The NY Times says otherwise. On his application to Columbia he listed his race as Asian AND African-American/black.

That was fraud.

That's not what it says. It says he ticked the categories "Asian" and "Black or African American". It doesn't mention a category "African-American/black". I see no problem with his describing himself as Asian, or black or African. It does very much look as if it's necessary to tinker with the wording before you can make it appear he misrepresented himself.

His race is Asian. He has no black or African ancestry. Both parents born in India.

I'm not going to try to tell people of Indian heritage around me they're not black. Not even if you insist someone else defines it as a category only for sub-Saharan black Africans.

Indians do not consider themselves to be black African. Momdani was clearly playing games on the college application because he was born in Africa, so he made believe he was racially African.

Its fraud.
 
Have you met any Indians from the far south? Many have very dark skin.
Some people really enjoy being confused about race vs ethnicity/culture vs literal skin color. A lot of them seem to be involved with the US Census, for some reason. But there's no reason you need to join them in their gratuitous confusion.

Cool. However they are not black African.

Momdani claimed to be racially black on his Columbia application so that he would hopefully get an Affirmative Action step up. It didn't work.

In the USA, black & African-American refer to a racial identity.

Someone from India or Pakistan or Australia, regardless of how dark they are, simply do not qualify.

Well, what do you think the reaction would be if Elon Musk put "African-American" on a job or college application for, cuz he was born in Africa?

The attacks and condemnation would be swift. As it should be.
