If the judge rules Mueller has exceeded his authority, then it proves an out of an control deep state. If the judge rules Mueller has not exceeded his authority, then it proves an out of control deep state.
 
If the Judge were inclined to dismiss the indictment against manafort, the Judge himself suggested that the case be handed off to ED Va prosecutors.

But as the Judge pointed out, Manafort is a small fry, and the real impact would be that Mueller would lose his leverage on Manafort to use against trump.

That might not be to Manafort's benefit then. If he can't cooperate with Mueller, and gets convicted, he's going away for a long time.
 
Is judge Ellis an old fogie like Alan Dershowitz or Rudy Guliani, whose once seeming good sense has faded and are now adopting bizarre reasoning in support of Trumpism?

I had the impression that Mueller's broad mandate was not unlike that of a beat cop. Any criminal activity observed or uncovered was fair game in pursuing to prosecution. Can anything in respect of the Manafort case be legally construed as being fruit of the poisoned tree? I don't see how...

From what we know, it seems that Mueller's team did what any good investigative team would do - followed the money. That led them to a previous investigation of Manafort. The judge is now saying that because these charges are based on an older investigation they don't count as charges that came up as part of this one, and which are therefore outside of Mueller's remit. Without knowing all the ins and outs for ourselves (as well as being pretty familiar with the relevant laws), none of us can really say.

It is worth noting, however, that this judge doesn't seem to be biased towards Manafort, as shown when he imposed a second ankle bracelet on him, one with conditions even more restrictive than the one he was already wearing.

That was my thinking. You have a prosecutor who is not interested in you other than as bait and you are complaining about that and asking for the case to be handled by a prosecutor who could make their career by nailing you to the wall. That doesn't seem wise.

Maybe he's been hoping for a pardon.
 
If Trump pardons Manafort, Manafort can't plead the 5th. That would work quite well for Mr. Mueller's investigation.

What if you just kept claiming you don't remember whenever they ask a question? Could a judge cite you for contempt?

Does not answer the question asked. That is about warrants and seems it would apply to any US attorney. My question was specific to issues around a special counsel and not about warrants.

ETA: I would call it interesting,and a normal person probably does find it interesting, but I have very little interest outside my question anyway.

I'm curious what the resignation of Ty Cobb says about the state of Trump's defenses, will see if it's a topic in other threads. I don't really need another CNN piece, or Vanity Fair or whoever, explaining why this time the WH is REALLY in chaos. On the other hand having lawyers bail on you right and left can't be a good thing. Trump does deserve representation, but it seems many on his team are foreseeing ethical pitfalls to serving in that role. I really don't understand what those would be, exactly.


Sure, but there is no guarantee of quality representation.

Ask any indigent minority defendent with ginned-up charges who gets a wet-behind-the-ears public defender.
