Continuation Part 11: Amanda Knox/Raffaele Sollecito

Love the attempt to move the goalposts. The original post was about AK's false confession or murder and rape which I appreciate you have acknowleged, albeit with explanations.

I don't know why you keep jumping up and down about us "acknowledging" something which has been a core part of the discussion for literally many years. It's a bit like a 9/11 denier doing a victory lap because someone "acknowledged" that the World Trade Centre towers fell down. We all know they fell down... what's your point?

The rest of your post regurgitates the FOA fact sheet.

You say that like it's a criticism. Even if "the FOA fact sheet" was a real thing you could link us to, that wouldn't somehow magically prove that everything on that fact sheet was false.

I didn't bring up the computer evidence, or the autopsy, so why would you if you didn't want to distract from AK's very damning admissions to the police?

I'll walk you through it in baby steps.

If Knox turns out to be factually innocent, then her statement is virtually certain to be a coerced, internalised false statement. This is because an innocent Amanda had no reason to make a deliberately malicious accusation.

Only if Knox is guilty does it make sense to think that her statement was a deliberately malicious accusation. Guilty Amanda does have a reason to make such a statement. Not a very good reason, really, since fingering Rudy would make a whole lot more sense, but at least it's not totally crazy.

The computer evidence putting Knox and Sollecito at home at 21:10, combined with the eyewitness evidence and autopsy findings putting the time of death before 21:10, show that it's overwhelmingly likely that Knox is factually innocent.

Therefore since it's overwhelmingly likely that Knox is factually innocent it follows that her statement is virtually certain to be a coerced, internalised false statement.

Yet Amanda never told the police the truth that Lumumba wasn't invlved at any time. I know, she was confused and pressured, villified and scapegoated. But during her victimhood, she never once told the truth about Lumumba. I guess she remained confused until well after he was released.

This demonstrates a series of logical fallacies resulting from an assumption of guilt.

1) The problem is you do not know that. You do not know that because there is no recording. Knox may have repeated multiple times that Lumumba was not there, but eventually said what 'the police knew to be true', which is the only statement they recorded.

2) What you can say is that the police never recorded Knox saying Lumumba was not involved.

3) As has been said if Knox was not there she could not know that Lumumba was not involved. So an innocent Knox could not be expected to make this statement.

So your argument is; If Knox was innocent she would have said that Lumumba was not there. The only way she could not know Lumumba was not there was if she was guilty. If she says Lumumba was there then she is guilty.

Is the logical error clear?

griffinmill:

Since you seem sure the convictions are correct, you know the following.

1. Amanda was there, Raffaele was there and Rudy was there.
2. You know all three are certain of the presence and involvement of the other two.
3. You know that Amanda knows that Raffaele is being questioned by police in another room, and you also know that she has no idea what he is saying, unless they have agreed on a story.
4. If they have agreed on a story they have agreed to blame Patrick, otherwise she has no idea what he is saying.
5. You know that in fact he never mentioned Patrick because you know the police would use this as evidence as they did with Amanda.

Therefore you know that Amanda and Raffaele had no agreed story.
Therefore when Amanda names Patrick, she can expect Raffaele to be naming Rudy, absent an agreed story.

How is she advancing her cause by naming someone in one room that she knows was not there, and she knows for sure Raffaele is not incriminating?

In fact when she names Patrick she knows she is lying, and that the lies will be immediately exposed, because Raffaele is either telling the truth or a different set of lies , and definitely not corroborating her lies, because as I just proved, they went to the questura with no agreed story.

I can't believe how dumb some people can be not to figure this out instantly.

Sorry for the ungainly bolding.
I look forward to you dissembling my logic.;)

Griffinmill refuses to acquaint himself with the actual source material so his arguments are not coming from any form of logic employed outside of the guilter circles. Let's look at some of the factual errors of his in just the last page of posts:

You obviously know her signed statement contains these details. If you wanted to be a little honest, you could at least say, "I know Amanda said these things in her signed statement, but I believe the police coerced her into saying it."

Those statements were written by the police, in Italian, using police terminology and phrasing. We know that Amanda was asked to sign them just as she was asked to sign the summaries of her previous interviews. We don't know if she read them.

It sounds like you're pretending that statement didn't happen and prefer the 5am voluntary confession where she "stands by" the same signed statement (of rape and murder) made only a few hours earlier, but also "doubts the veracity" of it.

The "stand by" was not in the 5:45 statement. That was what she wrote the next evening:
"And I stand by my statements that I made last night about events that could have taken place in my home with Patrik, but I want to make very clear that these events seem more unreal to me that what I
said before, that I stayed at Raffaele's house."

She is standing by the statements she made, not the interpretation that the police wrote up that she probably didn't even read. Could she have made it any more clear that those events seem more unreal to her than what she had been saying up until that night that she had stayed at Raffaele's house.

Esposito's confession came after an 18 hour interrogation, not 90 minutes. And it was eventually shown he had a verifiable alibi. So I'm guessing it's not even remotely analogous.

Where does griff get 90 minutes from? Amanda's interrogation that evening begins at 22:32. For this we have a time stamped audio recording that was presented in the trial. And that's not counting the many hours that she spent in the presence of the police in the preceding days.

We also have the alibis. Raffaele provides an alibi for Amanda saying she was with him that evening. Raffaele's computer shows that he was home till at least 21:26. The Swiss professor and several students provide alibis for Patrick saying he was at his pub. And if that's not enough, there is Toto saying Amanda and Raffaele were at the basketball court all night from 9pm till almost midnight.

I think we covered this. In Amanda's first statement, which she signed, she said Lumumba had sex with Meredith, followed by screams, and that she 'vaguely' remembered Lumumba murdering her.

Now this is simply bizarre. How does one "vaguely" remember a murder? But Amanda offers an insite into how that portion of the interrogation proceeded in her testimony:
CP: Signorina Amanda, listen. On the evening of November 1, 2007, did you hear Meredith, poor Meredith, scream?

AK: No.

CP: In the interrogation of November 6, 2007, at 5:45, you declared that before she died, you heard Meredith scream. How could you know that Meredith screamed before she was killed? Who told you?

AK: So when I was with the police, they asked if I heard Meredith's scream. I said no. They said "But if you were there, how could you not hear her scream? If you were there?" I said "Look, I don't know, maybe I had my ears covered." So they said "Fine, we'll write that down. Fine."

All the talking points well laid out. The alternative, more likely scenario, is that the police asked her to elaborate, she swore she couldn't remember any more details, and they took her statement.

But admittedly, this is my total speculation countering your total speculation. The difference is my speculation includes an outrageous, offensive lie by AK, whereas your speculation requires a belief in a vast conspiracy by the police.

The reality is that Italian law sets very strict guidelines in the interrogation of suspects. As soon as the police thought Amanda was saying that she was present at the time of the murder, the law says the interrogation must end immediately and her status as a suspect and her rights must be explained. The cops did stop the interrogation but then proceeded to write up their summary and have Amanda sign it. The Italian Supreme Court quite rightly declared that the statements were inadmissible against her but here griffin is using it.

Yet Amanda never told the police the truth that Lumumba wasn't invlved at any time. I know, she was confused and pressured, villified and scapegoated. But during her victimhood, she never once told the truth about Lumumba. I guess she remained confused until well after he was released.

There is her hand written statement from that very same day in which she says: "but the way the truth feels in my mind, there is no way for me to have known because I don't remember FOR SURE if I was at my house that night.". How is it that griffin doesn't accept this as a retraction of any claim that Patrick was the murderer?

Truth or fiction

The propositions in the false statement are in two parts:
1) Lumumba had sex with Ms Kercher and (confusedly remembered) he killed her.
2) Ms Knox was in the kitchen when this happened.

Leaving aside the question of admissability, what, objectively do we know about the murder, that without this statement, we would not know?

The answer is - absolutely nothing at all. Patrick Lumumba dîd not have sex with Ms Kercher and did not kill her. So we know that Part 1 is untrue. The PG community agrees it is untrue and that it has no bearing whatsoever on the objective question of who killed Ms Kercher - Lumumba is not involved.

Since Part 1 is entirely untrue, why should anyone believe Part 2? Part 2 is merely evidence for the truth of the propositions in Part 1, with Ms Knox an ear witness to the murder. Once the propositions contained in Part 1 have been disproved by other means, (alibi), there is no logical reason to hold that Part 2 has any value whatsoever as evidence of Ms Knox's own possible involvement in the murder. Notwithstanding this, at no time did Ms Knox admit to having any involvement whatsoever, in the murder.

Interestingly, the only time Ms Knox is believed by the PG community to have been truthful in what she has said in connection with the murder of Meredith Kercher, is when she retracted her statement that she heard Patrick Lumumba killing her. The PG community believe her on this point because they have objective, irrefutable proof of the truth of what she says in the form of an alibi witness for Lumumba. Indeed, Mignini required this unimpeachable, irrefutable evidence in order to release Lumumba (albeit he waited some considerable time after he had it before he acted).

Why do the PG community and the prosecutors and the courts require a standard of proof superior by many orders of magnitude to believe some things are true but not others, when a lower standard is acceptable? Why does Lumumba require an unimpeachable alibi to be let out of prison but an uncorroborated witness statement from someone already thought to be a liar, to put him there in the first place? Someone can explain this?

To be serious for a moment

Sollecito testified before Matteini and Ricciarelli. On those occasions he did not provide an alibi to Amanda Knox. That one is his last position before a judicial organ.
Then, on December 22. 2007 he refused to answer the questions before Mignini.
He never testified in the trial.

Actually Mach there is a little more to say on this issue.

I know a lot of fun has been had with the groupies w.r.t the fact that subsequent to the GIP hearing of Nov 8 2007 [ where he hedged ] RS has never given AK an alibi.

However in legal terms it’s quite straightforward apparently.
As a result of the ‘motion’ [presumably the 2008 Supreme? Court submission] by the RS defence team & this was the point of the exercise apparently ....................
This wishy washy non-alibi was not usable in the trials. That was the whole point of the ‘action’ of RS’s defence team.

Legally he was never giving her an alibi and that was being made clear to the courts by his defence.

So all this talk of alibis is somewhat surreal.

Such unadulterated fictional nonsense.

Raffaele Sollecito's explanation of his whereabouts and the whereabouts of Ms Knox are comprehensively laid out on pages 16-22 of his book, "Honour Bound".
There is no question whatsoever that each provides the other with an alibi for the entire range of time even the PLE thugs can dream up and stretch to accommodate the murder.

Fontenot, Esposito, and false statements

griffinmill,

Esposito confessed to accidently starting a fire, but he was charged with deliberately starting it. Amanda made a statement to the effect that she confusedly remembered that Patrick killed her, but she has now been convicted by a judge who said that she held the knife. It might be helpful also to recall that Karl Fontenot confessed after only 2 hours of interrogation, and it was an interrogation in English. And as others have pointed out, the 90 minute figure you provided is bogus. Why guess when Google can be your friend?

We'll let the lurkers decide.
griffinmill,

False, coerced statements are an empirical fact, and obtaining one doesn't require that much ill-judged or unethical behavior. When you bandy about silly phrases such as "a vast conspiracy," I begin to wonder why anyone should take your arguments seriously.

handwrittten statement of 7 November

griffinmill,

PG posters used to say that Amanda never withdrew her false statement. You probably know that she did so within 36 hours, and that may well explain the peculiar wording of your comment. She said that she was not there and could not know what had happened.

at no time did Ms Knox admit to having any involvement whatsoever, in the murder.

She did admit that she was involved in Meredith's death in her letter to the police.

She wrote: "Everything I have said in regards to my involvement in Meredith's death, even though it is contrasting, are the best truth that I have been able to think."

She was involved in Meredith's death.

She mostly thinks she was at Raff's but ...er...ah yes, maybe there IS a possibility that she was home at the cottage: but either way one thing knows: although she didn't murder Meredith, she was involved in her death.

You girls can say what you like.... in the US, that memorandum would have gotten her in the slammer so fast.....

And isn't is strange: as Lumumba is sitting in jail where are the statements one would naturally expect:

"I'm innocent but you mean to say Lumumba murdered Meredith? Why in the world would my boss want to murder her? WTF!!!! "I was working for a killer!!!!" "He's never been to our house! Did he have a date with Meredith? "Oh my God....somebody tell me what happened???!!!!"

You need to learn how to interrogate language for meaning. At no time anywhere, anyhow in any way, shape or form, did Ms Knox make any statement whatsoever, that could be construed to mean that she planned, instigated, carried out or committed, alone or with others, the murder of Meredith Kercher.

You might FEEL she did, but if you look at the evidence, you must THINK she did not.

False confessions are involved in fully 1/4 of US exonerations because of DNA.

The inability of the pro-guilt lobby to recognize the reality of this is a major issue. The pro- guilt lobby simply ignores it, each individual of which claiming, "only a guilty person would confess. I know if I were innocent I'd never."

I truly hope you never get a chance to find out.

And this:

Finally the fact that the police "lost" arguably the most vital single piece of evidence in their case, the recording of the one confession which was the keystone of their entire narrative, has to be seen as highly suspicious..

The Knoxians just make things up and then discuss among themselves as if the things they've made up, are actually facts.

The Kevin Lowe account has proof that Knox was taped that evening, that the tapes were lost, and that Mignini acknowledges that the tapes were lost.

For the Kevin Lowe account, these are facts.

More disingenuous nonsense. She said that she was not there and could not know what had happened. Once you are in custody, you should talk to your lawyer and let your lawyer talk to the authorities. That is what they are paid to do. If anything Amanda and Raffaele should have said less, not more, during the month of November. MOO.

But they were in a bind, because they were in custody and hopeful of release. That will have been their uppermost consideration. Prison is not a nice place and they had studies and lives to get on with. Their focus that month and the next was to secure release. It's hard to play it long when you don't know what's round the corner and it's your life that's being screwed up.

Mignini knew exactly what he was doing when he got them locked up by Matteini (hasn't Mach told us she was the judge who secretly authorised the invasion of Raf's place on the night of the 5th-6th?). He played dirty.

But they were in a bind, because they were in custody and hopeful of release.

Besides Amanda Marie Knox's writtings and memorandum while in jail, RS diary too: no surprise, shock or bewilderment about bar owner Lumumba being the murder of Knox's best friend and flatmate.

(How could the bastard do such a thing!!!!)

How can one argue with this drivel? The police told her Patrick was involved and for a while she believed them while clearly being confused. It's not hard to understand. It helps if you stop sneering so much. Then you will see better. She also had good reason to be preoccupied with her own desperate situation.

No doubt we're heading back to this guilter nonsense about her not telling the cops Lumumba was innocent (a fact she could not know). How wearisome.
