I saw predictions elsewhere that she would be lucky to get 50k. 4 million is some serious money. Good for her.

Sweet!

I think the publishing will coincide with the full exoneration from Supreme Court. More free advertisement :)

But she said “could” and “maybe”, and also said she did not have the datum with her.

Give it up. She lied through her teeth. She lied in her lab report too.

Discovery in Italian law: theory versus practice

You may not like her strategy of not disclosing data in the earlier judicial phase, but this is a matter of your dislikes. You project your own idea of how an expert should act like in any occasion in your likes.

Instead, in order to state that an expert “lied”, you have to meet a precise meaning by the law, that requires the expert to state or disclose false data, or state false facts about the matter of their research. The only experts who stated false facts are C&V: they stated that the negative controls tests did not exist. They based their argument about contamination regarding the knife on this false assumption. They were stating the false.

What Stefanoni did was not at all stating false data (nor to destroy evidence), it was just not disclosing data at a certain stage; when questioned at the trial she disclosed data and the data was truthful, and deposited truthful data. What C&V did, instead, is indeed stating false data.
Machiavelli,

An anonymous expert in Italian law unaffiliated with the case had this to say with respect to discovery: "There is total discovery in Italian law. If lawyers want them [forensic files], they can get them." This individual clarified that the statement above "refers to' discovery of investigation findings before the trial , actually, the preliminary hearing, begins."

OK, what information is needed about the bank records?

I had asked earlier about the timing of Meredith's ATM withdrawal as evidenced by the reciept just inside her room. I think someone had questioned whether Meredith actually had the €400 in cash when she was murdered.

Hey Charlie could you come over to the moderated thread and explain the bank records Cape goes on about?

Sure. I have them, I have gone over them at length, but it's been awhile, and perhaps it's time to fend off another round of imaginary evidence.

Reading TJMK can be hazardous to your health - it should be a required statement on the site.

They can write whatever they want in an appeal. That doesn't mean that the Corte Suprema di Cassazione will accept all those arguments.

Since Mach says he won't be commenting, we can't ask him, but I assume that much of this appeal is for local consumption. Galati gets to make Mignini, Massei, and others in Perugia happy by putting their theories back in the press.

On a another site it was said by Yummi that this appeal by Galati and Maresca will put on the record what "the facts" of this case really were, for all of time. He also asked that a public letter be written backing the prosecution. It sure seems he has a vested interest in the case.

Yummi is Maresca.

It *is* "narrow and technical"

smkovalinksy said:
I had thought this appeal to the Court of Cassation in Rome was to be argued on very narrow technical grounds only, within the Hellmann report, but this would not appear to be the case. Its as though time has been rolled back a few years.

So through Maresca, the Kercher family is part of this appeal. And now Hellmann's perspective of "reasonable doubt" and indeed his conditions for review, are called into question:

Elsewhere, the prosecution's appeal has claimed that only pro-defense theories were considered.

I guess I took (too) seriously the CNN report of a one day appeal behind closed doors, which would allow for only the most narrow and technical disputes.

This, conversely, is vast, general, comprehensive, and highly insulting to Hellmann. Sigh.......

The CNN report is correct. It will be a one-day appeal behind closed doors, dealing only with questions of law, not factual issues. (This is what I presume is meant by "narrow and technical".)

The prosecution's appeal brief consists of legal arguments, not factual ones. Don't confuse the fact that it is strongly worded (which it is) with it being broad in scope (which it isn't, and isn't allowed to be at this stage).

To be sure, the procedural objections raised by the prosecution are indeed nothing other than poorly disguised substantive disagreements. But I don't think the Cassazione judges will be fooled.

And, by the way, Machiavelli's jurisprudential claims are wrong, as usual. (The idea that the C-V review was "illegal" is an absurdity; the criminal procedure code clearly authorizes it. Machiavelli -- and Galati and Costagliola -- may disagree with Hellmann's reasoning on why it was necessary, but that does not make it a procedural violation.)

That might be fine if Massei had acted like a real judge should have and ordered Stefanoni to turn over the electronic data files that were withheld in spite of repeated requests by the defense to have these files. In fact Massei called a early recess or prolonged recess in order that the defense be given ALL files and then to have time to get up to speed on that missing data.

What we learned from C & V (and Hellmann learned it too) was that Stefanoni was withholding the electronic data files and she continued to withhold these files even after an order from Hellmann. Finally after his second email to her does Stefanoni finally (one day before the independent expert review is due) turn over these files.

Now the experts must go to the judge and explain that their report will be late. Does the prosecution and that idiot Maresca think Hellmann and Mazetti are blind fools?

And when Mignini sends two separate goon squads to Rome to shake down the experts (they went only to get the DVD that sat in the Perugia courthouse always) do you think Hellmann was able to ignore this? Especially since both experts called him to say they were being questioned by Perugia police at their respective places of employment. Does Mignini think everyone is blind or stupid ?

This is absolutely the case. All parties were allowed to bring their experts, but this is not the same of fulfilling the duty to allow the same counter evidence on the point, whereas the law expressly concedes the right to present the proof a contrario, not just to debate the evidence presented with your expert witnesses. The court denied the party the right to present counter evidence of the kind requested such as an expert’s report or a further test.

I guess the same thing can then be said for Mignini since he withheld some of the important scientific data from the defense in the first trial...even Massei couldn't overlook that one and yet in the end the electronic data files never made it to the defense. How can you expect the defense to provide counter evidence when the prosecutor blatantly ignores the duty to provide the defense with all evidence. Mignini for this alone should be tossed in jail right now...lets see how clever he is in the next year as the full details of this prosecution come to light for the rest of the world.

The court denied your counter evidence because it can not allow you to continue your ridiculous fishing expedition forever. It would simply be unfair and in fact Hellmann allowed far too much leeway to the prosecution anyway. When Comodi called the judges unfair and against the prosecution ...in any civilized country the judge would have thrown her off the case at least, if not in jail for contempt as well. Hellmann remained silent but you are foolish to imagine he ignored this disrespect.

The claims of sloppy police work were indeed in the defense submissions. The proof that these claims were true was determined by an independent expert review ordered by the court.

A further point.
It is also false that Stefanoni lied. In fact, the claims that she had “lied” as you read them in the C&V report are also the same, identical claims that were already presented by the defence in the Massei’s trial. And, you can think whatever you like about Stefanoni, but the fact is that these claim by C&V are a repetition of known facts and thus they cast absolutely no light at all.

Stefanoni did lie ...have you ever heard of a lie by omission?

You say that Stefanoni lied, I say this is false.

The proof of her lies came from review of the electronic data files...this data provided the details of exactly why she wished to hide these files.

You may not like her strategy of not disclosing data in the earlier judicial phase, but this is a matter of your dislikes. You project your own idea of how an expert should act like in any occasion in your likes.

Actually she may just be sloppy and inaccurate in her work...but then why does she fight to keep the EDF hidden for so long?

Instead, in order to state that an expert “lied”, you have to meet a precise meaning by the law, that requires the expert to state or disclose false data, or state false facts about the matter of their research. The only experts who stated false facts are C&V: they stated that the negative controls tests did not exist.

Ah...actually (and Hellmann noticed this too) Comodis two lame efforts to sneak false control data sheets were both caught by the court...first by a regular juror going over the days files who noticed that the dates and numbers failed to match. Remember that? Hellmann calls recess and gives her an hour to find the real file since she promises it is in the record. She failed to find it....Remember that? And days later she tries again to introduce a fake control data file (she found it in a storage garage) and Hellmann (again she should have been tossed in jail) firmly tells her he doesn't care what sheets she now provides it cant disprove contamination before the sample ever got to the lab. Any of this ringing any bells for you? The truth is no legitimate control data was ever produced... again, who can say if Stefanoni lied or was simply sloppy and inaccurate in her work...

C & V simply reviewed all the data including data withheld from the defense in the first trial and concluded that the samples were too small to be tested according to world standards and that Stefanoni had neither the qualifications nor the special laboratory set up to even begin to such Low copy number samples...and in fact contamination is highly likely given her demonstrated sloppy handling at all phases including collection, storage and examination and finally record keeping.

Ill leave out the part where it is an illegal conflict of interest to have Stefanonis boss hired on as a prosecution consultant.
