From what's been reported, Penny continued to chokehold Neely after he had become unresponsive and warned he was going to kill him. I have no doubt that Penny did not intend to kill Neely, but his action was reckless and showed a disregard for human life. Murder? No. Manslaughter? Yes.

The longer video that emerged today shows the three minutes and 52 seconds after the train pulled into Broadway Lafayette station on Monday at 2.30pm.

The footage begins with Penny already with Neely in the chokehold. For two minutes and five seconds, Neely struggled on the floor, flailing his feet.

He went limp after two minutes and six seconds, by which point a by-passer had stepped onto the train.

The man - who can be heard but is not seen - warned Penny that Neely had defecated, which he feared was a sign that he was dying.

'He's defecated on himself... you're going to kill him now,' he said."


"Another man who was helping Penny restrain Neely replied that it was an old stain on Neely's trousers, and that Penny was no longer 'squeezing'.

'He's not squeezing? All right. Because after he's defecated himself that's it. You've got to let him go,' he replied.

He then warned of a 'murder charge'.

The second man turned to Neely and said: 'Hey can you hear me?'. Met with silence, the man told Penny to stand up.

Penny does not speak, but releases Neely and springs to his feet.

The unidentified by-stander can be heard saying: 'That was one hell of a chokehold, man.'

Over the next several seconds, Penny and the other man who had been helping him attempt to put Neely in the recovery position.

After three minutes and 50 seconds, Neely appears to convulse or take a deep breath.

The video cuts out at three minutes and 52 seconds. It is unclear whether he moved again.

I see that claiming everything is "Soros-backed" is the latest GOP crap. Lord, these people are so disgusting and stupid.

Judging from other asshats that have supported Daniel Penny (Elon Musk) it appears he is another hero for the right-wingers.

The meme of the big bad cities looms large in the reactionary mind. These people act like big cities are practically open warzones and they'll celebrate anyone who engages in vigilante violence against this perceived lawlessness.

It's interesting to see them twist themselves into pretzels trying to explain why, even if you're being generous to Penny, accidentally choking someone to death isn't manslaughter.

Everything costs you, but the people in charge just write off the cost of the old cars on their taxes and then steal the money to buy new ones. Then they sell you a lottery ticket.

I'm not sure of your point. Seems like you're combining two. My point is that we ignore problems at our peril.

The puppet board appointed by Florida Gov. Ron DeSantis (R) in his ongoing war with Disney has now made, perhaps, their pettiest move yet: threatening to impose code enforcement fines on Disney subject to foreclosure, meaning they could theoretically be used to seize Disney’s property.

According to the Orlando Sentinel, DeSantis’ board has “created a code enforcement system that could issue fines to Walt Disney World, which is known for meticulous care of its grounds,” which would include imposing fines for code violations of up to $500 per day, all determined by a group of newly-appointed code enforcement officers, who would answer to the new administrator the board had selected (along with a substantial pay increase). The new program “would also authorize foreclosures on any liens.”

The suggestion from the governor and his puppet board that a new code enforcement regime is needed at Disney is beyond laughable, but the added threat of fines enforceable by foreclosure ratchets this all up to a despicably insane level. What possible code “violation” will DeSantis’ minions find as a pretext for seizing property in his quest for vengeance against a mouse who dared squeak one press release of criticism?
