Seeing as how they've already proven she wasn't tired and wasn't planning on going to bed I don't see what difference they think it's gonna make.

If she can't handle taking on a person bigger than her (she's ******* 5' 2" and 110lbs) then she shouldn't be a cop.

I have been known on many occasions to stay up past my bedtime, even going out and partying when I should be going home and getting some rest. Such parties are never as awesome as I expect, usually because I'm too tired and end up passed out in a corner after half a beer. I attribute such poor decision-making to the fact that I'm kinda tired when I'm making the decision to stay up late anyway.
 
Seems that the defense is going for a "no criminal intent, just a tragic accident" defense, as expected. Not sure what other option they really had. Though I didn't hear anything about extreme fatigue or any other such excuse, just run of the mill carelessness with tragic consequences.

Realistically, hoping for a lesser conviction, hung-jury, or not-guilty would all use the same defense strategy. Who knows how persuasive this will be to the jury.

She was describing me to a T as well. I am diagnosed ADHD and can't stand the effects of the medicine. I am zero percent shocked that's the path he took.
