I don't think he is. Because the US isn't a signatory to the ICC, Trump can kill, abuse as many US citizens as he wants, and not be subject to the ICC. But Venezuela is a signatory, so if Trump is not subject to judicial action by the US or Venezuela for crimes against Venezuelans then he could be subject to the ICC. The ICC can only be involved if individuals are not subject to national courts. US presidents can commit any crime in their role as POTUs and have absolute immunity in the US, the interesting question is whether an ex US president could be subject to deportation and trial for crimes in e.g. Venezuela? if not the the ICC does have jurisdiction for the crimes against Venezuelans.
 
What are the odds Dump will install a new, US-friendly dictator when/if they seize Venezuela? The trumpkins will go on about freeing the country and allowing free elections, but we all know neither Dump nor they care the tiniest bit about freedom and democracy. They don't want it at home, and they care even less about brown foreigners. In fact, since the cruelty is the point they'd probably be overjoyed if said brown people continue to be oppressed.

So what sort of flag would a Privateer carrying a letter of marque issued by Trump fly?
