Continuation Part 2 - Discussion of the Amanda Knox case

I am genuinely glad the DNA will likely be thrown out and Amanda and Raffaele almost certainly released. I was on the fence a long time and leaning toward guilt but the TOD issue was very convincing to me, especially once Rolfe weighed in as well. The other issues were almost irrelevant due to the multitude of explanations to their existence, despite their intriguing natures. The DNA was however the only other strong indicator and I really hope now the truth will set them free. I mean that.

I think Rudy should be strung up by the proverbials for not using his time in court to come clean and exonerate them. I hope he gets time added to his sentence for perjury.

Well done, Danceme. Congratulations on changing your mind.

It will be interesting to see how the Kerchers respond to this news. They should be livid over how this case was handled and made to stretch over 3 ½ years. I think the Italian system owes them an apology when this is over.

Yes, because there's probably some super-sekret evidence in there that the experts deliberately left out of their "Conclusions" that completely changes things.

I'm sure you think Judge Hellmann is just going to jump to the end and not even bother reading the entire report. Guess why he's given both sides almost a month to analyze the report.

They've concluded the evidence is not reliable, nothing else written in the report can possibly change that …

Could this be the beginning of the end of the thread? There've been false dawns before, but this looks promising. Some decisive outcome has to be good, and decisively not guilty has to be the best outcome.

It reminds me of the Wizard of Oz. Dorothy has the ruby slippers and could go home any time, it just takes the good witch a long damn time to get around to telling her. The wheels of justice turn inhumanly slowly.

If this new document turns out to be open to other interpretations than the one that has been quoted, I shall be more than somewhat disappointed.

I agree. I can't wait to read the part of the report where it talks about Stefanoni falsely attributing the DNA results to Sollecito because she doesn't know how to read the test data. And then, just to prove that she has no idea what the hell she is talking about, she hid the test data for a few years, claiming that since she couldn't understand it, therefore no one else really needed to see it either.

I suspect that the "request for freedom" for Knox/Sollecito that Sfarzo is referring to is not what you might think. I suspect he's talking about a request to release them from remand while the appeal trial is ongoing - to a position of either house arrest or total liberty. I don't think he's referring to a request to acquit.

I know, that's not what I meant, I betcha they'll get the same treatment that other Italian college kid got that was arrested on a ludicrous charge, but they won't have to cook in prison all summer!

PMF: Even if they were to throw out every shred of DNA evidence, however, Miss Knox's murder conviction will still be re-affirmed. You don't need DNA evidence to convict someone of murder. Miss Knox is so guilty it hurts to even hear her speak.

WOW!

But I always knew that most of them are basing their guilt belief almost entirely on the alleged "lies", and these will never go away, so; GUILTY forever, no matter what …

Komponisto wrote a great post how you just cannot infer guilt from somebody's appearance or some statements they've made, especially after hours of manipulative interrrogation …

Yes, it will be intresting to see how they came to their conclusions. How were their procedures different than Stefanoni's? Did they conduct different (possibly newer) tests? The court is going to have to understand how they came to their conclusions in order to accept or reject them.

Disagree. The court appointed these experts. Noway nohow is Hellmann going to reject their conclusions. It's a matter of how much damage he is going to allow to be inflicted on Stefanoni before he lets Knox/Sollecito go. If I were the prosecution I would drop charges against Knox/Sollecito before Bongiorno gets her hands on Stefanoni and her forensics procedures. Such a cross-examination could severely undermine the case against Guede.

Ha. Well, the other side is having to engage in some rather acrobatic contortions in order to rationalize this away. Quennell, for instance, tries to suggest that "not following international protocols" was the result of the local authorities following their own superior protocols.

I must say, however, that it's really hard to get around the phrase "erroneous interpretation".

Speaking of the Wizard of Oz, the quote posted by Rhea is suggestive of another scene:

The PMF fallback position:

PMF: Let RS and AK get their hopes up - it will be just a longer ride down and they deserve every sinking moment. If they walk, it's because money found the right pockets and a lot of them.

Seems like they are starting to lose their faith in the probity of the Italian justice system.

Does anybody think this report opens up Stefanoni to be sued by Amanda and Raffaele, her incompetence has destroyed their lives and that of their families, though I would like to add I believe that both are of such exceptional character that they will recover and go on to contribute enormously to the betterment of society

Indeed. That looks significant. I take it no nuance is lost going from Italian to English? Doubtless if there is PMF will be on to it.

Let's wait and see. All we can tell for sure is how far things have melted so far, and they certainly seem to have melted quite a bit. Momentum is clearly important here, but this case has a history of throwing up surprises and defying predictions of exhonoration.

What can one do but hold ones hands up in dispair. Can it be that the computer records, the stomach contents and the DNA are all in favour of the defence? If so there is plenty of blame that things went on this long to go around, but I hope the defendents kept all the receipts from their lawyers and experts from the first trial.

This time we can say: CASO CHIUSO.

A bit unfortunate for Frank he was defendeding Stefanoni before, attacking people heavily for criticizing her; she was the only good person in this mess and the villain was Mignini and the police alone, he said …

:)

The forensic team in this case has appalled me. I was shocked when I saw the collection video and saw how they had just LEFT the clothes Meredith Kercher was wearing that night behind, I was horrified how the local cops had tossed the crime scene by Dec 18th. It would be difficult to convince anyone outside the followers of this case just how truly horrible the forensic techniques really were. No one would believe it without seeing it. The mop video helps.

I am so pleased to hear what is in the report. This is what all of the supporters have been working and hoping for. I would love to see Stefanoni and Mignini to take the largest fall for what they each have done. Morally corrupt, this was not a mistake on their part. They deserve to be jailed.
