Everything that isn't protected by attorney-client privilege is fair game; and as a Fixer, Cohen would have kept his clients at arms length for most shady deals, ergo no privilige.

And everything criminal is also not protected by the privilege.

But not trump disclosing crimes to him after he committed them, only ones that Cohen was involved in the planning of.
 
So, since the raid on Cohen seems to have been triggered by Trump's statement that he knew nothing about the payment to Daniels, and that statement was "very clever", then it must mean that the raid was part of Trump and Cohen's plan, must it not? I can't wait to see what very clever move they've got up their sleeves next.

As usual, Seth Abramson's feed provides very useful context. He thinks the SDNY coordination was probably done to provide a "clean team" to overrule objections of attorney-client privilege. Apparently it's SOP to have a team like this.

Also the raid wasn't just about Stormy - remember Cohen has been Trump's "fixer" for years.

As usual, Seth Abramson is a dope. There is no reason Mueller's team could not provide a segregated team to review for privilege, but there is a reason that they would make a referral to the SDNY team of matter outside the scope of their appointment.

Also, the appointment has no legal basis, but is an attorney general creation. The scope can be modified on a whim.

That actually depends: if he was seeking Cohen's advice, then yes, it would be protected.
If he was bragging about it not.
But it is very unlikely that Cohen would have any notes on such meetings.
 
If they found criminal evidence while looking for the stuff on Stormy would it be admissible? It gave them enough for the warrant after all.

From what I've read there are a few exceptions to attorney client privilege. If communications involved the planning of the commission of a crime, fraud or tort it isn't protected. The same if there are communications not strictly given in a legitimate legal context or if that information has been disclosed elsewhere.

So for starters, "Michael, help me cover up this money laundering" would not be protected.
 
Attorney-client privilege cannot be used as cover for criminal activity. There is law specifically aimed at that.

UPDATE: The readers of this feed are smart as hell. I just got a tip via DM suggesting Mueller *may* have used SDNY in part so attorneys there could act as a "clean team" to conduct a privilege review on any attorney-client documents taken from Cohen's office. Interesting theory.

Most likely, Mueller would have had to inform the DOJ of the upcoming raid if he was going to initiate it: this would have tipped Trump/Cohen off.

the SDNY DAO is part of the DoJ and at a minimum the DA would have had to sign off although it is more likely that they kicked up to the Assistant AG level.

This is a separate team entirely, who is not investigating Trump even indirectly, to properly vet his claims of attorney-client privilege (which have already begun) in accordance with the law and tell him to go suck it when appropriate.

This is how grown ups who respect the justice system more than politics conduct themselves. Take some notes or something, it may be educational.

She said a lot of things. The daughter crack (how convenient, we all know he wants his daughter, right?). The mysterious threat in a dark parking lot - "Be a shame if something happened to your little girl..." What is this, The Godfather? That right there made me question a lot of other things she said.

You and Vixen should make a play date to learn some of the very basic, beginner facts of this case. It wasn't a dark parking lot, he didn't threaten the girl, and Trump himself has stated he wants to take his daughter to poundtown on more than one occasion.

What you're basically saying is what made you question a lot of other things she said is based off of things she didn't actually say that you weren't paying enough attention to. There has to be a fallacy name for that.

You aren't familiar with his appointment, are you? The scope of his appointment explicitly allows him to claim whatever he likes as part of his appointment. That wasn't part of the logic.

The FBI raids are clearly very good for Trump & Co. It is truly another sign that Trump has done nothing wrong and has the best people working for him. I'll just sit back and listen to all the well reasoned explanations why.

Note: Bush's personal attorney was never subject of an FBI raid and we all know how awful he was. Either one, really.
