U.S. District Court Judge Clay Land tossed out on Wednesday a complaint by an Army captain fighting deployment to Iraq by questioning the legitimacy of President Barack Obama.

Land also put attorney Orly Taitz, who represents Capt. Connie Rhodes and is a leader in the national “birther” movement, on notice by stating that she could face sanctions if she ever again files in his court a similar “frivolous” lawsuit — a document that at one point the judge states that a middle school student could find irony in.

“(Rhodes) has presented no credible evidence and has made no reliable factual allegations to support her unsubstantiated, conclusory allegations and conjecture that President Obama is ineligible to serve as president of the United States,” Land states in his order. “Instead, she uses her complaint as a platform for spouting political rhetoric, such as her claims that the president is ‘an illegal usurper, an unlawful pretender, [and] an unqualified imposter.’”

In his order, Land states in a footnote that Obama defeated seven opponents in a “grueling” primary campaign that cost the contenders more than $300 million. Obama then moved on to the general election, where he faced Sen. John McCain, who Land states got $84 million to wage his campaign.

“It would appear that ample opportunity existed for discovery of evidence that would support any contention that the president was not eligible for the office he sought,” Land says.

Taitz, who Land says has fueled the “birther movement” with her litigation, hasn’t appeared to have won any of her claims, the judge said. Taitz pressed her agenda by filing the complaint on behalf of Rhodes, a doctor who had her final two years of medical school paid for by taxpayers, Land states.

The judge specifically addresses Rhodes’ “birther” arguments, including allegations that Obama might have used 149 addresses and 39 Social Security numbers before becoming president and the existence of what Taitz claims is Obama’s Kenyan birth certificate.

Land ordered that the defendants — who include Obama, U.S. Defense Secretary Robert Gates and Col. Thomas MacDonald, Fort Benning garrison commander — will recover any costs from the complaint from Rhodes.

Taitz says she plans to appeal the ruling to the Eleventh Circuit Court of Appeals. She has 60 days to do so. She’s currently appealing a similar ruling in a similar case before Judge Clay Land involving another soldier.

I've always wanted to know what color the sky is in Taitz world.

I first heard about this birther nonsense around January. I looked into it. A simple google search provided me enough information to believe that Obama was born in the US and has a valid birth certificate.

Taitz will just keep fighting this. She's trying to make reality conform to her whack-job desires.
 
Judge Land is “a typical puppet of the regime — just like in the Soviet Union” and that “somebody should consider trying [Land] for treason and aiding and abetting this massive fraud known as Barack Hussein Obama.”

She should be dis-allowed from filing any lawsuits about anything.
 
Honestly, I wish the judge made Taitz pay for this crap, rather than make her "clients" pay for the waste of time. She's the one spoonfeeding them this crap; let her face the consequences.

I just adore watching judges say: "You're a freakin' halfwit now get out of my courtroom" in proper judicial language. It's an intricate literary exercise, given that they're not allowed to use the words "blowhard", "crapfest", and "whack-a-doodle-doo".

Not really. Dismissing a case with prejudice does indeed mean "don't bother us with THIS crap again," but you can't prevent her from bringing a case that is nearly identical in content but with a different named plaintiff or a slightly different set of pleadings.

There are, what, a half million troops in the US Army, plus the other branches of service. In theory, she could file the same damn paperwork for every single one of them and they'd all be separate cases that would need to be disposed of ("dismissed") separately.

Well before that, she would be disbarred and sanctioned into a small greasy smear,.... I hope.

ETA: I hope Rhodes turns around and SUES her for being a bad lawyer and causing her to lose money

Like Arthwollipot, I haven't enjoyed a judicial ruling so much since Dover. It was much fun.

Her "conscientious objections" to serving under the current Commander in Chief apparently can be accommodated as long as she is permitted to remain on American soil.
