Oscar Pistorius shoots girlfriend - Part 2

Some of us are having trouble with SA courts being allowed to change the sentence after OP has been convicted and the punishment set. Would courts in the Netherlands be allowed to change the punishment for a convicted criminal?

I don't know about the Netherlands, but in the UK people appeal against sentences all the time. The hazard is, it may just as likely be increased as decreased.

Oscar just can't keep out of the news it seems. First, he was involved in a prison brawl over the use of a phone and now on December 18 he and his defense team filed papers at the Constitutional Court to appeal his sentencing.

This is Oscar's last chance to avoid his prison sentence. It angers me that he still will not accept responsibility for Reeva's death and instead fights to get off with a light punishment. Remorse and responsibility are two concepts lacking in Oscar's moral toolkit.

Remorse and responsibility are not inconsistent with personal liberty.
It is possible all members of the forum are free, and feel remorse and responsibility for something they have done.

Actually, Oscar is not being punished for killing Reeva, but for killing "whoever was behind that door because he/she wasn't an immediate threat". It was never proved that he knew it was Reeva, and I suspect that if it had been proved that he knowingly blasted off at Reeva in a rage the punishment would have been significantly heavier.

So he is actually getting off with a light punishment. His problem is that he seems to keep arguing that the penalty for blasting off recklessly at an unknown person who wasn't an immediate threat should be lower than the minimum sentence he has already copped and I can't see that going anywhere.

Pistorius' legal battle is over. His final application to appeal to the Constitutional court has been rejected. He has no other way of left of reducing his 13 year sentence, which he should now complete in the normal way.

It is unclear, apparently, when he will be eligible for parole.

Does anyone know about the facility he is locked up in? I'm curious what type of prisoner he is, and how much he is around general population.

This may be an unfair appraisal, but from what little I have followed my impression is one of entitlement and arrogance. As I said, perhaps I'm wrong.

No, I don't think you're wrong.

If Oscar's story is true...
I see a tragedy where a man was captured by the allure of big money, powerful guns and paranoia that followed.
He destroyed his girl friend and his own life, acted in haste, repents at leisure.
This can happen only where guns and crime are rife, Oscar manufactured neither.

More pathetic excuses for a violent murderer. Nobody forced him to do anything, least of all Reeva. He's still got a relatively short sentence. I hope he does it hard.

Yes, he had the world at his feet, poor chap.

Nope. He slaughtered an innocent woman in an act of entitled indulgence, then fabricated an alibi (which was also murder) in an attempt to get away with it. Simple.

Well there's someone in another thread arguing endlessly that the armed burglar who broke into a 78 year old man's house in the middle of the night and ended up getting stabbed by the pensioner is a victim deserving of sympathy. Your ideas on justice aren't quite the stupidist being displayed on the forum at the moment.

The irony of your post is simple.
He thought he was protecting Reeva, if he is telling the truth that the judge believed.
This is so like Schrodinger's cat.
And Oscar was hero or goat. He knew which as soon as he got back to that empty bed.

Oh Christ. The hero worshipping judge (like you) who was proven wrong.

Accept it, you hero is a scumbag murderer. He knew what he was doing, murdering Reeva, and is finally paying the price.

Yep. You know I think this likely. That doesn't allow anyone to commit murder, though.
No of course not. I am surprised by the brains on thread being so captured by judicial terms.
Murder.
I don't see this as murder, but we are going in circles sadly.

......I don't see this as murder.......

Luckily, people who write laws and uphold laws had the sense to discount the sort of views you hold. You are wrong, and they (and we) are right.

This is the forum where we should be nuanced, of course it was either murder (he knew damn well Reeva was behind the door), or some other form of homicide. And everyone forgets that four shots could not be sure to kill, tragically there was one bullet that shattered her head.

I tell you what, Samson. Rather than go around and around in circles with you on this, let's discuss it when Pistorius is released. Just as I'll discuss Bamber when he has died.
