Ed clintonemails.com: Who is Eric Hoteham?

Face palm:

The Justice Department said Friday it has been asked to investigate the “potential compromise of classified information” in connection with the private e-mail account that Hillary Rodham Clinton used while serving as secretary of state.

None of those reviewed by his office “had classification or dissemination markings, but some included” intelligence community information “and should have been handled as classified, appropriately marked, and transmitted via a secure network,” McCullough wrote.

In other words, not kept on a cowboy server next to Bill's old Hustler Magazines.

Your second source agrees with your first source that the information contained in Clinton's emails was not classified when Clinton sent those emails. Some information was retroactively deemed classified. The State Dept released at least one email containing that retroactively deemed classified information on June 30, 2015.
Face Palm is correct. I suppose if one is so invested in a "Clinton is evil bad wrong" narrative, one is unable to understand that Clinton is not responsible for the State Dept releasing an email containing retroactively deemed classified information on June 30, 2015.

ETA: Also from your second source: It is not a criminal referral. So, we have a request for a not criminal investigation into something that also doesn't suggest wrongdoing by Clinton. It would really help you to read your own links.

The great news is that there is no way anyone can justify not getting Hillary's server.

We know it had classified information on it, so we need to know what else was on it and whether it was exposed.

From the article cited:

...

Clinton’s campaign pushed back quickly Friday against the suggestion that concerns by the inspectors generals raised deeper questions about her online exchanges. Spokesman Nick Merrill said that she had “followed appropriate practices in dealing with classified materials.”

“As has been reported on multiple occasions,” Merrill said, “any released e-mails deemed classified by the administration have been done so after the fact, and not at the time they were transmitted.”

...

Therefore, if Clinton used her own e-mail server, used a State Department e-mail server, or used a Bozo the Clown e-mail server, then the selection of any e-mail server would have had no effect on the post-transmission classification of the e-mails.

I do enjoy the spin from Hillary's campaign being presented as if it were factual.

Sure we mishandled secret information while I was SoS, but because we mishandled it was perfectly fine for me to run it through my personal server.

Time to give up the server, Hillary.

From wareyin:

And from me:

No comment on the fact that it is not a criminal referral?

It's almost like 16.5 doesn't want to answer this question...

I thought you said you knew what retroactively meant.

Might be helpful if you actually cited and read the actual documents:

"The letter I.C. I.G. sent to FBI earlier this month was a counterintelligence referral indicating there is a compromise of classified national security information in former Secretary Clinton's emails. The emails exist on a at least one private server and thumb drive, and that was the counterintelligence information concern we referred to the FBI," said Williams in an email.

A Justice Department official said Friday: "The department has received a referral related to the potential compromise of classified information. It is not a criminal referral." Earlier in the day, Justice referred to it as a "criminal referral" before revising the statement. Williams noted, "We don't make criminal referrals; that is over to FBI to decide how to proceed."

I will cheerfully concede that they made a "counterintelligence referral indicating there is a compromise of classified national security information in former Secretary Clinton's emails," if you think that sounds better?

The retroactive nature of the classification of some of these emails is actually besides the point. Hillary was the chief diplomat of the United States. Even her opinions about foreign leaders that she sends or refers to in an email is potentially sensitive information that should be classified. She could have produced classified information on the spur of the moment, out of thin air, because of who she was and how important her decisions were. Who is going to stamp "classified" on her emails the second she composes it on her computer? Of course the classification has to be retroactive, unless she does it herself. The fact that many of the emails on her server, upon reflection, were considered sensitive - even many years later - is of huge importance and relevance.

Also, the fact that they weren't deemed classified until years later is a direct consequence of the fact that she squirreled these emails away, out of sight from prying eyes (except for, perhaps, the Chinese and the Russians).

And who demanded the release of Clinton's emails, which according to you were classified by nature?

You'll be providing evidence that the Chinese and Russians hacked the server, I assume?

You opinion is both noted and irrelevant.

More importantly, the "retroactive" classification claim is WRONG.

The intelligence IG said at least four emails in question "were classified when they were sent and are classified now,"

The fools at State Department just failed to MARK them as such. Keep in mind State was handling Classified info marked as classified by the intelligence community. Then STATE failed to handle the classified information as such.

absolute screw up of the highest order.

It is utterly amazing that we know Hillary's server has classified information on it and that it has not been taken into possession of the United states Government and that Hillary has not voluntarily given it up.

You think the FBI would take YOUR word for it?

The FBI should seize the server TODAY.
