Getaway driver arrested for murder.

A bunch of kids, probably drunk, after having successfully stolen alcohol from the homeowner's garage earlier.

Spraying them with bullets was not the answer.


These weren't kids, they were criminals, and now they're dead, see how that works?

The ridiculousness of the scenarios is kind of the point. At the one end is shooting the criminal while he's in your home - under US law, entirely reasonable and, if the criminal happens to best you, he cannot claim self defence


it's pretty clear that it's ridiculous to apply the same immunity to the original victim the following day, after all has been completed.


At some point between the first scenario and the second scenario, it becomes ridiculous. When is that?
 
I still maintain that there is a lot to this story that we haven't been told.

Most "Home Invasions" of this type are done by people who know each other and have got a grudge - there's always a back story that leads to the "Invasion". Any time I hear of this type of home invasion, I do not think in terms of "perpetrators" and "victims" since both parties seem equally responsible for the carnage.

A lot of journos would lead you to believe that this type of Home Invasion could happen to anyone. No....it doesn't. As long as you are not dealing drugs and stealing from people, you never have to fear this type of Home Invasion happening to you.

In Texas you can ... you can even shoot them if they're stealing your neighbour gardening tools.

Following him to his garage to shoot him when he's no threat to your life is ridiculous. In fact, shooting him in the back as he makes off with your stuff is pretty extreme, in my opinion. But when he breaks into your home and you're there, you must reasonable assume that he could be there to hurt or kill you or your family. It's not the same situation at all because of the present danger.

I'm with you, but the law in the US seems to work differently and a fleeing criminal can be shot in the back with immunity, if I recall correctly. i think there's case law that tallies with this (I may be wrong, I often am).

I'm wondering - not of you, but of anyone that knows about this stuff - what the law is in this instance.

Personally I do not even have firearms ready for self defence in my home ... then low crime risk in my area makes it unnecessary in my opinion.

I don't have firearms, either. I'm uncomfortable around them. I do have a very nice hooked machete that belonged to my father when he was working in the forest. It looks a bit like this one:

Evidence that the son and the father were dealing drugs and stealing from people?

Many years ago, my parents house was invaded, vandalized and burgled. I can assure you my parents were not dealing drugs nor stealing from anyone.

I'm very comfortable around firearms .. used them on the farm as a kid all the time, and for hunting and I used to be in a gun club ...

but I live in the city now, far from the gun range .. and I'm too crippled to walk around in the bush hunting for food, so they are not needed anymore.

If your parents were at home while it happened and were threatened by the intruders - then yeah, I think they were dealing drugs.
