It appears that the judge was overruled by the appeals court -- twice. Presumably they are fully familiar with the evidence and the law.

The judge who presided over the trial of Oscar Pistorius has been strongly criticised by South Africa's Supreme Court for making "fundamental" errors and "ignoring" key evidence during last year's trial.

In an extraordinary twist in the case, Judge Eric Leach on Thursday night threw out Thokozile Masipa's original verdict of culpable homicide and replaced it with murder.

Substantive merits aside, the tone of Judge Masipa’s ruling was inappropriate. She described Pistorius as a “fallen hero”, adding that he lost “his career”, “is ruined financially” and that “having taken a human life in the way he did, he cannot be at peace.”

This language is wholly inappropriate given the circumstances. A person who murders another is expected to face financial, professional and emotional ruin and this should not be relied upon to excuse a lighter sentence.

It looks like she is still a judge. One hopes she gets nothing other than traffic offences to judge.

When a judge has an obvious crush on the defendent, justice and professionalism demand recusal. She didn't, and now (outside of her simpering loyalists) her credibility is shot.

I think a corpse on the floor is usually the one thought of as the victim.

Oscar can pretty much only be a victim of thinking it's a good, safe idea to shoot indoors (and through doors) blindly and without concern for others who you know are living in the house. Or no longer living, or in the transition from one state to the other as you continue to fire.

So, what phone records are you talking about? As far as I can tell, he was paroled which traditionally means you are still considered guilty of the crime but no longer a danger to society.

Hard to imagine a guy that shot blinding through a closed door into a bathroom without knowing where his girlfriend was is no longer a danger to society but hey, what do I know.

Edit: who cares about the phone records. Even if he told the truth, his truth was that he shot blindly through a door at someone that anyone should have known was probably his girlfriend.

From what I can tell his argument was, "I heard a noise in the bathroom and thought my girlfriend was asleep in bed so I deliberately shot at the intruder in my bathroom, not the big bathroom but the really small room with just the toilet where there is literally no way I could miss and literally no reason an intruder would be in there and they would have had to go through my bedroom to get to!" So, perfectly innocent and reasonable choices.

I've been of the opinion that even if he was telling the truth, he's still a murderer because he's an idiot. He was trying to kill someone, for sure, even under his own story.

But I don't think he was telling the truth (it's hard to believe that he was actually so stupid) and that link of yours says nothing about "phone records". There was no intruder in the house, and no conceivable reason for him to imagine that there was.
