Someone needs to tells Surburban Turkey is that these is nothing that Biden can do about it.he has no control over state legislation;it's all up to the courts.

That's you are a Progressive and not a Democrat. It has nothing to do with politics. It has everything to do with the Progressives will always be perfect because they will never actually be tested.
 
So what happens if some vindictive or mentally off person accuses a girl/woman of having an abortion ? Does the accused have to undergo a gynecological exam to prove she didn't? This law is just so filled with problems that's it's going to be a nightmare.
 
Having to pay the court fees for the person that is suing you, plus them getting the $10k is going to flood the courts. I wonder how much evidence will be required.

The only upside to this is that the people who are able to sue do not have the powers of law enforcement behind them. It's going to be exceedingly difficult for them to prove, even with civil court having lower standards than "beyond a reasonable doubt".

Who cares if they can’t win? They can hit the target with lawsuit after lawsuit, make the target submit to discovery, force them to hire a lawyer, tie them up in court indefinitely…

It basically legalizes SLAPP suits against anyone remotely associated with abortion, then tries to make the law difficult to challenge in court by saying it only applies to civil proceedings.

There is no enforcement agency to the law. So it would be on whoever is bringing the lawsuit to prove she had it by their own means. Since they can't get medical data due to HIPAA (which IS a federal statute) that means that there's really nothing they can do.

The more I'm reading up on this the more the teeth are falling out of it. It appears they put significantly more effort into making it pass the courts than they did actually making it effective for anything other than grandstanding.

I'm not saying it's great. I'm saying that there are ways around it, and it appears to be more for grandstanding and, in essence, to harass women in general.

That being said, let a few women start getting harassed by this and see what happens next election cycle.

I don't like it, but it's going to piss A LOT of civil judges off.
 
Let's not shift the argument here. None of that matters.

Suppose the woman is a slut. Suppose she is irresponsible. Suppose she wants to "use abortion as birth control" (just for the sake of argument —it doesn't matter that no one actually does this).

If she wants an abortion, she should be able to legally get a safe abortion. It's as simple as that. You don't even have to be a "fan" to accept that abortion is good and should be widely available in most circumstances.

A baby should not be the equivalent of a fine to be used for the purpose of punishing someone for being a slut*.

* And yes, I am using the word here to reflect the thinking behind much of the pro forced birth mindset and for effect. I am not using it because I think it should be generally used.

CainKane's post pissed me off, because I get really tired of hearing about the "rape and incest exemption." It makes me boil, because the pro-life people espousing it (who THINK they are being very charitable and moderate by including it) are actually just admitting that they oppose abortion because they want to punish women for having unsanctioned sex.

They don't realize that's what they're doing, I don't think, but there's no other way for me to interpret their argument.

If abortion is wrong and murder, then it's wrong and murder - PERIOD. It shouldn't matter how the baby got there. That's a human life. You said so. (You meaning the proverbial arguer, obviously.) You can't just kill people because they end up in inconvenient places through no fault of their own. That's the argument, right? So why should it matter to the "baby's" inherent humanity if the mother was raped or if she enjoyed herself?

The only ethically consistent position regarding fetal humanity is one that rejects all abortions. Unless, of course, fetal humanity isn't really the crux of the issue, after all...

But the would-be children of pro-choice people aren't going to grow up to be fundamentalist Christians. If anything, the quiverfull bunch ought to be encouraging abortions for everyone except themselves!

What I don't understand is how the new TX law was allowed to go into effect as it is clearly in violation of Roe v. Wade.

I think the Biden Admin will do something about it if they can. I'm not a lawyer or an expert on what executive actions can do or what Congress can do so I won't even attempt a guess. But I do know that if something can be one, it will be done.

A federal law would trump a state one, but nothing will be done because Manchin and Sinema.

We could move to Austin where we have family and live a lot cheaper than here on our retirement income. It's actually a nice city and the 'bluish' area in TX, but we just can't bring ourselves to live in a place that is otherwise a sea of Trumpers. Plus... I hate the weather in TX. Too damn hot.
 
Like most reasonable people, I don't endorse women using their wombs as a mobile death chamber in lieu of sexually responsible behavior. That is my preface, as someone who leans conservative, for the following:

This Texas law is insane, imo. Firstly, 6 weeks...many women won't even know they are pregnant. No exceptions for rape or incest? Equally crazy.

Somehow, I hope that in a semi-sane world, this legislation will not stand for long.
