Who killed Meredith Kercher? part 23

Oh dear. Please look at the phone logs - all available as part of the court records. Amanda was by the basketball courts when she read Patrick's message.

No. No she wasn't. That was an ignorant and incorrect interpretation of the base station data on the part of Massei.

I suggest you read either the transcript of the relevant expert witness testimony - or, even more easily, the many other references to this same base station tower and sector within the Massei Report itself - to see that this base station sector clearly covered Sollecito's apartment.

Another fail.

You have been given ample links. Now go do your own research.

This comes across as a bit feeble. It is in your interest, in the sense that you want to advocate a particular position, to make your case as well as you can. You don't have to, but your views are not going to get any traction if you ask people to research stuff that they don't believe.

And there it is! So predictable. Just how hard would it be for you to provide the actual quote if it existed? Surely it would be on TJMK. But you can't, so you shan't. :jaw-dropp

It matches the blood imprint(s) perfectly.

Then the prosecution should have submitted evidence to the court to support this. Too bad they didn't hire you lol

What is strange is that Machiavelli's claim above was not made, until it was made by Prosecutor Crini at the Florence trial. That's right. The evidence was available to police on Nov 2, 2007, and it was not until the Fall of 2014 that anyone mentioned that "match" in court.

It certainly does not match the forensics. But by the Fall of 2014 the "two knife theory" had collapsed, and without a match, the bedsheet stain rules out the kitchen knife from Raffaele's.

yes, it is now a proven fact that Amanda Knox was on the murder scene when Meredith was killed, that Meredith was killed by multiple persons (and Guede was not the one holding the knife) and Knox washed her hands of Meredith's blood.
It is also proven that she falsely accused an innocent voluntarily and that false accusation was a prolonged behaviour, and any alleged violation would be irrelevant to the evidence on the point.

It is also obvious that the trial was annulled for political reasons, just like the Andreotti trial, by a judge who was a former politician (and formerly investigated, but "saved"), and was annulled because, after the corruption with a political imprimatur of the Hellmann trial, that would have created a situation in which Sollecito would be the only person who goes to jail (while USA would refuse to extradite Knox), a situation obviously non sustainable on the international leval because in that situation those who "know" would blackmail and destabilize too many people.

Just for the record "Ada" indeed "submitted a witness statement" to the police on Nov 15th, 2007... but when the case came to trial no one, not even Volturno was able to find her :(

Vixen, you seem to mix up the above "witness not found" documents with this post from Amanda Knox's blog...
I wonder, why?

This Ada is easily identified as the same person who testified in a written witness statement to the court of the fact of Amanda whinging about not being able to get back some of her things in the cottage.
Do you actually read the posts you respond to?
It's interesting that you are focussing on a sidenote in said witness statement...

I will not divulge the current link to her identity here for reasons of her right to privacy.
How gracious of you, problem is that graciousnes isn't needed, because anyone who has more than a little knowledge of the case knows who "Ada" is...

What I will say is , it is the same Ada as in the blog. Russian name, Far Eastern ethnicity.
In what blog? Knox is only speaking of "Ada"...

Thanks to Amanda's indiscreet disclosure (revenge for the negative slant of Ada's witness statement, perhaps?) poor Ada is now in danger of being arrested by Italian police for contempt of court for failing to turn up as summonsed. Now everybdoy knows she is to be found...living in Seattle.

Gee, thanks, Amanda. _NOT!
No, she isn't. Looks like the police failed to remind her to give her new adress, in the case she was leaving Perugia and it looks like "Ada" finished her studies in Perugia, moved on, and ended up in Seattle years later.
Blame the Italian police for not keeping track of her. ;)

Such "theory" has not collapsed at all.
Never disproven by any court, never collapsed.

Right. That's why the ISC exonerated the pair in 2015. Right.

That's also why there was no mention of the "match" before the 2014 trial.

Thanks for your opinion, and wecome back to the thread.

Just so you know, the average award of the ECHR is just €3.5K* and research shows even if a settlement is negotiated out of court, it is rarely more than what the court would have awarded.

No doubt, Amanda is locked in a negotiation dispute with Italy trying to demand €500K, which might explain the delay in the update.

*This refers to Article 6 claims (denied a fair trial).

Article 3 (Torture) commands a higher award, so no doubt, this is why Amanda has tried to claim torture.

The "delay in update" is actually just because the ECHR has made another round of questions to Amanda Knox. They probably don't like to tell you about that :)

It is the most interesting unresolved question to me. Was the final acquittal political? Luca Cheli certainly believes so, and indeed he forecast an acquittal. I consider Raffaele unlucky in the first instance, but extremely lucky in the final phase, that he was tangled up with an American girl.

None of this is obvious at all. If it were we'd be hearing from other sources rather than the tried and true guilters who are hanging on.

Regarding the so-called "political nature of the exonerations, please share your thoughts on how it went when a Florence court was approached with this.

Right. That's why the ISC exonerated the pair in 2015. Right. (...)

Even Bruno Marasca state they agree with the lower courts there is incontrovertible evidence that Knox was killed by more than one person.

It's not my opinion. It's the 5th Ch SC's opinion.

(...)

Regarding the so-called "political nature of the exonerations, please share your thoughts on how it went when a Florence court was approached with this.

I suppose was never approached, since the political nature of the annullments (note: annullment, not exoneration) is something that occurred in Rome, which is outside the Florence jurisdiction.

This was the only thing I used to agree on with Luca Cheli. The annullment is obviously political, this is manifest even just from the fact that it is completely nonsensical from a legal or logical point of view, contradicts factual findings and trial papers and is in egregious conflict with the res iudicata (definitive point of law established by !st chambers).
It even places the suspects on the scene of crime and fully embraces the findings like multiple murderers etc. as I pointed out.
It even states "530.2" which is nonsensical in a SC verdict.
The sentence says "political" at every line.

Thanks for these. I don't think London John was saying RS was a saint, but that his remarks were "stupid and immature". I think RS's remarks if true, are pretty awful actually, and while I am still a bit unclear about the context, any "jokes" that might allude to crime and murder in particular ("I will be nice and painless"- is it really true he said that?) are extremely thoughtless. I would want more context to lower my opinion of him further. I can see why you would want to post the links, and it might have been more effective if you had couched your commentary with a bit more caution (IMV).

Not really. Although Italy could have proved it had they recorded the interrogation. Incompetence is a theme in this case. We'll see what the final word is when the ECHR is done with the case.

It is also obvious that the trial was annulled for political reasons...and was annulled because...of the Hellmann trial, that would have created a situation in which Sollecito would be the only person who goes to jail (while USA would refuse to extradite Knox), a situation obviously non sustainable on the international leval....

I think there is some truth to this. While it's true the USA would have certainly refused extradition, it's not because of 20 posters on ISF e-mailing John Kerry saying she's like totally innocent bro, it's because Italy would have no case claiming there was a reasonable basis to believe the accused committed the crime outside of a Massei/Nencini show trial and they would have to actually provide all the relevant documentation on the case, and evidence, and risk exposing the entire fraud.

I suppose was never approached, since the political nature of the annullments (note: annullment, not exoneration) is something that occurred in Rome, which is outside the Florence jurisdiction.

Thanks for the info.

On the other matter, the Boninsegna court called it an absolution.
